ORDER OF THE MINISTER OF ECOLOGY, GEOLOGY AND NATURAL RESOURCES OF THE REPUBLIC OF KAZAKHSTAN

About approval of the Method of carrying out gas monitoring in case of operation of polygon

According to Item 5 of article 355 of the Ecological code of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve the enclosed Method of carrying out gas monitoring in case of operation of polygon.

2. Recognize invalid some orders:

1) the order of the Minister of environmental protection of the Republic of Kazakhstan of January 12, 2012 No. 6-p "About approval of the Method of carrying out gas monitoring for each section of solid waste landfill" (it is registered in the Register of state registration of regulatory legal acts for No. 7411);

2) the order of the Minister of Energy of the Republic of Kazakhstan of January 25, 2016 No. 26 "About introduction of amendments to the order of the Minister of environmental protection of the Republic of Kazakhstan of January 12, 2012 No. 6-p "About approval of the Method of carrying out gas monitoring for each section of solid waste landfill" (it is registered in the Register of state registration of regulatory legal acts for No. 13329).

3. To provide to department of state policy of waste management of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Method of carrying out gas monitoring in case of operation of polygon

1. This method of carrying out gas monitoring in case of operation of polygon (further - the Technique) are developed according to Item 5 of article 355 of the Ecological code of the Republic of Kazakhstan (further - the Code) and it is intended for carrying out gas monitoring in case of operation of polygon.

2. Control, monitoring and (or) carrying out analyses are carried out by accredited laboratories according to Item 3 of article 355 of the Code.

3. Gas monitoring for each section of polygon begins prior to operation of polygon and continues before completion of process of biological decomposition of waste. In case of construction of new polygons the natural background level of methane and carbon dioxide is established. Background level of methane and carbon dioxide is established prior to operation of polygon.

4. Gas monitoring is carried out:

in the thickness of waste where the quantity and composition of the formed gas is determined;

on surface of polygon and the sanitary protection zone of object for identification of cases of uncontrollable gas discharge on surface.

5. The organization of network of observations for gas monitoring of polygons are given in appendix 1 to this Technique.

Carrying out monitoring, including in case of determination of level of pollution of atmospheric air is performed at the same time days and in the same calendar day of month.

Points of monitoring are placed in the same geographical coordinates.

6. Frequency of implementation of selection and the analysis is proved in the program of monitoring attached to ecological permission to impact according to the order of the acting minister of ecology, geology and natural resources of the Republic of Kazakhstan of August 9, 2021 No. 319 "About approval of Rules of issue of ecological permissions, submission of the declaration on impact on the environment and also blank forms of ecological permission to impact and procedure for their filling" (it is registered in the Register of state registration of regulatory legal acts for No. 23928).

7. The wells constructed in the thickness of waste are necessary for monitoring of level of concentration of gas and its movement in polygon body. These wells are under construction separately from system of collection and release of gas and are used as control points for determination of level of decomposition of waste and environmental impact.

8. Wells for monitoring are established at distance of at least 20 meters from body of waste. Depth of wells equals to the maximum depth of waste in polygon body.

9. In body of polygon control points on cell perimeter for monitoring of gas on section of the polygon equipped with the antifiltrational screen are established. On the polygons which do not have the antifiltrational screen, control points are established with density of one control point on one hectare of the area filled with waste.

10. The arrangement of control points of monitoring of gas outside thickness of waste depends on specific polygon. In case of the choice of location of these points it is considered:

1) structure and amount of the formed gas;

2) geological conditions of the territory;

3) type of waste;

4) the measures constraining gas distribution;

5) the antifiltrational screen or the upper isolating layer;

6) proximity to buildings and constructions of polygon;

7) coefficient of filtering waste.

11. Test of filtrate and surface water is selected in representative Items. Implementation of selection and measurement of amount and structure of filtrate are carried out separately in each Item of the site where the filtrate is formed.
