About approval of the Regulations on the Supreme council of safety

Based on part (1) article 94 of the Constitution of the Republic of Moldova and article 12 of the Law on state security

The president of the Republic of Moldova DECIDES:

Art. 1. - Approve Regulations on the Supreme council of safety according to appendix.

Art. 2. - Declare invalid the Regulations on the Supreme council of safety approved by the Presidential decree of the Republic of Moldova No. 331-II of October 8, 1997.

Art. 3. - This decree becomes effective from the date of publication.

Regulations on the Supreme council of safety

Chapter I General provisions

Art. 1. - The supreme council of safety is the consultative body analyzing activities of the ministries and other central administrative authorities in the field of ensuring national security and represents recommendations to the President of the Republic of Moldova concerning foreign and domestic policy of the state.

Art. 2. - The supreme council of safety performs the activities according to the Constitution of the Republic of Moldova, the Law on state security, other legal acts and this provision.

Art. 3. - (1) the Supreme council of safety considers national security issues on the basis of the multilateral approach caused as situation in political, military, legal areas and area of public order of the country, and financial and economic, social, information, educational, ecological, administrative, energy, etc.

(2) In the activities the Supreme council of safety pays priority attention to consideration of the special threats of homeland security connected with corruption in large sizes and organized crime.

Chapter II of Function of the Supreme council of safety

Art. 4. - The supreme council of safety performs the following functions:

a) gives help to the President of the Republic of Moldova in implementation of its constitutional powers for the purpose of protection of sovereignty, independence and territorial integrity of the Republic of Moldova;

b) advises the President of the Republic of Moldova concerning domestic and foreign policy of rather homeland security and defense;

c) coordinates and monitorizirut political documents in the field of ensuring national security and defense;

d) analyzes threats and risks for homeland security and defense and develops offers on their prevention and fight against them;

e) develops offers to the President of the Republic of Moldova for the purpose of optimization of system of ensuring national security and defense;

f) represents to bodies of the public power of the offer and recommendation about national security issues and defenses;

g) develops effective analysis system, examination and strategic planning for ensuring national security and defense, including in crisis situations.

Art. 5. - (1) For the purpose of realization of the functions the Supreme council of safety:

Develops 1) and claims:

a) decisions concerning domestic and foreign policy in the field of ensuring national security and defense;

b) decisions according to the prevention and counteraction to emergency situations with serious socio-political, economic, military, sanitary, ecological and other consequences;

c) recommendations to the President of the Republic of Moldova on national security issues within its constitutional powers, relatively:

- implementation of the common directorship activities for ensuring national security and defense;

- acceptances of necessary measures for ensuring national security and defense;

- ensuring cooperation of bodies of the public power in the field of ensuring national security and defense;

- publications of decrees concerning ensuring national security and defense;

- negotiating and the conclusion of the international treaties on behalf of the Republic of Moldova connected with ensuring national security and defense.

Considers 2):

a) political documents in the field of homeland security and defense;

b) plans of interaction of the Ministry of Defence, Ministry of Internal Affairs, Ministry of Justice, Service of information and safety of the Republic of Moldova, Service of the state protection and other bodies for ensuring national security and defense;

c) drafts of international treaties in the field of homeland security and defense;

d) drafts of regulations on the main national security issues and defenses;

e) the reports and data provided by bodies of the public power concerning homeland security and defense;

f) plans for equipment by weapon, ammunition, special equipment of law-enforcement bodies and state security;

g) plans for participation of the Republic of Moldova in international missions and transactions;

h) army regulations and regulations on the General Staff of Armed forces;

i) plans for mobilization of national economy;

j) strategic plans of mobilization, use, construction, development, training, equipment and financing of Armed forces;

k) offers on provision of the highest military ranks;

l) general structure and staff of Armed forces;

Analyzes 3):

a) the problems connected with domestic and foreign policy in the field of ensuring national security and defense;

b) activities of bodies of the public power and the public institutions responsible for the prevention and counteraction to threats to safety, including cases of corruption undermining homeland security;

c) extent of combat training and mobilization of forces of national system of defense;

d) the situations requiring the announcement of emergency, obsidional and warlike situation;

e) the problems connected with creation, control and maintenance in permanent readiness of force and instrument for ensuring of homeland security and defense.

Monitorizirut 4):

a) implementation of Strategy of homeland security of the Republic of Moldova;

b) implementation of the industry concepts, doctrines and strategy concerning homeland security and defense;

c) execution of decisions of the Supreme council of safety and presidential decrees of the Republic of Moldova in the field of homeland security and defense.

(2) Performs also other functions provided by the law.

Chapter III Organization and functioning of the Supreme council of safety

Art. 6. - (1) the Supreme council of safety consists of the chairman, the secretary and members of council.

(2) the Chairman of the Supreme council of safety is the President of the Republic of Moldova.

(3) the Secretary of the Supreme council of safety is the adviser to the President of the Republic of Moldova in the field of defense and homeland security.
