1. Approve:

1) the size and effective period of quota for import of white sugar and raw sugar reed on the territory of the Republic of Kazakhstan according to appendix 1 to this order;

2) Rules for apportionment of quotas for import of white sugar and raw sugar reed on the territory of the Republic of Kazakhstan according to appendix 2 to this order.

2. To provide to department of production and conversion of crop products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective from the date of official publication and extends to the legal relationship which arose since May 15, 2021.

Rules for apportionment of quotas for import of white sugar and raw sugar reed on the territory of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of distribution of quotas for import of white sugar and raw sugar reed on the territory of the Republic of Kazakhstan (further – Rules) are developed according to Item 3 of article 18 of the Law of the Republic of Kazakhstan "On regulation of trading activity" and subitem 7.1.34 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130 "On single customs and tariff regulation of the Eurasian Economic Union" and determine procedure for distribution of quotas for import of the white sugar intended for production of sacchariferous products, and raw sugar reed intended for industrial conversion on the territory of the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) quota – the fixed amount of the white sugar intended for production of sacchariferous products, and raw sugar reed, intended for industrial conversion which is exempted from payment of import customs duty when importing to the territory of the Republic of Kazakhstan;

2) goods:

white sugar – the white sugar classified by code 1701 99 100 of the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further – the CN FEA EEU) and intended for production of sacchariferous products;

raw sugar reed – raw sugar reed subline items of 1701 13 and 1701 14 CN FEA EEU, intended for industrial conversion.

Chapter 2. Procedure for distribution of quotas for import of white sugar and raw sugar reed

3. The authorized body no later than 3 (three) working days from the date of enforcement of these rules places on Internet resource of authorized body the announcement of order taking for participation in distribution of quotas for import of white sugar and raw sugar reed on the territory of the Republic of Kazakhstan (further – the announcement).

In the presence of amounts of quotas for import of white sugar and raw sugar reed, remained unallotted, the announcement is placed authorized body till August 16, 2021.

In the announcement the following information is specified:

1) quota amount which will be distributed between applicants;

2) date and time of the beginning and completion of order taking;

3) the commitment form on participation in distribution of quotas for import of white sugar to the territory of the Republic of Kazakhstan according to appendix 1 to these rules (further – the request);

4) the commitment form on participation in distribution of quotas for import of raw sugar reed on the territory of the Republic of Kazakhstan according to appendix 2 to these rules (further – the request).

The term of final date of submission of requests by applicants constitutes 8 (eight) working days from the date of placement of the announcement.

4. The request and documents attached to the request are numbered, proshnurovyvatsya and certified by the signature of the head of the applicant.
