According to article 8 of the Law of the Republic of Tajikistan "About technical regulation" the Government of the Republic of Tajikistan decides:

1. Approve the Technical regulation "Safety of Alcoholic Products" it (is applied).

2. To industry ministry and new technologies of the Republic of Tajikistan together with the relevant ministries and departments to take necessary measures for implementation of this technical regulation.

3. Enact this resolution after six months after official publication.

Technical regulation "Safety of Alcoholic Products"

1. General provisions

1. The technical regulation "Safety of Alcoholic Products" (further - the Technical regulation), establishes obligatory for application and execution of the requirement to the alcoholic products released in the territory of the Republic of Tajikistan, related by production processes, storages, transportations of realization and utilization and the requirement to marking and packaging of alcoholic products for ensuring its free movement of the territories of the Republic of Tajikistan.

2. The technical regulation is developed for the purpose of protection of life and health of the person, property, the environment, life and health of animals and plants, the prevention of the actions misleading consumers of alcoholic products concerning its appointment and safety.

2. Scope of the Technical regulation

3. The technical regulation extends to the alcoholic products released in the territory of the Republic of Tajikistan. Objects of technical regulation of the Technical regulation are:

- alcoholic products;

- production processes, storages, transportations, realization and uses of waste depending on the need for alcohol.

4. The technical regulation does not extend on:

- the alcoholic products following en route through the territory of the Republic of Tajikistan;

- the alcoholic products made in the scientific purposes;

- the alcoholic products made by physical persons for private use without the purpose of its subsequent realization in the territory of the Republic of Tajikistan;

- the alcoholic products exported according to agreements in foreign trade out of limits of the territory of the Republic of Tajikistan;

- products containing ethyl alcohol according to the list according to appendix 1.

3. Terms and determinations

5. For the purposes of application of the Technical regulation the following terms and concepts are used:

1) alcoholic products - the food products made without use or with use of the ethyl alcohol made from food raw materials, and (or) alcohol-containing food products with volume fraction of ethyl alcohol of more 0,5 of percent, except for products included in the list provided by appendix 1 to the Technical regulation. Alcoholic products are subdivided into such types as ethyl alcohol, alcoholic drinks, low alcohol drinks, wine-making products, distillates, brewing products, medovarenny products, alcohol-containing food products;

2) alcoholic products in bulk - the alcoholic products placed in in or transport plant container (in the capacitor equipment, including barrels, reservoirs, cistern and automobile cars, fleksitanka and the similar equipment, intended for transportation (transportation) by different types of transport), intended for pouring in consumer packaging or productions of other types of alcoholic products or other products and which are not subject to realization to the consumer as ready-made product before its pouring or conversion in case of production of other alcoholic products or other products;

3) wine-making products - alcoholic products:

- made as a result of complete spirit fermentation of the whole or crushed berries of fresh grapes or fruit, mash grape, mashes fruit;

- made with the subsequent distillation of products of fermentation and endurance or without endurance;

- made as a result of complete or incomplete spirit fermentation of the whole or crushed berries of fresh grapes, fruit or mash grape, mashes of one or more, fruit with addition, of the following products: the rectified ethyl alcohol from food raw materials, distillate of grape origin, distillate wine, distillate fruit, including the rectified, sacchariferous products, flavoring substances, nutritional supplements, fragrances, carbon dioxide, water specified in the document (documents) according to which alcoholic products are made (the standard, the standard of the organization, specifications or other document).

- for production of wine-making products according to the list according to appendix 3 use of the technological transactions and technological means specified in the table 10 of appendix 3 to the Technical regulation is authorized;

4) distillate - the alcoholic products with volume fraction of ethyl alcohol more than 52 percent received by the simple or fractioned distillation (distillation) or rectification of the fermented mash, wine filling (wine materials), alcohol-containing barmy rainfall, gushchevy rainfall, alcohol-containing residue, other alcohol-containing food products. Distillate is applied to production of alcoholic products, including wine-making products, and can have the name of raw materials or drink for which it is made;

5) medovarenny products - the alcoholic products made from honey without addition or with addition of the rectified ethyl alcohol, sugar, distillate honey, distillate of the fruit, concentrated fruit juice, carbon dioxide, fresh mashes of the fruit, alcoholized fruit juice, natural vkusoaromatichesky substances and medicines and having the prevailing aroma and taste of honey;

