About questions of the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic

1. Approve:

1) Regulations on the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic according to appendix 1;

2) the scheme of management of the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic according to appendix 2.

2. Rename the State patent and technical library under Public service of intellectual property and innovations under the Government of the Kyrgyz Republic into Public institution "Innovative center" under the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic.

3. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 10.12.2021 No. 302

4. To the state agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic:

1) in accordance with the established procedure to develop and introduce to the Cabinet of Ministers of the Kyrgyz Republic the draft of the Regulations on Public institution "Innovative center" under the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic;

2) to take the necessary measures following from this resolution.

5. To impose control of execution of this resolution on department of education, science, culture, sport and youth of Administration of the President of the Kyrgyz Republic.

6. This resolution becomes effective after seven days from the date of official publication.

Regulations on the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic

1. General provisions

1. This Provision determines legal and organizational basis of activities of the State agency of intellectual property and innovations under the Cabinet of Ministers of the Kyrgyz Republic (further - Kyrgyzpatent).

2. Kyrgyzpatent is legal successor of Public service of intellectual property and innovations under the Ministry of Economics and finance of the Kyrgyz Republic.

3. Kyrgyzpatent is the authorized state body of the executive authority of the Kyrgyz Republic performing ensuring single state policy in the field of protection of intellectual property and development of innovations.

4. Kyrgyzpatent in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic, the conventional principles and rules of international law, international treaties which participant is the Kyrgyz Republic, and also this Provision.

5. Kyrgyzpatent will independently organize and performs the activities within the powers established by this Provision.

Financing of maintenance costs of Kyrgyzpatent and his territorial subdivision, subordinated organizations is performed at the expense of the means of the republican budget and means accumulated on special treasurer accounts for maintenance of Eurasian patents in force according to the Eurasian patent convention of September 9, 1994 and the Protocol on protection of industrial designs to the Eurasian patent convention of September 9, 1994 of September 9, 2019 and also other means which are not contradicting the budget legislation of the Kyrgyz Republic.
