About the ministerial procedures performed concerning subjects of managing

For the purpose of streamlining of regulation of business and other economic activity, and also further enhancement of procedure of ministerial procedures I decide:

1. Determine that the principles of implementation of ministerial procedures concerning subjects of managing (legal entities and individual entrepreneurs) (further - ministerial procedures) are:

availability and priority of accounting of interests of subjects of managing;

inadmissibility of failure in reception of an application of the subject of managing and implementation of ministerial procedure on the bases which are not provided by legal acts, resolutions of Council of Ministers of the Republic of Belarus and resolutions of Board of National Bank;

determination of the list of the documents and (or) data represented by the subject of managing for implementation of ministerial procedure, in case of inadmissibility of reclamation or can be requested from the interested person of the documents and (or) data which are not provided by legal acts, resolutions of Council of Ministers of the Republic of Belarus and regulations of ministerial procedures, and also documents and (or) data which are available for authorized body by it independently;

ensuring the greatest possible convenience of implementation of ministerial procedures, including by means of consolidation in service "one window";

the maximum use of information technologies in the course of implementation of ministerial procedures, including by their transfer in electronic form (further - digitalization of ministerial procedures);

proportionality of general administrative load of managing subjects to real-life requirements of regulation of business and other economic activity by means of implementation of ministerial procedures;

other principles established by legal acts.

2. The single list of the ministerial procedures performed concerning subjects of managing (further - the single list), affirms Council of Ministers of the Republic of Belarus.

In the single list concerning each ministerial procedure it is determined:

authorized body - the state body, other organization including which is not subordinated to Council of Ministers of the Republic of Belarus, their structural division, interdepartmental or other commission within which competence implementation of ministerial procedure is;

body regulator - the state body, other organization including which is not subordinated to Council of Ministers of the Republic of Belarus within which competence realization of state policy in the respective sphere of the public relations is;

term of implementation of ministerial procedure;

type of the payment levied when implementing ministerial procedure.

Implementation of the ministerial procedures which are not included in the single list is not allowed.

3. Body regulator:

performs preparation of drafts of acts of the legislation on inclusion in the single list of new ministerial procedures, their change or exception of the single list;

approves regulations of ministerial procedure according to the requirements established in appendix;

acts as the customer of actions for digitalization of ministerial procedures, to ensuring their consolidation in service "one window";

explains regulations of the corresponding ministerial procedure provided in the single list and also if necessary issues the instruction, obligatory for execution, about adjustment of the amount of the payment levied when implementing ministerial procedure determined by authorized body on analysis results of information concerning forming of such payment;

performs other functions according to this Decree and other acts of the legislation.

4. The regulations of ministerial procedure affirm Council of Ministers of the Republic of Belarus if the body - the regulator of such ministerial procedure is not rule-making body.

5. Ministerial procedures are performed on free or paid basis by collection of collection (duty) and (or) service fee (work).

The amount of the payment levied when implementing ministerial procedure in type:

collection (duty), it is determined according to legal acts;

service fees (work), it is determined proceeding from economic justification of the costs connected with implementation of ministerial procedure, and it is not higher than 10 percent of level of profitability.

6. When implementing ministerial procedures it is on a grant basis carried out:

access for interested persons to the single portal of electronic services for submission (response) of statements for implementation of ministerial procedures, receipts of executive decisions (notifications on the made executive decisions) and submissions (response) of administrative claims electronically;

finishing request of authorized body, other state body, other organization which delegates powers on acceptance, preparation for consideration of the applications of interested persons and (or) issue of the executive decisions made by authorized bodies and also on adoption of executive decisions about failure in adoption of statements of interested persons, services "one window" (further - the authorized person) to the state information resource (system) and information electronically from such resource (system) to the authorized person by means of nation-wide automated information system;

provision of the state information resource (system) by the owner (operator), republican organization for state registration of real estate, rights to it and transactions of information with it electronically to the authorized person * or to the operator of nation-wide automated information system.

Services of the commercial organizations - operators of the state information resource (system), the republican organization for state registration of real estate, the rights to it and transactions with it on provision of information according to the paragraph to the fourth part one of this Item are financed by state body or the organization, in subordination (maintaining) of which they are, at the expense of the means provided in the republican budget on their functioning. The procedure for financing of the specified services is determined by Council of Ministers of the Republic of Belarus. **

7. Create the register of the ministerial procedures performed concerning subjects of managing (further - the register), which is the state information system integrated with nation-wide automated information system.

The procedure for forming and maintaining the register, his operator are determined by Council of Ministers of the Republic of Belarus.
