I. General provisions

1. This Provision establishes procedure for the organization and implementation of federal state control (supervision) of activities of the legal entities performing activities for return of overdue debt as core activity, included in the state register of the legal entities performing activities for return of overdue debt as core activity (further respectively the state control (supervision), controlled persons, the state register).

3. The state control (supervision) is exercised by Federal Bailiff Service (further - regulatory (supervising) authority) and its territorial authorities.

4. The following officials have the right to exercise the state control (supervision):

head of regulatory (supervising) authority;

the deputy manager of regulatory (supervising) authority who according to distribution of obligations supervises activities of structural division of central office of regulatory (supervising) authority within which scope of maintaining questions of implementation of the state control (supervision) which job description provides powers on implementation of the state control (supervision) (further - the deputy manager of regulatory (supervising) authority) fall;

the head of the structural unit of central office of regulatory (supervising) authority within which scope of maintaining questions of implementation of the state control (supervision), and his deputy which official regulations provide powers on implementation of the state control (supervision) (further respectively - the head of the structural unit of regulatory (supervising) authority, the deputy manager of structural division of regulatory (supervising) authority) fall;

other federal government civil servants of structural division of central office of regulatory (supervising) authority within which scope of maintaining questions of implementation of the state control (supervision) which official regulations provide powers on implementation of the state control (supervision) fall;

b) in territorial authorities of regulatory (supervising) authority:

the heads of territorial authorities of regulatory (supervising) authority and their deputies supervising according to distribution of obligations activities of structural division of territorial authority within which scope of maintaining questions of implementation of the state control (supervision) which job description provides powers on implementation of the state control (supervision) (further respectively - the head of regulatory territorial authority (supervising) authority, the deputy manager of regulatory territorial authority (supervising) authority) fall;

heads of structural divisions of territorial authorities of regulatory (supervising) authority within whose scope of maintaining questions of implementation of the state control (supervision), and their deputies whose official regulations provide powers on implementation of the state control (supervision) (further - the head of the structural unit of regulatory territorial authority (supervising) authority) fall;

other federal government civil servants of structural divisions of territorial authorities of regulatory (supervising) authority within whose scope of maintaining questions of implementation of the state control (supervision) which official regulations provide powers on implementation of the state control (supervision) fall.

5. The officials authorized on holding specific preventive and (or) control (supervising) action are determined by the decision of regulatory (supervising) authority or its territorial authority on holding preventive and (or) control (supervising) action.

6. The officials authorized on decision making about holding control (supervising) action are:

a) head of the structural unit of regulatory (supervising) authority, deputy manager of structural division of regulatory (supervising) authority;

b) head of regulatory territorial authority (supervising) authority, deputy manager of regulatory territorial authority (supervising) authority;

c) head of the structural unit of regulatory territorial authority (supervising) authority;

d) head, deputy manager of territorial department (department, inspection) structural division of territorial authority.

7. For the purpose of this provision object of the state control (supervision) is understood as the activities of controlled persons for return of overdue debt performed according to the Federal Law on protection of the rights.

When implementing the state control (supervision) activities of controlled person as object of control can be referred to the following categories of risk of damnification (damage) (further - category of risk):

a) high risk;

b) significant risk;

c) average risk;

d) low risk.

8. Accounting of objects of control, reference of objects of control to categories of risk are performed by regulatory (supervising) authority and its territorial authorities in the state register in the place of entering of data into the state register.

9. In case of reference of objects of control to categories of risk the regulatory (supervising) authority and its territorial authorities proceed from information on types and the number of the violations allowed by controlled person when implementing activities for return of overdue debt, established by the decisions of the courts, resolutions on cases on administrative offenses which took legal effect.

10. Object of control belongs to the high category of risk in cases:
