About simplification of customs procedures and further enhancement of organizational structure of bodies of the State Customs Service

According to the Presidential decree of the Republic of Uzbekistan of June 5, 2020 No. UP-6005 "About Reforming of Customs Administration and Enhancement of Activities of Bodies of the State Customs Service of the Republic of Uzbekistan", and also for the purpose of further increase in efficiency of activities by widespread introduction of the advanced digital technologies in case of simplification of customs procedures:

1. Approve offers of the State Customs Committee on creation of extra categorized customs posts of remote electronic declaring within the total extreme number of staff of customs authorities:

since October 1, 2021 - in managements of the State Customs Committee on the Tashkent, Syr Darya, Kashkadarya and Khorezm regions;

since April 1, 2022 - step by step in other territorial administrations of the State Customs Committee.

2. Establish procedure according to which:

a) since October 1, 2021:

customs posts of remote electronic declaring carry out remote customs clearance of the electronic cargo customs declarations provided by participants of foreign economic activity (further - foreign trade activities);

activities of customs posts of foreign trade activities in the territories in which customs posts of remote electronic declaring are created specialize in implementation of forms of customs control;

the procedure for the organization of activities of customs posts of remote electronic declaring and foreign trade activities, and also border customs posts is established by the State Customs Committee;

the monthly allowance in the amount of 40 percent of official pay rate is paid to employees of groups on work with inspection and customs complexes (scanners) of border customs posts for harmful working conditions at the expense of means of the Government budget of the Republic of Uzbekistan;

b) since December 1, 2021 at check points of cars through Frontier of the Republic of Uzbekistan:

tasks of check and execution of the corresponding documentation on goods of veterinary and phytosanitary bodies are carried out by means of the customs information system "Single Window" or information systems integrated with it;

practice of putting down of seal and registration of commodity-transport documents by veterinary and phytosanitary bodies is cancelled;

practice of advance payment of all subjects to payment of charges on the basis of the single invoice before entrance of vehicles to the border check-point takes root;

c) since January 1, 2022:

after adoption by customs authorities of the decision on return of excessively paid or enforced customs payments these means return to participants of foreign trade activities within three working days;

the minimum term of delay or payment by installments of payment of customs payments establishes term in 14 days, during this term percent are not levied, in case of exceeding of the minimum term of delay or payment by installments of payment percent are charged completely for the entire period;

the size of the additionally accrued customs payments which are not subject to collection and return is established up to 20 percent of basic settlement size;

practice of conditional release of goods before completion of examination on determination of commodity code according to the commodity nomenclature foreign trade activities appointed by customs authority with ensuring payment of customs payments takes root;

the possibility of representation of single providing for ensuring obligation fulfillment on payment of customs payments of the participant of foreign trade activities within several customs transactions is created, such providing shall be sufficient for execution of all obligations on customs payments;

according to the statement of the participant of foreign trade activities by customs authorities the provisional solution for determination of the amount of the customs payments which are subject to payment on goods is made.

3. Approve the offer of the State Customs Committee on creation in the structure of the Central customs laboratory with the status of the isolated legal entity within the total extreme number of staff of customs authorities.

To the State Customs Committee (M. B. Azimov) in two-month time to introduce to the Cabinet of Ministers the draft of the resolution providing the organization of activities of the Central customs laboratory including receipt of the status of Regional customs laboratory of World Customs Organization, determination by this laboratory of structure of the nicotinocontaining products and alcoholic drinks, rendering other services connected with conducting examination and certification of goods and also conducting examination of drugs, psychotropic substances and their precursors and other types of judicial and criminalistic examination.

4. Determine that in case of modification and amendments in organizational structure of customs authorities, including the organization of activities of customs posts of remote electronic declaring according to this Decree, the additional expenses connected with compensation of employees till January 1, 2022 are made at the expense of Special fund of financial support, social protection, development of customs authorities and contingencies of the State Customs Committee, since January 1, 2022 - at the expense of the Government budget.

5. Approve the list of the liquidated customs posts of the State Customs Committee according to appendix No. 1.

6. Make changes and additions to some acts of the President of the Republic of Uzbekistan according to appendix No. 2.

7. To the State Customs Committee:

a) in a month to develop and accept procedure for the organization of activities of customs posts of remote electronic declaring and foreign trade activities, and also border customs posts;

b) together with the interested ministries and departments in two-month time:

implement system of advance payment of the charges which are subject to payment to monitoring bodies at check points of cars through Frontier of the Republic of Uzbekistan on the basis of the single invoice, and also entrance and transit charges before entrance of vehicles to the border check-point;

develop and approve procedure for issue by customs authorities of the provisional solution for determination of the customs payments which are subject to payment on goods;

make in the Cabinet of Ministers offers on the changes and amendments in acts of the legislation following from this Decree.

8. Assign to the chairman of the State Customs Committee M. B. Azimov the personal responsibility for the effective organization of execution of this Decree.

Discussion of course of execution of this Decree, implementation of coordination and control of activities of the departments responsible for its execution to assign to the Prime Minister of the Republic of Uzbekistan A. N. Aripov.
