About approval of the Instruction on the organization and implementation of production supervision on hazardous production facility

According to subitem 14-9) of article 12-2 of the Law of the Republic of Kazakhstan "About civil protection", PRIKAZYVAYU:

1. Approve the Instruction on the organization and implementation of production supervision attached to this order on hazardous production facility.

2. To provide to committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Emergency Situations of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

The instruction on the organization and implementation of production supervision on hazardous production facility

Chapter 1. General provisions

1. This Instruction on the organization and implementation of production supervision on hazardous production facility (further - the Instruction) is developed according to subitem 14-9) of article 12-2 of the Law of the Republic of Kazakhstan "About civil protection" and disaggregates procedure for the organization and implementation of production control over observance of requirements of industrial safety by the organizations operating hazardous production facilities (further - the organization).

2. In this Instruction the following basic concepts are used:

1) production supervision - the actions on hazardous production facility aimed at ensuring compliance with industrial safety, performed by officials of service of production supervision;

2) industrial safety - condition of security of physical persons and legal entities, the environment from harmful effects of dangerous production factors;

3) requirements of industrial safety - the special conditions of technical and (or) social nature established by the legislation of the Republic of Kazakhstan for the purpose of ensuring industrial safety.

3. Production supervision on hazardous production facilities is exercised by the officials of service of production supervision designated by the order of the head of the organization.

Chapter 2. Powers of the officials of the organization exercising production supervision

4. The following powers are assigned to officials of service of production supervision in the field of industrial safety:

1) plan development of works on implementation of production supervision in divisions of the organization;

2) implementation of production control over observance by workers of requirements of industrial safety;

3) the organization and conducting checks regarding observance of requirements of industrial safety;

4) issue to heads of structural divisions of the organization, instructions, obligatory for execution, about elimination of the revealed violations which can be cancelled only by the written order of the head of the organization;

5) organization of plan development of actions for ensuring industrial safety and accident elimination;

6) the organization of work on preparation of conducting examination in the field of industrial safety;

7) introduction to the head of the organization of offers:

about holding actions for ensuring industrial safety, about elimination of violations of requirements of industrial safety;

about suspension of the works which are carried out with violations of the requirements of industrial safety creating threat of life and to health of workers or which can lead to the striking impact of dangerous production factors on personnel, the population, the environment;

about discharge from work of persons who did not have timely training, retraining concerning industrial safety;

8) receipt of the documents and materials necessary for assessment of condition of industrial safety in the organization;

9) carrying out the analysis of origins of accidents and incidents on hazardous production facilities and storage of documentation on their accounting;

10) organization of preparation and retraining of workers for industrial safety;

11) bringing to data of employees of hazardous production facilities information on modification and (or) amendments in regulatory legal acts of the Republic of Kazakhstan in the field of industrial safety;

12) the organization of the investigation and accounting of accidents, accidents which happened owing to accident on hazardous production facility of cases;

13) implementation of other powers, stipulated by the legislation the Republic of Kazakhstan in the field of industrial safety.

Chapter 3. Regulations on production supervision

5. The organization develops Regulations on production supervision taking into account specifics and industry of the organization, features of the operated hazardous production facilities and conditions of their operation.

6. The regulations on production supervision contain:

1) powers of the officials of the organization exercising production supervision in the field of industrial safety;

2) number of hazardous production facilities and their production divisions;

3) the short characteristic of hazardous production facilities containing the following data:

about condition and technical inspection of factory buildings, technology constructions;

about engineering certification of dangerous technical devices;

about the accidents which happened on hazardous production facility, incidents and accidents;

about the organization of preparation, retraining of the heads, specialists and workers occupied on hazardous production facility concerning industrial safety;

4) the actions plan on ensuring industrial safety;
