About approval of Rules of exchange of documents in electronic form under the organization of information exchange

The government of the Russian Federation decides:

1. Approve the enclosed Rules of exchange of documents in electronic form under the organization of information exchange.

2. Recommend to public authorities of subjects of the Russian Federation, other state bodies, bodies of the public power of the federal territory Sirius, local government bodies, the public and local government offices, state and to the municipal unitary enterprises, the organizations performing publicly significant functions, to the organizations, created for accomplishment of the tasks set for the Government of the Russian Federation, public authorities of the Russian Federation or public authorities of subjects of the Russian Federation to the legal entities created based on the Federal Laws, to legal entities in whose authorized capital there is share of the Russian Federation, either subjects of the Russian Federation, or municipalities, to state non-budgetary funds and also other legal entities to use the Rules approved by this resolution.

3. Recognize invalid:

the order of the Government of the Russian Federation of December 25, 2014 No. 1494 "About approval of Rules of exchange of documents in electronic form under the organization of information exchange" (The Russian Federation Code, 2015, No. 1, the Art. 284);

Rules of exchange of documents in electronic form under the organization of information exchange

1. These rules establish procedure for information exchange by means of exchange of documents in electronic form for federal bodies of the government, public authorities of subjects of the Russian Federation, other state bodies, bodies of the public power of the federal territory Sirius, local government bodies, the public and local government offices, state and the municipal unitary enterprises, the organizations performing publicly significant functions, the organizations created for accomplishment of the tasks set for the Government of the Russian Federation, public authorities of the Russian Federation or public authorities of subjects of the Russian Federation, the legal entities created based on the Federal Laws, legal entities in whose authorized capital there is share of the Russian Federation, either subjects of the Russian Federation, or municipalities state non-budgetary funds, and also other legal entities (further - participants of information exchange) if participants of information exchange performed accession to the information system "Common Information Space of Processes of Public Administration" (further - system of the state electronic document management), or to system of interdepartmental electronic document management.

In these rules the document in electronic form is understood as the electronic document which structure of details is determined according to the rules of clerical work in state bodies, local government bodies established by Federal Archival Agency according to part 2 of article 11 of the Federal law "About Information, Information Technologies and on Information Protection" or the electronic document submitted in machine-readable form in the digital formats including developed and approved according to the Regulations on the information system "Common Information Space of Processes of Public Administration" approved by the order of the Government of the Russian Federation of February 17, 2022 No. 198 "About approval of the Regulations on the information system "Common Information Space of Processes of Public Administration" (further - Regulations on system of the state electronic document management).

3. The documents in electronic form used in the course of information exchange are created during activities of participants of information exchange with use of the electronic document management systems which are available for them according to requirements of the legislation of the Russian Federation, and also regulatory legal acts of the participants of information exchange establishing rules (procedure) of documentation, document flow and use of documents.

4. Exchange of documents in electronic form between participants of information exchange is performed by means of system of interdepartmental electronic document management, and also electronic document management systems of the participants of information exchange connected to system of interdepartmental electronic document management or to system of the state electronic document management, forming jointly the transport bus according to requirements of the legislation of the Russian Federation about information, information technologies and about information protection.

5. In the absence of possibility of use of the transport bus information exchange is performed with use of the removable machine information medium.

6. Information transfer unit via the transport bus is the shipping container which contains the document in electronic form or the technological message (further - the shipping container) which guaranteed delivery is provided due to observance of the procedure of exchange and is confirmed by the office electronic message (further - the transport receipt).

7. The organizer of interdepartmental electronic document management determined according to the Regulations on system of interdepartmental electronic document management approved by the order of the Government of the Russian Federation of September 22, 2009 No. 754 "About approval of the Regulations on system of interdepartmental electronic document management" provides interaction of participants of information exchange who are attached to system of interdepartmental electronic document management, and also is operator of head node of interdepartmental electronic document management.

The organizer of common information space of the state electronic document management determined according to Regulations on system of the state electronic document management provides exchange of documents in electronic form of participants of information exchange who are attached to system of the state electronic document management, and also is operator of node of the organizer of common information space of the state electronic document management.
