About calculations for natural gas, electrical and heat energy

For the purpose of enhancement of procedure of payments for natural gas, electrical and heat energy, I decide decrease in financial load of consumers of energy resources:

1. Enter to Item 1 of the Presidential decree of the Republic of Belarus of December 22, 2010 No. 670 "About some questions of payment of natural gas, electrical and heat energy" the following changes:

1.1. in subitem 1.1:

in word part three "Council of Ministers of the Republic of Belarus" shall be replaced with words "The ministry of anti-monopoly regulation and trade together with the Department of Energy";

in word part four "Council of Ministers of the Republic of Belarus" shall be replaced with words "Department of Energy in coordination with the Ministry of anti-monopoly regulation and trade";

1.2. part the tenth subitem 1.2.2 after the word of "subitem" to add with words ", the paragraph the second parts one of subitem 1.3 of this Item";

1.3. add Item with subitem 1.3 of the following content:

"1.3. the consumers having for January 1, 2021 debt for the energy resources released gazo-and the power supplying organizations (including on which decisions of the President of the Republic of Belarus on provision of delay and (or) payment by installments of its repayment are made) annually following the results of 2021-2023 are exempted from:

interest payments for use of others money, penalty fee and penalties added for failure to provide of timely calculations for energy resources and not paid for January 1 of the year following for reporting in the amount determined proceeding from specific weight of repayment sum in reporting year of debt in the total amount of this debt for January 1, 2021;

repayments of part of the debt formed for January 1, 2020, in the amount of 10 percent from repayment sum of such debt in reporting year, but no more amount of remaining balance of the specified debt for January 1 of the year following reporting.

The consumers who provided repayment in 2021-2023 with the accruing result at least 90 percent from the outstanding amount formed for January 1, 2020 and not extinguished for January 1, 2021 (without the amounts of the release specified in paragraph three of part one of this subitem), are exempted from repayment of this debt in the amount of its remaining balance on the first following after month of such repayment.

Condition of the release specified in parts one and the second this subitem is complete payment by the accruing result from January 1, 2021 to December 31 accounting year of the current consumption of the corresponding type of energy resources.

Condition of release of national association "The Vitebsk concern "Meat-and-milk Products" from debt repayment according to the paragraph third parts one and part two of this subitem regarding the debt transferred according to the Presidential decree of the Republic of Belarus of February 25, 2020 to No. 70 "About development of agro-industrial complex of the Vitebsk region" is complete payment the accruing result from January 1, 2021 to December 31 accounting year of the current consumption of the corresponding type of energy resources totally on all organizations which are part of consolidation.

Gazo-and the power supplying organizations of the consumers having the right concerning debt for energy resources to make in 2021-2023 charge of interest for using others money, penalty fee and penalties for failure to provide of timely calculations for energy resources once following the results of year.

For the purposes of the taxation interest for using others money, penalty fee and penalties in the amounts exempted from their payment according to the paragraph the second parts one of this subitem:

are not included consumers of non-operating incomes provided that the specified interest for using others money, penalty fee and penalties were not included in structure of non-operating expenses earlier;

reduce non-operating incomes gazo-and the power supplying organizations for the tax (reporting) periods in which the specified interest for using others money, penalty fee and penalties were earlier included in structure of non-operating incomes.

The amounts of release from repayment of part of debt according to the paragraph third parts one and part two of this subitem:

are written off gazo-and the power supplying organizations in financial accounting for the retained earnings account within its remaining balance and the added capital in the remained amount;

are not included consumers of non-operating incomes;

can go consumers for payment of one-time awards to heads of the organizations and to their deputies supervising questions of calculations for energy resources (further - heads).

One-time award:

cannot exceed the double size of the amount of tariff salary and its increases established to the head according to the legislation and local legal acts. Its specific size is determined by the owner of property or the official (body, the organization), authorized to sign the employment contract (contract) with the head;

it is not considered when calculating coefficient of ratio of the average salary of the head and the average salary for the organization in general;

it is paid to the head on condition of absence of debt on payments in republican and (or) local budgets, the budget of state non-budgetary fund of social protection of the population of the Republic of Belarus, on salary payment, public welfare payments to the families raising children.".

When implementing by consumers of energy resources of repayment from January 1, 2021 to day of official publication of this Decree of debt according to part two of subitem 1.3 of Item 1 of the Presidential decree of the Republic of Belarus of December 22, 2010 No. 670 gazo-and the power supplying organizations being part of GPO "Beltopgaz", GPO "Belenergo" consumers of energy resources to the first day of the second month following after month of official publication of this Decree adjust accounting data taking into account release from repayment of the remaining balance of debt provided in part two of subitem 1.3 of Item 1 of the Presidential decree of the Republic of Belarus of December 22, 2010 No. 670.

3. JSC Non-bank Credit and Financial Organization Edinoye raschetnoye i informatsionnoye prostranstvo, authorized organizations *, the organizations which are rendering housing and communal services, gazo-and the power supplying organizations being part of GPO "Beltopgaz", GPO "Belenergo" have the right to sign the agreement in which the procedure and conditions of distribution, the money transfer accepted by means of automated information system of single settlement and information space for services of heat supply (heating and heating of water) provided by the organizations rendering housing and communal services are determined.
