RESOLUTION OF THE MINISTRY OF LABOUR AND SOCIAL PROTECTION OF THE REPUBLIC OF BELARUS

About assessment of reliability of data on labor activity and the salary

Based on Item 2 of the resolution of Council of Ministers of the Republic of Belarus of November 30, 2012 No. 1105 "About approval of the list of actions technical (technological, testing) nature" and subitem 7.1.10-2 of Item 7 of the Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1589, the Ministry of Labour and Social Protection of the Republic of Belarus DECIDES:

1. Determine that:

1.1. assessment of reliability of the data on labor activity and the salary provided by the employer for purpose of pensions (further if other is not established, - assessment of data), is performed by employees of committees on work, employment and social protection regional (The Minsk city) executive committees (further if other is not established, - committee), managements (departments) of work, employment and social protection city (except the cities of district subordination), district executive committees, managements (departments) of social protection of local administrations of areas in the cities (further if other is not established, - management (department) when studying the source documents containing these data, provided to committee, management (department) of the employer and (or) in case of visit of the employer located in the territory of the corresponding administrative and territorial unit;

1.2. when evaluating data employees of committee, management (department) estimate (study, compare):

the data on labor activity and the salary of workers containing in the source documents which are available for the employer and the data on labor activity and the salary provided by the employer for purpose of pensions;

the documents (their copy) on labor activity and the salary, certification of workplaces submitted by the employer under the terms of work, including in electronic form, other necessary information;

1.3. the decision on evaluating data is made by the head of committee, management (department) or the official authorized by it.

The decision on evaluating reliability of the data on labor activity and the salary provided by the employer for purpose of pensions in form according to appendix 1 is drawn up in duplicate, one of which is stored in committee, management (department) for the purposes of accounting of the held events for assessment of data, and another in five-day time after decision making is issued (it is sent by mail) to the employer.

Assessment of data cannot be performed by employees of management (department) if assessment of these data is carried out by employees of committee;

1.4. employees of committee, the managements (department) authorized on evaluating data have the right:

demand oral or written explanations from the employer or persons authorized by him on the questions arising during assessment;

in case of visit of the employer to enter on the territory and (or) objects of the employer;

1.5. by results of assessment of data in five-day time after its completion:

the appraisal report of reliability of the data on labor activity and the salary provided by the employer for purpose of pensions in form according to appendix 2 is drawn up (further if other is not established, - the act);

the instruction about elimination of violations in form according to appendix 3 is taken out (further if other is not established, - the instruction) in case of identification of violations of requirements of the legislation. The instruction is not taken out if the revealed violations are eliminated in day of evaluating data. About pronouncement of the instruction or elimination of the revealed violations without its removal the mark in the act becomes.

The instruction is drawn up in duplicate, one of which is stored in committee, management (department) for the purposes of control of elimination of the revealed violations, and another in five-day time after pronouncement of the instruction is issued (it is sent by mail) to the employer;

1.6. in case of accomplishment at the scheduled time instructions of measure of responsibility are not applied to the employer concerning whom such instruction is taken out.

In case of not elimination of the revealed violations in time, established in the instruction, identification of the further violations which are earlier established during assessment of data and also in case of identification of violations which elimination is impossible, measures of responsibility are applied according to the procedure, established by the legislation;

1.7. committees, managements (departments) provide accounting of the carried-out assessment in register of the carried-out assessment of reliability of data on labor activity and the salary in form according to appendix 4.

2. Declare invalid the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of December 28, 2012 No. 125 "About evaluation procedure of reliability of data on labor activity and the salary provided by the employer for purpose of pensions".

3. This resolution becomes effective after its official publication.
