ORDER OF THE MINISTER OF HEALTH OF THE REPUBLIC OF KAZAKHSTAN

About approval of Health regulations "Sanitary and epidemiologic requirements to objects of production of confectionery, conditions of production, packings, transportations, storages, realization, utilizations and destructions of confectionery"

According to subitem 132-1) of Item 16 of the Regulations on the Ministry of Health of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of February 17, 2017 No. 71 of PRIKAZYVAYU:

1. Approve the enclosed Health regulations "Sanitary and epidemiologic requirements to objects of production of confectionery, conditions of production, packings, transportations, storages, realization, utilizations and destructions of confectionery".

2. Recognize invalid:

1) the order of the acting minister of national economy of the Republic of Kazakhstan of February 24, 2015 No. 124 "About approval of Health regulations "Sanitary and epidemiologic requirements to objects of production of confectionery, conditions of production, packings, transportations, storages, realization, utilizations and destructions of confectionery" (it is registered in the Register of state registration of regulatory legal acts at No. 10725, it is published on June 1, 2015 in information system of law of Ad_let);

2) Item 3 of the List of some orders of the Ministry of national economy of the Republic of Kazakhstan and the Ministry of Health of the Republic of Kazakhstan to which changes and amendment are made the acting minister of health care of the Republic of Kazakhstan approved by the order of September 3, 2018 No. KR DSM-9 (it is registered in the Register of state registration of regulatory legal acts at No. 17501, it is published on October 15, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan).

3. To provide to committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Health regulations "Sanitary and epidemiologic requirements to objects of production of confectionery, conditions of production, packings, transportations, storages, realization, utilizations and destructions of confectionery"

Chapter 1. General provisions

1. Health regulations "Sanitary and epidemiologic requirements to objects of production of confectionery, conditions of production, packings, transportations, storages, realization, utilizations and destructions of confectionery" (further – Health regulations) are developed according to subitem 132-1) of Item 16 of the Regulations on the Ministry of Health of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of February 17, 2017 No. 71 (further - the Provision), establish and contain sanitary and epidemiologic requirements to objects of production of confectionery (further - objects), to conditions of production, packings, transportations, storages, realization, utilizations and destructions of confectionery, including on the objects placed as a part of objects of public catering.

2. Sanitary and epidemiologic requirements to the choice of the parcel of land under construction, to designing, construction new, to reconstruction, re-equipment, re-planning and expansion of the existing objects, repair, commissioning and reshaping of objects, water supply, water disposal, heat supply, lighting, ventilation and conditioning of objects are established by the order of the Minister of Health of the Republic of Kazakhstan of April 28, 2021 No. KR DSM-36/2021 "About approval of Health regulations "Sanitary and epidemiologic requirements to facilities for production of food products" (it is registered in the Register of state registration of regulatory legal acts at No. 22673) (further - Health regulations "Sanitary and epidemiologic requirements to facilities for production of food products"), the health regulations, hygienic standard rates approved according to subitem 132-1) of Item 16 of the Provision technical regulations and single sanitary and epidemiologic and hygienic requirements to products (goods) of the Eurasian Economic Union (further – documents of regulation).

Sanitary and epidemiologic requirements to content and operation of rooms, buildings, constructions, the equipment of objects, to collection, storage and transportation of production wastes and consumption, implementation of production supervision, working conditions, consumer services, to medical support and hygienic personnel training of objects are established by health regulations "Sanitary and epidemiologic requirements to facilities for production of food products", the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011) approved by the Decision of the Commission of the Customs union of December 9, 2011 No. 880, and documents of regulation.

Sanitary and epidemiologic requirements to objects regarding conditions of production, packings, storages, transportations, realization, the utilizations and destructions which are not provided by these Health regulations are established by health regulations "Sanitary and epidemiologic requirements to facilities for production of food products".

3. In these Health regulations the following terms and determinations are used:

1) bactericidal irradiator – the device of the opened and (or) closed type which is intended for disinfecting of air and surfaces in rooms by direct ultraviolet rays (ultra-violet radiation) of the bactericidal (antimicrobic) action providing loss of viability of microorganisms (including viruses, bacteria, mold, fungi, yeast, dispute of microorganisms) under the influence of ultra-violet radiation (for example, bactericidal lamp, bactericidal retsirkulyator, irradiator-retsirkulyator);