6) brewing products - the alcoholic products made from brewing raw materials and (or) beer without addition or with addition of fruit and other vegetable raw materials, products of their conversion, fragrances without addition of ethyl alcohol;

7) low alcohol drinks - the alcoholic products with content of ethyl alcohol (fortress) in finished goods less than 7 percent made without use or with use of the rectified ethyl alcohol and (or) alcohol-containing food products, the prepared (corrected) water or mineral water with general mineralization no more than 1 g/l containing ingredients which use is provided by the document (documents) according to which alcoholic products (the standard, the standard of the organization, specifications or other document), including sacchariferous products, acids, carbon dioxide, infusions, extracts of fruit (fruits, berries) and grain raw materials, juice, vegetable raw materials, dairy products, honey and other products of beekeeping (including honey in honeycombs, propolis, zabrus, uterine bee milk are made), salts, other alcoholic drinks, nutritional supplements, and not belonging to wine-making and brewing products;

8) alcoholic drinks - the alcoholic products made with use of the rectified ethyl alcohol, and (or) alcohol-containing food products, and (or) other alcoholic products;

9) alcohol-containing food products - the alcoholic products with volume fraction of ethyl alcohol of more 0,5 of percent representing alcohol-containing semifinished products for production of alcoholic products, including the fruit fermented wine materials, the fruit sbrozhenno-alcoholized wine materials, mash grape, the mash fruit alcoholized the mashes alcoholized, the alcoholized juice, the alcoholized infusions, the alcoholized fruit drinks, fragrant alcohols, aqueous-alcoholic extracts, the concentrated food bases, food fragrances, other semifinished products;

10) ethyl alcohol - the alcoholic products with a strength at least 88 percent representing the water solution of ethanol made by method of spirit fermentation of sugars and starch-containing raw materials (except for fruit) with the subsequent distillation and (or) home brews rectification of distiller's beer or rectification of ethyl alcohol raw, containing the accompanying flying impurity, and also received from the head fraction of ethyl alcohol made of food raw materials, and the products of conversion which are formed in case of production of ethyl alcohol, vodka, alcoholic beverage products. Ethyl alcohol is subdivided into ethyl crude alcohol and the rectified ethyl alcohol. For production of ethyl alcohol the food raw materials specified in the list according to appendix 2 are used;

11) categories of ethyl alcohol from food raw materials:

- the rectified ethyl alcohol - the ethyl alcohol with a strength at least 96 percent made by method of spirit fermentation sakharo-and starch-containing raw materials from the subsequent bragorektifikatsiy distiller's beer or rectification of ethyl alcohol raw, and also the head fraction of ethyl alcohol made of food raw materials, and the products of conversion which are formed in case of production of ethyl alcohol of food raw materials, vodka, alcoholic beverage products, and containing the accompanying flying impurity;

- ethyl alcohol - raw - the ethyl alcohol with a strength less than 96 percent made by distillation of mature distiller's beer, intended for production of the rectified ethyl alcohol and containing the accompanying flying impurity;

12) categories of alcoholic drinks:

- vodka - the alcoholic drink fortress from 37,5 to 56 percent made on the basis of the rectified ethyl alcohol and the prepared (corrected) water with processing of aqueous-alcoholic solution (sorting) by sorbents with the subsequent filtering for complete cleaning and the representing colourless aqueous-alcoholic solution with taste and characteristic vodka aroma soft, inherent in vodka;

- vodka with the protected name of the place of goods origin - the vodka representing colourless aqueous-alcoholic solution fortress from 37,5 to 56 percent with taste soft, inherent in vodka, received by way of mixing of the rectified ethyl alcohol from grain raw materials with specially prepared (corrected) water with the subsequent processing of this aqueous-alcoholic solution active coal, without processing or with processing by powdered skim milk, with the subsequent filtering for complete cleaning through quartz sand with the established particle size distribution. The fragrant alcohols and the alcoholized infusions received from aromatic, fruit and other types of vegetable and food raw materials, extracts of vegetable raw materials, essential oils, vkusoaromatichesky natural substances, nutritional supplements, complex dietary supplements and other food ingredients are allowed;

- special vodka - vodka fortress from 37,5 to 45 percent with it is emphasized with the specific aroma and soft taste received for the account of introduction of food ingredients, and (or) with addition of fragrant alcohols, other aromatic components, made by way of mixing of the rectified ethyl alcohol from grain raw materials with specially prepared (corrected) water with the subsequent processing of this aqueous-alcoholic solution by active coal and the subsequent filtering for complete cleaning through quartz sand with the established particle size distribution;

