About approval of Rules of implementation of the state control (supervision) of implementation of the international motor transportations at check points through frontier of the Russian Federation

1. Approve the enclosed Rules of implementation of the state control (supervision) of implementation of the international motor transportations at check points through frontier of the Russian Federation.

2. Determine that realization of the powers provided by this resolution is performed by the Federal Customs Service within the limiting Russian Federation established by the Government of the number of employees of central office and territorial authorities of the Federal Customs Service, and also budgetary appropriations provided to the Federal Customs Service on management and management in the sphere of the established functions.

3. This resolution becomes effective since July 1, 2021.

Rules of implementation of the state control (supervision) of implementation of the international motor transportations at check points through frontier of the Russian Federation

I. General provisions

1. These rules establish procedure customs authorities (their officials) of the state control (supervision) of implementation of the international motor transportations at check points through frontier of the Russian Federation (further respectively - the state control (supervision), check points).

The procedure for information exchange between the Federal Customs Service and Federal Service for the Oversight of Transport when implementing the state control (supervision) affirms the Federal Customs Service and the Ministry of Transport of the Russian Federation.

2. The purpose of the state control (supervision) is ensuring accomplishment by the Russian and foreign carriers in the territory of the Russian Federation of the Russian Federation Code of Administrative Offences, the Federal Law "About the State Control of Implementation of the International Motor Transportations and about Responsibility for Violation of Procedure for Their Accomplishment", the Federal Law "About Highways and about Road Activities in the Russian Federation and about Modification of Separate Legal Acts of the Russian Federation", the Law of the Russian Federation "About Frontier of the Russian Federation", orders of the Government of the Russian Federation of December 24, 2008 No. 1007 "About collection for driving of the vehicles registered in the territory of foreign states through highways of the Russian Federation", other regulatory legal acts of the Russian Federation, international treaties of the Russian Federation in the field of the international motor transportations (further - the international agreements of the Russian Federation) and these rules.

3. When carrying out the state control (supervision) the following problems are solved:

observance of established procedure of implementation of the international motor transportations by the Russian and foreign carriers;

the prevention and suppression of administrative offenses when implementing the international motor transportations by the Russian and foreign carriers;

accounting of use of permissions to implementation of the international motor transportations at check points.

4. Persons interfering carrying out the state control (supervision) bear responsibility in accordance with the legislation of the Russian Federation.

II. Rules of carrying out the state control (supervision)

5. The state control (supervision) concerning the vehicles going to the Russian Federation and from the Russian Federation including en route through its territory without driving through the territory of other state members of the Eurasian Economic Union, is performed in the way:

a) conducting the checks provided by international treaties of the Russian Federation, the Russian permission to journey of the vehicle belonging to foreign carrier on the territory of the Russian Federation or the multilateral permission granting during the term of the action the right to journey of the vehicle belonging to foreign carrier on the territories of the State Parties of the specified international treaties or on the territories of the states participating in system of multilateral quota of the European conference of Ministers of Transport, and also observance of rules of their filling with putting down of mark about entrance of the vehicle on the territory of the Russian Federation or about its departure from the territory of the Russian Federation (further - mark about entrance or departure), except as specified, when according to international treaties of the Russian Federation implementation of transportation is allowed without such permissions;

b) conducting checks of the special one-time permission provided by international treaties of the Russian Federation to implementation by the vehicle belonging to foreign carrier, the international motor transportation from the territory or on the territory of the third state with putting down of mark about entrance or departure;

c) conducting checks of observance of requirements to movement of the heavy and (or) large-size vehicle, stipulated by the legislation the Russian Federation about highways and about road activities and the state control of implementation of the international motor transportations (weight and dimensional control);

d) conducting checks of special permissions, the stipulated in Article 4 Federal Law "About the State Control of Implementation of the International Motor Transportations and about Responsibility for Violation of Procedure for Their Accomplishment", and also observance of routes when they are specified in such permissions, with putting down of mark about entrance or departure when in such permissions there are graphs (places) for their putting down;

e) conducting checks:
