Section 1. General provisions

Article 1. Purposes and tasks of the Law

This Law is designed to provide social protection of the citizens injured with the Aral environmental disaster and determines their status, classification of the territories, establishes compensations and privileges to persons needing measures of social resettlement fixes basic approaches to forming of system of protection of life and health of the population living in ecologically adverse areas, providing conditions of steady activity, priority supply of the population with organic food, medical means, drinking water, improvements of sanitary and epidemiologic situation.

Article 2. Classification of ecologically unsuccessful territories of the Kazakhstan part of Priaralya

environmental disaster;

ecological crisis;

ecological pre-crisis condition.

Article 3. Zone of environmental disaster

1. The main criteria of delimitation of zone of environmental disaster are:

strong growth of death rate of the population;

forced migration for the ecological reasons;

excess of standard rates of maximum-permissible concentration of pollutants in the surrounding environment in sizes, life-endangering the populations;

final fracture of ecosystems and loss by them of capability to self-recovery;

the catastrophic shallowing of water objects exceeding century fluctuations.

2. The zone of environmental disaster includes the territories of the Aral and Kazalinsky districts of Kyzylorda area, Chelkarsky district of the Aktyubinsk region.

Article 4. Zone of ecological crisis

1. The main criteria of delimitation of zone of ecological crisis are:

strong growth of specific population morbidity;

excess of standard rates of maximum-permissible concentration of pollutants in the surrounding environment in the sizes hazardous to health of the population;

reducing specific structure and violation of structural integrity of ecosystems, decrease in bioproductivity of ecosystems by 75 percent;

the crisis shallowing of water objects exceeding mean annual fluctuations.

2. The zone of ecological crisis includes the territories of regions of the Kyzylorda area (except specified in Article 3), the city of Kyzylorda and the city of Baikonur, including the settlements entering its administrative-territorial subordination.

Article 5. Zone of ecological pre-crisis condition

1. The main criteria of delimitation of zone of ecological pre-crisis condition are:

the strong growth of population morbidity having causal relationship with ecological crisis state;

steady excess of standard rates of maximum-permissible concentration of pollutants in the surrounding environment;

reducing quantitative specific structure of ecosystems and fall of their bioproductivity for 50 percent at least;

the shallowing of water objects exceeding mean annual fluctuations.

2. The zone of ecological pre-crisis condition includes Bayganinsky's territories, Irgizsky, Mugalzharsky (within borders of settlements of the former Mugodzhar district), Temirsky districts of the Aktyubinsk region; Aryssky (including the city of Arys), Otrarsky, Suzaksky, Chardarinsky districts, the city of Turkestan and rural districts of the Step, Jean-Icahn, Eski Icahn, Ushkayyk, Iassa, Orangay, Karashyk, Zhuynek, Babaykorgan, Shornak, Zhibek of zhola, Maydantal of the city of Kentau of the Turkestan region, and also Ulytausky district (within borders of settlements of the former Zhezdinsky district of the Zhezkazgan region) the Karaganda region.

Article 6. The status of the citizens who were injured owing to environmental disaster

Owing to environmental disaster treat victims:

1) citizens the living or living at least 10 years since 1970 till present in the territory which received in accordance with the established procedure the status of zone of environmental disaster (including children aged up to ten years);

2) the citizens who lost health from the disease having causal relationship with ecological disaster, living or living in this zone, at least 3 years.

Article 7. The status of the citizens who were injured owing to ecological crisis

Owing to ecological crisis treat victims:

1) citizens the living or living at least 15 years since 1975 till present in the territory which received in accordance with the established procedure the status of zone of ecological crisis (including children aged up to 15 years);

2) the citizens who lost health from the disease having causal relationship with ecological disaster, living or living in this zone, at least 5 years.

Article 8. The status of the citizens who were injured owing to influence of ecological pre-crisis condition

Owing to ecological pre-crisis condition treat victims:

1) citizens the living or living at least 20 years since 1975 till present in the territory which received in accordance with the established procedure the status of zone of ecological pre-crisis condition (including children and teenagers aged up to 18 years);

2) the citizens who lost health from the disease having causal relationship with ecological disaster, living or living in this zone, at least 7 years.
