1. Approve the enclosed Rules of maintaining the Register of emissions and transfer of pollutants.

2. Recognize invalid the order of the acting minister of power industry of the Republic of Kazakhstan of June 10, 2016 as No. 241 "About approval of Rules of maintaining the State register of emissions and transfer of pollutants" (it is registered in the Register of state registration of regulatory legal acts for No. 13968).

3. To provide to department of environmental policy and sustainable development of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan provision in legal department of service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining Register of emissions and transfer of pollutants

Chapter 1. General provisions

1. Rules of maintaining the Register of emissions and transfer of pollutants of the Republic of Kazakhstan (further - Rules) are developed according to Item 2 of article 22 of the Ecological code of the Republic of Kazakhstan and determine procedure for maintaining the Register of emissions and transfer of pollutants.

2. In these rules the following concepts are used:

the register of emissions and transfer of pollutants is the structured electronic database about condition of emissions of pollutants to the environment and levels of environmental pollution placed in open access on official Internet resource which is kept for the purpose of providing the right of everyone to access to ecological information and participation of the public in decision making process on the questions concerning the environment and also assistance to prevention and reducing environmental pollution;

"pollutant" means substance or group of substances which can be harmful to the environment or health of the person owing to their properties and as a result of their introduction to the environment, included in the list of pollutants for the reporting under industries established by Rules;

"emission" means any introduction of pollutants to the environment as a result of any activities irrespective of whether it is intended or emergency, planned or unplanned, including flood on the land surface and in water objects, issue in atmospheric air, dumping of pollutants into water objects, downloading pollutants in subsoil, waste disposal or their placement on the land surface or through systems of the sewerage without final sewage treatment;

"transfer" means movement out of limits of object of the pollutants or waste intended for removal or recovery, and also the pollutants containing in the sewage intended for cleaning;

"object" means one or several stationary sources on the same site or on adjacent sites which are in property of the same person or are operated by the same person.

Chapter 2. Procedure for maintaining Register of emissions and transfer of pollutants

3. The register of emissions and transfer of pollutants is kept:

1) in binding to specific objects - concerning the reporting under stationary organized sources;

2) separately by each type of pollutant and each type of waste - according to the list of pollutants for the reporting under industries established by rules of maintaining the register of emissions and transfer of pollutants;

3) on the basis of determination of issues to the environment - according to instructive-methodological documents.

Activities for maintaining the register of emissions and transfer of pollutants are performed by the subordinated organization of authorized body in the field of environmental protection.

4. The operators performing the types of activity stated in Annex 1 to these rules annually till April 1 represent to the Register of emissions and transfer of pollutants the reporting for the previous calendar year.

5. In the Register of emissions and transfer of pollutants information on pollutants which emission is performed from stationary and diffusion sources in the atmosphere, water and the earth, and also information on transfer of waste is provided.
