Based on Item part three 1, 3, parts four of Item 5 of Article 9, parts two of item 4 of Article 15, of parts one and the fourth Item 3 of Article 18, parts two of Item 2 of Article 19, parts two of Item 3 of article 20 of the Law of the Republic of Belarus of January 8, 1998 No. 135-Z "About joint household" the Council of Ministers of the Republic of Belarus DECIDES: Item parts two

1. Approve:

The regulations on payment procedure of obligatory payments concerning common property of joint household in case of arrangement in non-residential capital structure (the building, construction) of the residential isolated rooms (are applied);

The regulations on procedure for carrying out by local executive and administrative organ or the organization of open tender authorized by it at the choice of the authorized person (are applied);

The regulations on procedure for forming and maintaining the state register of the organizations which can act as the authorized person on management of common property of joint household (are applied).

2. Establish:

the list of the additional services connected with servicing of common property of joint household in non-residential capital structure according to appendix 1;

requirements to content of voting bulletins on general meeting of participants of joint household and on general meeting of copartners of owners and to procedure for their filling according to appendix 2.

3. Contracts on rendering utilities concerning common property of joint household are signed for the benefit of participants of joint household depending on the chosen method of management of common property of joint household by the chairman of the board of partnership of owners, the participant of joint household authorized by general meeting of participants of joint household, the organization managing common property of joint household by the authorized person designated by local executive and administrative organ (further - person, authorized to manage common property of joint household).

Person, authorized to manage common property of joint household, in case of the conclusion of agreements on rendering utilities acts as the representative of all participants of joint household, acting from their person and at their expense.

Utilities concerning common property of joint household are rendered according to the procedure, established by the legislation.

Agreements gazo-, heat and electric utility services consist according to regulations of the civil legislation on the agreement of power supply.

4. Utilities expenses are determined proceeding from the actual consumption of these services in kind based on these devices of individual and (or) group accounting, and in case of their absence - in the procedure established by the legislation.

5. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

5.1. No. 175 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022

5.2. in the resolution of Council of Ministers of the Republic of Belarus of March 4, 2015 No. 161 "About approval of the Standard agreement about joint household and the Standard charter of partnership of owners":

to state the name of the resolution in the following edition:

"About approval of the Standard agreement about joint household and the Standard agreement about management of common property of joint household";

to state preamble and Item 1 in the following edition:

"Based on part two of item 4 of Article 15, No. 135-Z "About joint household" the Council of Ministers of the Republic of Belarus DECIDES: parts two of Item 2 of article 19 of the Law of the Republic of Belarus of January 8, 1998

1. Approve:

The standard agreement about joint household (is attached);

The standard agreement about management of common property of joint household (is attached).";

exclude Item 3;

To be reworded as follows the standard agreement about joint household it (is applied);

add the resolution with the Standard agreement about management of common property of joint household it (is applied).

6. The contracts on joint household signed before entry into force of this resolution in six-months time from the date of entry into force of this resolution shall be brought into accord with the Standard agreement about joint household approved by the resolution of Council of Ministers of the Republic of Belarus of March 4, 2015 No. 161, in edition of this resolution.

7. To explain to the state committee on property questions of application of this resolution within its competence.

8. This resolution becomes effective since July 8, 2021.
