About approval of Rules of safety control of transportations by road transport and urban land electric transportation

1. Approve the enclosed Rules of safety control of transportations by road transport and urban land electric transportation.

2. This order becomes effective since September 1, 2021 and is effective till September 1, 2026.

Rules of safety control of transportations by road transport and urban land electric transportation

1. Rules of safety control of transportations by road transport and urban land electric transportation determine safety requirements under the organization and implementation of transportations by road transport and urban land electric transportation.

2. These rules are obligatory for:

the legal entities and individual entrepreneurs performing public conveyances based on the transportation agreement of the passenger or the charter agreement;

the legal entities and individual entrepreneurs performing carriages of goods by road transport and urban land electric transportation based on the transportation agreement;

the legal entities and individual entrepreneurs performing movement of persons, except the driver, and (or) material objects by buses and cargo vehicles without the conclusion of the specified agreements;

the physical persons performing operation of cargo vehicles which permitted maximum mass exceeds 3500 kilograms, and buses <1>.

3. Under the organization and implementation of public conveyances and (or) loads the legal entities and individual entrepreneurs specified in Item 2 of these rules (further - subjects of transport activities) shall provide:

availability at workers of necessary knowledge, abilities, professional education, years of service (experience);

the admission to management of vehicles or vehicle control independently in the absence of signs of diseases (conditions) which are medical contraindications <2>;

carrying out input, pretrip, seasonal and special instructing in safety of public conveyances and (or) loads;

safety of the vehicles operated by the subject of transport activities;

safe conditions of public conveyances and loads, including transportations in special conditions;

respect for features of the mode of on-duty time and time of rest, working conditions of drivers of the cars established by the Ministry of Transport of the Russian Federation according to article 329 of the Labor Code of the Russian Federation>, regarding regulations of time of vehicle control and time of rest (does not extend to the drivers occupied on international carriages and transportations by urban land electric transportation);

respect for features of the mode of on-duty time and time of rest of the tram drivers and the trolleybus established by the Ministry of Transport of the Russian Federation according to article 329 of the Labor Code of the Russian Federation (does not extend to the drivers occupied on transportations by road transport);

observance of the work-rest schedule set by the European agreement concerning work of crews of the vehicles making the international motor transportations (ESTR) of July 1, 1970 <4> (does not extend to the drivers who are not occupied on international carriages);

4. Under the organization and implementation of public conveyances and (or) loads the physical persons specified in Item 2 of these rules (further - physical persons) shall provide:

vehicle control for lack of signs of diseases (conditions) which are medical contraindications <2>;

safety of the vehicles operated by physical person;

safe conditions of public conveyances and loads, including transportations in special conditions;

the observance of regulations of time of vehicle control and rest established by traffic regulations;

carrying out the analysis and elimination of the reasons of road accident and road traffic offenses with participation of the vehicles <6> belonging to them.

5. Ensuring availability with the subject of transport activities at workers of necessary knowledge, abilities, professional education, years of service (experience) of work shall be reached by means of:

carrying out professional selection and professional training of drivers according to procedure for passing of professional selection and professional training by the workers employed, directly connected with movement of vehicles of road transport and urban land electric transportation <7>;