- alcoholic beverage products - alcoholic drinks with a strength from 7 to 60 percent with sugar content no more than 600 g/l representing mix of the rectified ethyl alcohol, the prepared (corrected) water, various alcoholized juice, fruit drinks, infusions and fragrant alcohols received by conversion of fruit (fruit and berry) and aromatic vegetable raw materials with addition of sugar syrup, essential oils, grape wines, brandy, lemon acid and other food components (including carbon dioxide), and prepared by blending with the subsequent endurance or without endurance and filtering of blend. Availability in bottles with alcoholic beverage products of separate parts of the plants, fruits and berries provided by compounding is allowed. In production of vodka, vodka with the protected name of the place of goods origin, special vodka and alcoholic beverage products use of the rectified ethyl alcohol from head fraction of ethyl alcohol and waste of alcoholic beverage production is forbidden;

- aperitif - the alcoholic beverage product with a strength from 12 to 35 percent with content of sugar at least 50 and no more than 180 g/l made with use of the food ingredients giving soft taste of bitterness;

- cocktail - the alcoholic beverage product with a strength from 20 to 40 percent with sugar content no more than 240 g/l made with addition of food ingredients;

- balm - alcoholic beverage product with a strength at least 20 percent with content of general extract (solids) at least 50 g/dm3 from brown till dark brown color with spicy aroma, prepared from food ingredients and semifinished products which part herbs, sugar dye can be;

- gin - alcoholic drink fortress is at least percent 37,5 with the prevailing taste of juniper received by aromatization of aqueous-alcoholic solution by vkusoaromatichesky substances of berries of juniper "Juniperus communis L." and other natural vkusoaromatichesky substances, at the same time aroma and taste of juniper shall remain dominating;

- the distilled gin - alcoholic drink fortress is at least percent 37,5 with the prevailing taste and aroma of juniper received one - or repeated distillation of mix of ethyl alcohol fortress there is at least 96,2 of percent and the prepared (corrected) water with addition of fruits of juniper, without addition or with addition of other vegetable raw materials and (or) natural vkusoaromatichesky substances, without addition or with addition of the rectified ethyl alcohol, with the subsequent dilution (in need of) the prepared (corrected) water, without addition or with addition of dyes, sweeteners and other nutritional supplements;

- dry gin - the distilled gin with content of sugar of no more 0,1 of g/l which aroma is received only by means of redistillyation of ethyl alcohol by traditional method in the presence of all used natural plant materials (raw materials), and also from distillate of gin with a strength at least 70 percent without addition of dyes;

- liqueur - the alcoholic beverage product with a strength at least 15 percent made of the rectified ethyl alcohol or of alcoholic drinks with addition of sacchariferous products, products of agricultural origin or foodstuff (including milk and dairy products, wine, vkusoaromatichesky substances), with sugar content at least 70 g/l for the cherry brandy made of cherry distillate or at least 80 g/l for liqueur from gentian or similar plants which are the single aromatic raw materials, and also at least 100 g/l for other liqueurs. Vkusoaromatichesky substances are not used for fruit liqueurs from blackcurrant, cherry, raspberry, blackberry, bilberry, citrus, mulberry, the Arctic blackberry, cloudberries, blueberry, cowberry, sea-buckthorn, pineapple, and also for vegetable liqueurs from mint, gentian, anise, the Alpine wormwood, yazvennik, officinal herbs;

- strong liqueur - liqueur with a strength at least 35 percent with sugar content at least 250 g/l;

- liqueur dessert - liqueur with a strength less than 35 percent with sugar content at least 100 g/l;

- emulsion liqueur - liqueur with a strength at least 15 percent with sugar content at least 150 g/l, opaque, without foreign inclusions, made with addition of foodstuff (including milk, cream, eggs) and food ingredients or without them;

- liqueur egg - the liqueur with a strength at least 15 percent with sugar content at least 150 g/l made of distillate and (or) alcoholic drink which part yolks of eggs (at least 140 g/l for ready-made product), proteins of eggs, sugar or honey, with possible addition only of natural vkusoaromatichesky substances are;

- cream - the liqueur with a strength at least 15 percent with sugar content at least 250 g/l made of fruit (fruit and berry) raw materials with addition of food ingredients (except for dairy products);

