About social protection of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site

(as amended on 27-06-2022)

The testing of nuclear weapon which were carried out within 40 years on the Semipalatinsk test nuclear test site caused irreplaceable damage to health of people and the surrounding environment, caused growth of general incidence and death rate of the population. All territory Semipalatinsk and districts of the Pavlodar, East Kazakhstan and Karaganda regions, adjacent to the ground, are recognized as zone of ecological catastrophe.

More and more harmful the remote consequences of nuclear testing which pass from father to son affect.

Liquidation of these consequences requires implementation of package of measures for treatment, improvement, rehabilitation, social protection of the population and to social and economic development of the territory.

Chapter 1. General provisions

Article 1. Purposes and tasks of the Law

This Law is recognized to provide social protection of the citizens who were injured owing to long nuclear testing on the Semipalatinsk test nuclear test site.

The law establishes the status of citizens and classification of the territories which were affected by impact of long-term nuclear explosions, determines the list of compensations, privileges and actions for social and economic development of the territory.

Article 2. The rights of citizens to compensation of the damage caused to their health and property

The categories of citizens listed in article 10 of this Law have the right to compensation of the damage caused to their health and property in the sizes determined by Articles 12, of 13, of 14, 15 these Laws.

Operation of this Law extends to the citizens living in areas and the cities of the Semipalatinsk region and the respective districts of the Pavlodar, East Kazakhstan and Karaganda regions which underwent to pollution by radioactive materials owing to testing of nuclear weapon.

The citizens who left the specified areas and the cities on other residence, falling under operation of this Law and living in the territory of the Republic of Kazakhstan use the privileges provided by this Law.

The citizens who left the specified areas and the cities on other residence, getting under operation of this Law and living outside the territory of the Republic of Kazakhstan use the privileges provided by this Law according to interstate agreements.

Article 3. Obligations of the state on providing the rights of the citizens who were injured owing to nuclear testing

Republican and local state bodies shall provide the rights of the citizens who were injured owing to nuclear testing to compensation of the damage caused to their health and property.

The state undertakes obligations on implementation of complex of necessary measures and legal protection of citizens on implementation of this Law.

Chapter 2. Classification of the territories which were affected by nuclear testing

Article 4. Classification of the territories which were affected by radioactive fallout when carrying out nuclear testing

On what the effective equivalent dose of radiation for the population exceeds 0,1 of rem for the entire period of testing are considered as the polluted territories.

Depending on the size of effective equivalent dose the polluted territories are subdivided on:

- zone of extreme radiation risk;

- zone of the maximum radiation risk;

- zone of the increased radiation risk;

- zone of the minimum radiation risk;

- the territory with the preferential social and economic status.

Types of economic activity and procedure for its organization, amount of environmental management and ecological rehabilitation of the territory are established by the Government of the Republic of Kazakhstan.

Borders of zones of ecological catastrophe and the list of the areas entering them change by introduction of amendments and (or) amendments to this Law according to the procedure, stipulated by the legislation the Republic of Kazakhstan.

Article 5. Zone of extreme radiation risk

Zone of extreme radiation risk - part of the territory which underwent to radiation pollution, with impact dose on the population over 100 rem for the entire period of testing, entering strip of the maximum seismic impact.

The territories of the Sarzhalsky rural district of Abaysky district, the Dolonsky rural district of Beskaragaysky district, settlements Sarapan and Iza of the abolished Zhanasemeysky district of East Kazakhstan area belong to zone of extreme radiation risk.

Article 6. Zone of the maximum radiation risk

Zone of the maximum radiation risk - part of the territory which underwent to radiation pollution with impact dose on the population from 35 to 100 rem for the entire period of testing.

Settlements of the Abaysky, Beskaragaysky and abolished Zhanasemeysky areas, Akbulaksky, Abralinsky, Algabassky, Aynabulaksky, Karaolensky and Tanatsky rural districts of the city of Semey of the East Kazakhstan region, Akzharsky and Maldarsky rural districts of the May region of the Pavlodar region belong to zone of the maximum radiation risk.

Article 7. Zone of the increased radiation risk

Zone of the increased radiation risk - part of the territory which underwent to radiation pollution with impact dose on the population from 7 to 35 rem for the entire period of testing.

Settlements of Borodulikhinsky, Zharminsky, Ayaguzsky, Glubokovsky, Shemonaikhinsky, Ulansky districts, the cities of Semey, Kurchatov, Ust-Kamenogorsk and Ridder of the East Kazakhstan region belong to this zone; Karkaralinsky district of the Karaganda region within the territory of the abolished Kazybekbiysky district, the May region of the Pavlodar region.

Article 8. Zone of the minimum radiation risk

Zone of the minimum radiation risk - part of the territory which underwent to radiation pollution with impact dose on the population from 0,1 to 7 rem for the entire period of testing.

Settlements of Urdzharsky abolished the Taskeskensky, Kokpektinsky, Aksuatsky, Zyryanovsky, Zaysan and Tarbagatai areas of East Kazakhstan region belong to zone of the minimum radiation risk; Karkaralinsky district of the Karaganda region, not including the territory of the abolished Kazybekbiysky district; Lebyazhinsky district of the Pavlodar region.
