1. Approve enclosed:

Rules of decision making about undesirability of stay (accommodation) of the foreign citizen or the stateless person in the Russian Federation, and also suspensions of action and cancellation of such decision concerning the person without citizenship who received the temporary identity certificate of the stateless person in the Russian Federation, except for decisions on undesirability of stay (accommodation) of the foreign citizen or the stateless person in the Russian Federation accepted in connection with availability of the circumstances creating real health hazard of the population;

the list of federal executive bodies, authorized to make the decision on undesirability of stay (residence) of the foreign citizen or stateless person in the Russian Federation, except for decisions on undesirability of stay (accommodation) of the foreign citizen or the stateless person in the Russian Federation accepted in connection with availability of the circumstances creating real health hazard of the population.

2. Recognize invalid acts and separate provisions of acts of the Government of the Russian Federation according to the list according to appendix to this resolution.

3. This resolution becomes effective from the date of entry into force of the Federal Law "About Introduction of Amendments to the Federal Law "About Legal Status of Foreign Citizens in the Russian Federation" and Separate Legal Acts of the Russian Federation regarding Settlement of Legal Status of Stateless Persons".

1. These rules establish procedure for decision making about undesirability of stay (residence) of the foreign citizen or stateless person in the Russian Federation (further - the decision on undesirability of stay), and also suspensions, renewals of action and cancellation of such decision concerning the person without citizenship who received the temporary identity certificate of the stateless person in the Russian Federation, except for decisions on undesirability of stay (accommodation) of the foreign citizen or the stateless person in the Russian Federation accepted in connection with availability of the circumstances creating real health hazard of the population.

2. The decision on undesirability of stay, and also the decision on suspension, renewal of its action or cancellation of such decision are accepted by the federal executive bodies included in the list approved by the order of the Government of the Russian Federation of August 23, 2021 No. 1390 "About procedure for decision making about undesirability of stay (residence) of the foreign citizen or stateless person in the Russian Federation and also suspensions of action and cancellation of such decision concerning the person without citizenship who received the temporary identity certificate of the stateless person in the Russian Federation, except for decisions on undesirability of stay (accommodation) of the foreign citizen or the stateless person in the Russian Federation accepted in connection with availability of the circumstances creating real health hazard of the population and recognition voided acts and separate provisions of acts of the Government of the Russian Federation" (further - authorized bodies).

4. Territorial authorities (divisions) of authorized bodies in case of identification of the circumstances provided by the Federal Law "About Procedure for Departure from the Russian Federation and Entry into the Russian Federation" which are the basis for decision making about undesirability of stay represent the materials confirming the specified circumstances to the relevant authorized body.

5. In case of issue to the stateless person on which the decision on undesirability of stay, the temporary identity certificate of the stateless person in the Russian Federation is made (further - the temporary certificate) this decision, except for case, stipulated in Item 6 these rules, is subject to cancellation by the authorized body which accepted it within 5 working days from the date of receipt of the notification from territorial authority of the Ministry of Internal Affairs of the Russian Federation on issue to this person of the temporary certificate.

6. In case of issue to the stateless person of the temporary certificate action of the decision on undesirability of the stay accepted by Federal Service for Financial Monitoring stops the specified federal executive body within 5 working days from the date of receipt from territorial authority of the Ministry of Internal Affairs of the Russian Federation of the notification on issue or replacement to this person of the temporary certificate for effective period of such certificate.

Action of the decision on undesirability of stay in the relation of the specified person is resumed in case of departure of this person out of limits of the Russian Federation what the Federal Service for Financial Monitoring within 3 working days from the date of receipt of the data confirming the fact of departure of such person out of limits of the Russian Federation makes the relevant decision on.

7. The authorized body without delay informs the relevant territorial authority (division) on the made decisions on undesirability of stay, on suspension, renewal of action and cancellation of the decision on undesirability of stay if the specified decisions were made based on the materials provided by this body (division) according to item 4 of these rules.
