1. Approve:

1) criteria for evaluation of risk degree behind compliance with law of the Republic of Kazakhstan in the field of regulation of trading activity according to appendix 1 to this joint order;

2) checking leaf behind compliance with law of the Republic of Kazakhstan in the field of regulation of trading activity concerning subjects of domestic trade regarding pricing according to appendix 2 to this joint order;

3) checking leaf behind compliance with law of the Republic of Kazakhstan in the field of regulation of trading activity concerning the trade markets, retail chain stores and large shopping facilities according to appendix 3 to this joint order;

4) checking leaf behind compliance with law of the Republic of Kazakhstan in the field of regulation of trading activity concerning wholesale distribution centers according to appendix 4 to this joint order.

2. To provide to department of domestic trade of the Ministry of Trade and integration of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Ministry of Trade and integration of the Republic of Kazakhstan.

3. To impose control of execution of this joint order on the supervising vice-Ministers of Trade and integration, national economy of the Republic of Kazakhstan.

4. This joint order becomes effective since July 1, 2021 and is subject to official publication.

Chapter 1. General provisions

1. These criteria for evaluation of risk degree behind compliance with law of the Republic of Kazakhstan in the field of regulation of trading activity (further – Criteria) are developed according to the Entrepreneurial code of the Republic of Kazakhstan (further – the Code), and also the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 "About approval of form of checking sheets" (No. 48 "About approval of Rules of forming by regulatory state agencies of system of assessment and risk management is registered in the Register of state registration of regulatory legal acts at No. 17371) and the order of the acting minister of national economy of the Republic of Kazakhstan of June 22, 2022 and about introduction of amendments to the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 "About approval of Rules of forming by state bodies of system of risks assessment and form of checking sheets" (it is registered in the Register of state registration of regulatory legal acts at No. 28577).

2. In these Criteria the following concepts are used:

1) subjects (objects) of control – individual entrepreneurs and legal entities behind which activities control of compliance with law of the Republic of Kazakhstan on regulation of trading activity is exercised;

2) point – quantitative measure of calculation of risk;

3) insignificant violations – the violation connected with lack of the commodity and accompanying documents on food products processed by the manufacturer or the supplier (seller);

4) normalization of data – the statistical procedure providing reduction of the values measured in different scales to conditionally general scale;

5) considerable violations – the violations connected with realization in the territory of the Republic of Kazakhstan with indication of the price in tenge of the goods which are drawn up by label of the prices, exposed in internal and (or) external show-windows of the shopping facility or realization in the territory of the Republic of Kazakhstan of goods which cost shall not exceed the price which is drawn up by label, the shopping facility exposed in internal and (or) external show-windows, or specifying of the price of goods in tenge in case of its realization in the territory of the Republic of Kazakhstan on the terms of the public agreement, accurately drawn up price labels on implementable goods with indication of description of goods, its grades, the price for the weight or commodity unit, implementation of electronic trading, the equipment the trade markets of trade places according to the scheme of their placement, administrative and household, storage facilities and places public, the equipment of places, available to review, availability in stationary shopping facilities availability in wholesale distribution centers of compliance to requirements of hardware of wholesale distribution centers, providing with administration wholesale distribution centers of the approved regulations of work;
