About concurrent engineering and construction of facilities and implementation of ministerial procedures

In pursuance of Item 5 of the Presidential decree of the Republic of Belarus of February 26, 2021 "About implementation of construction activities" and Item 2 of the Presidential decree of the Republic of Belarus of May 4, 2021 No. 176 "About housing bonds" the Council of Ministers of the Republic of Belarus DECIDES: No. 58

1. Approve Regulations on concurrent engineering and construction of facilities it (is applied).

2. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022 No. 175

2.2. to add subitem 6.1.2 of Item 6 of the Regulations on procedure for conducting state examination of the town-planning projects, architectural, construction projects allocated in them queues of the construction, start-up complexes and estimates (estimate documentation) approved by the resolution of Council of Ministers of the Republic of Belarus of September 30, 2016 No. 791, with the paragraph of the following content:

"construction projects on stages of works in case of concurrent engineering and construction of facilities;".

3. This resolution becomes effective in the following procedure:

subitem 2.1 of Item 2 of this resolution - since November 7, 2021;

other provisions of this resolution - after its official publication.

Regulations on concurrent engineering and construction of facilities

1. This Provision developed based on subitem 1.9 of Item 1 of the Presidential decree of the Republic of Belarus of January 14, 2014 No. 26 "About measures for enhancement of construction activities" determines procedure of concurrent engineering and construction of facilities.

2. In this Provision the following terms and their determinations are used:

linear object – roads, the railroads, the subways, power lines, communication lines, pipelines, channels;

objects of housing and communal services – constructions of centralized systems of water supply, water disposal (sewerage), objects according to the address with solid utility waste, bridge constructions in settlements;

concurrent engineering and asset construction – allocation in the construction project of stages of works with performance of works on asset construction at the current stage along with accomplishment of project works on the subsequent stages in the presence of the architectural project approved in accordance with the established procedure;

technological objects of the industry – objects of the industry, including fuel and energy complex on which engineering procedure of conversion of raw materials and materials, transportations and distributions of finished goods is performed;

unique objects of the national level – theaters, the museums, art and exhibition complexes, national sports constructions, luxury hotels, and also the objects included in the State list of historical and cultural values of the Republic of Belarus;

stage of works – set technologically connected among themselves construction, the commissioning forming the finished element of the built, reconstructed, restored construction object, allocated in accordance with the established procedure in the project documentation and the construction contract.

3. Concurrent engineering and construction of facilities is allowed in cases of implementation of construction activities for construction, reconstruction, restoration:

the objects of social infrastructure included in the State investing program, and also in regional investing programs;

linear objects;

objects of engineering infrastructure in free economic zones;

construction objects necessary for functioning of meliorative and water management systems;

technological objects of the industry;

unique objects of the national level;

objects of housing and communal services.

Concurrent engineering and asset construction is not allowed concerning apartment houses.

4. Implementation of concurrent engineering and the construction of facilities specified in Item part one 3 this provision is allowed based on availability of the Section of the reasons for investments determining the project budget and efficiency evaluation of investments developed as a part of preproject (pre-investment) documentation on construction object (except for objects on which preproject (pre-investment) documentation is developed in the form of design assignment), and it is specified in design assignment.

The decision on implementation of concurrent engineering and asset construction is accepted:

The Ministry of Architecture – when financing object, except for objects of housing and communal services, with attraction of financial resources of the republican budget, including the state trust budget funds the, and also state non-budgetary funds, external state loans and external loans attracted under guarantees of the Government of the Republic of Belarus, the credits of the banks of the Republic of Belarus issued under guarantees of the Government of the Republic of Belarus, the credits of banks which repayment and servicing is performed at the expense of means of the republican budget;

regional, Minsk city executive committees – when financing object at the expense of means of local budgets, the credits of the banks of the Republic of Belarus issued under guarantees of local executive and administrative organs, the credits of banks which repayment and servicing is performed at the expense of the local budget, and also concerning objects of housing and communal services irrespective of financing sources;

the customer, the builder – when financing asset construction, except for objects of housing and communal services, at the expense of the sources which are not specified in paragraphs second and third to this part.

5. Development of the project documentation on construction object concerning which concurrent engineering and construction is conducted is performed according to requirements of acts of the legislation, including requirements of technical regulatory legal acts, obligatory for observance, in the field of architectural, town-planning and construction activities.

6. In case of concurrent engineering and asset construction two-phasic designing with development of the project documentation as a part of architectural and construction projects is carried out.
