ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About licensing of activities for transportations by inland water transport, sea transport of dangerous goods and activities for implementation of towages by sea transport (except for case if the specified activities are performed for ensuring own needs of the legal entity or the individual entrepreneur)

According to the Federal Law "About Licensing of Separate Types of Activity" Government of the Russian Federation decides:

1. Approve enclosed:

Regulations on licensing of activities for transportations by inland water transport, sea transport of dangerous goods;

Regulations on licensing of activities for implementation of towages by sea transport (except for case if the specified activities are performed for ensuring own needs of the legal entity or the individual entrepreneur).

2. This resolution becomes effective since March 1, 2022 and is effective till March 1, 2028.

Regulations on licensing of activities for transportations by inland water transport, sea transport of dangerous goods

1. This Provision determines procedure for licensing of the activities for transportations by inland water transport, sea transport of dangerous goods performed by legal entities, including foreign, and individual entrepreneurs (further - activities for transportations of dangerous goods).

2. Licensing of activities for transportations of dangerous goods is performed by Federal Service for the Oversight of Transport (its territorial authorities) (further - the licensing body).

3. Activities for transportations of dangerous goods include the following works:

a) transportations by inland water transport of dangerous goods, including with use of small size vessels;

b) transportations by sea transport of dangerous goods, including with use of small size vessels.

4. The licensed requirements imposed to the license applicant (licensee) in case of performance of works on transportation by inland water transport of dangerous goods are:

a) availability at the license applicant (licensee) on the property right or on other legal cause of the dangerous goods of the courts conforming to requirements of the technical regulation about safety of objects of the inland water transport approved by the order of the Government of the Russian Federation of August 12, 2010 No. 623 "About approval of the technical regulation about safety of objects of inland water transport" intended for transportation (if the specified requirements are applied to such courts);

b) availability at the license applicant (licensee) of the official responsible for ensuring safe operation of courts having length of service at least 3 years as the ship master, the senior assistant of the captain or the senior mechanic on inland navigation vessels or on ocean ships, secondary professional or higher education in "navigation" or "operation of ship power stations", and also the holding the post certified on the right according to requirements, stipulated in Item 3 articles 34.1 of the Code of inland water transport of the Russian Federation (except for license applicants (licensees) transporting dangerous goods with use of small size vessels);

c) availability at the license applicant (licensee) of life insurance contracts and health of members of crews of vessel in case of execution of service duties by them according to item 4 of article 28 of the Code of inland water transport of the Russian Federation;

d) availability at the license applicant (licensee) of safety management system of courts, stipulated in Article 34.1 Codes of inland water transport of the Russian Federation (except for license applicants (licensees) transporting dangerous goods with use of small size vessels);

e) availability at the license applicant (licensee) for each vessel of the ship plan of emergency measures for prevention of pollution declared to them oil, stipulated in Article 39 Codes of inland water transport of the Russian Federation;

e) availability at the license applicant (licensee) (except for license applicants (licensees) transporting dangerous goods with use of the small size vessels and dumb boats intended for transportations of dry cargo ships) the document confirming insurance or financial provision of insurance risks of emergence of responsibility of the license applicant (licensee) according to the subitem 3 of Item 5 of article 121 of the Code of inland water transport of the Russian Federation;

g) availability at the license applicant (licensee) for each small size vessel of the ship ticket declared to them with information on purpose of the vessel for transportation of dangerous goods.

5. The licensed requirements imposed to the license applicant (licensee) in case of performance of works on transportation by sea transport of dangerous goods are:

a) availability at the license applicant (licensee) on the property right or on other legal cause of the courts intended for transportation of the dangerous goods conforming to requirements of the technical regulation about safety of objects of the sea transport approved by the order of the Government of the Russian Federation of August 12, 2010 No. 620 "About approval of the technical regulation about safety of objects of sea transport" (if the specified requirements are applied to such courts);

b) availability at the license applicant (licensee) of management system safe operation of courts according to the International code on management of safe operation of courts and prevention of pollution and the International code on protection of courts and port means (for courts to which requirements of the relevant International code are applied);

c) availability at the license applicant (licensee) of the official responsible for ensuring safe operation of courts having length of service at least 3 years as the ship master, the senior assistant of the captain or the senior mechanic on ocean ships, secondary professional or higher education in "navigation" or "operation of ship power stations" (except for license applicants (licensees) transporting dangerous goods with use of small size vessels);

d) availability at the license applicant (licensee) of life insurance contracts and health of members of crews of vessel in case of execution of service duties by them according to Item 2 of Article 60 of the Maritime Code of the Russian Federation;

e) availability at the license applicant (licensee) for each vessel of the plan of emergency measures for pollution abatement by oil provided by the International convention on prevention of pollution from courts of 1973 declared to them (with the changes made by the Protocol of 1978 to it) (for courts to which requirements of the specified Convention are applied);