- punch - the alcoholic beverage product with a strength from 15 to 20 percent with content of sugar at least 300 and no more than 400 g/l made of the rectified ethyl alcohol with addition of the alcoholized juice, fruit drinks from fruit (fruit and berry) raw materials, the alcoholized infusions of efiromaslichny raw materials and food ingredients;

- punch with rum - the alcoholic beverage product made of rum with addition of the alcoholized juice, fruit drinks from fruit (fruit and berry) raw materials, infusions of efiromaslichny raw materials and vkusoaromatichesky substances;

- fruit liqueur - the alcoholic beverage product with a strength from 18 to 20 percent with content of sugar at least 250 and no more than 400 g/l made of the alcoholized juice, fruit drinks with addition of food ingredients;

- tincture - the alcoholic beverage product with a strength from 16 to 60 percent with sugar content no more than 300 g/l made with use of food ingredients;

- bitters - the tincture with a strength from 25 to 60 percent with content of general extract no more than 30 g/l made with use of the food ingredients giving smack of bitterness;

- tincture semisweet - tincture with a strength from 20 to 40 percent with content of sugar at least 20 and no more than 100 g/l;

- tincture sweet - tincture with a strength from 16 to 29 percent with content of sugar at least 80 and no more than 300 g/l;

- tincture dessert - the alcoholic beverage product with a strength from 12 to 16 percent with content of sugar at least 140 and no more than 300 g/l made of semifinished products with addition of food ingredients;

- whisky - the alcoholic drink with a strength at least 40 percent with specific aroma and taste made one - or repeated distillation of the fermented mash from grain of cereals and (or) the malt prepared from it with the subsequent endurance of distillate the fortress of no more 94,8 of percent in wooden barrels with a capacity no more than 700 l within at least 3 years and its blending with the prepared (corrected) water without addition or with addition of sugar dye;

- rum - alcoholic drink fortress is at least percent 37,5 with specific aroma and taste made by dilution of distillate rum the prepared (corrected) water without endurance or with its endurance in oak container without addition or with addition of sugar dye;

- alcoholic drink from grain raw materials - the alcoholic drink with a strength from 35 to 60 percent made of the unrestrained or sustained grain distillates without addition or with addition of sugar and other sacchariferous products, natural vkusoaromatichesky substances, sugar dye, the prepared (corrected) water;

13) categories of low alcohol drinks:

- the low alcohol alcoholized drink - the low alcohol drink made with use of drinking or mineral water, the rectified ethyl alcohol and (or) distillates without addition or with addition of ingredients which use is provided by the document (documents) according to which alcoholic products (the standard, the standard of the organization, specifications or other document), including sacchariferous and vkusoaromatichesky substances are made;

- low alcohol drink of fermentation - the low alcohol drink with a strength no more than 6 percent made by spirit fermentation of mash, complete or incomplete spirit fermentation of the whole or crushed berries, fruit, honey, their mashes and made without addition of ethyl alcohol, and also without use of ethyl alcohol and products made with addition of ethyl alcohol without addition either with addition of carbon dioxide or with saturation by carbon dioxide as a result of fermentation of mash;

- mead - the low alcohol drink of fermentation by fortress from 1,5 to 6 percent made by spirit fermentation of the mash containing at least 8 percent of honey without use or with use of honey for sweetening and other products of beekeeping (including honey in honeycombs, propolis, zabrus, uterine bee milk, etc.), vegetable raw materials, without addition or with addition of natural sacchariferous substances, without saturation or with saturation by carbon dioxide as a result of fermentation of mash honey;

- Poiré - the low alcohol drink of fermentation with a strength no more than 6 percent made of the fermented pear mash and (or) the fermented recovered pear juice without addition or with addition of sacchariferous products, without saturation either with saturation by carbon dioxide or with saturation by carbon dioxide as a result of fermentation of pear mash before receipt of pressure of carbon dioxide in bottle at least 100 kPa at temperature of 20 °C;

- cider - the low alcohol drink of fermentation with a strength no more than 6 percent made of the fermented apple mash and (or) the fermented recovered apple juice without addition or with addition of sacchariferous products, without saturation either with saturation by carbon dioxide or with saturation by carbon dioxide as a result of fermentation of apple mash up to the carbon dioxide pressure in bottle at least 100 kPa at temperature of 20 °C;

- the cider flavored - the cider made with addition of natural vkusoaromatichesky substances;
