About federal state control (supervision) on road transport, urban land electric transportation and in road economy

According to article 3.1 of the Federal law "Charter of Road Transport and Urban Land Electric Transportation", article 13.1 of the Federal law "About Highways and about Road Activities in the Russian Federation and about Modification of Separate Legal Acts of the Russian Federation" and the Federal law "About the State Control (Supervision) and Municipal Control in the Russian Federation" Government of the Russian Federation decides:

1. Approve the enclosed Regulations on federal state control (supervision) on road transport, urban land electric transportation and in road economy.

2. Recognize invalid acts and separate provisions of acts of the Government of the Russian Federation according to the list according to appendix.

3. Determine that realization of the powers provided by this resolution is performed by Federal Service for the Oversight of Transport within the limiting Russian Federation established by the Government of the number of employees of central office and territorial authorities of Federal Service for the Oversight of Transport, and also budgetary appropriations provided to Federal Service for the Oversight of Transport on management and management in the sphere of the established functions.

4. This resolution becomes effective since July 1, 2021.

Regulations on federal state control (supervision) on road transport, urban land electric transportation and in road economy

I. General provisions

1. This Provision establishes procedure for the organization and implementation of federal state control (supervision) on road transport, urban land electric transportation and in road economy (further - supervision).

2. Subject of supervision is observance:

a) the mandatory requirements established by Articles 6 and 7, parts 1 and 2 of Article 8, parts 1 and 2 of Article 18 and articles 21.1 and 27 of the Federal law "Charter of Road Transport and Urban Land Electric Transportation";

b) licensed requirements to activities for transportation of passengers and other persons by buses;

c) mandatory requirements to transportations of dangerous and perishable loads;

d) mandatory requirements to implementation:

driving through highways public of federal importance of the vehicles having the permitted maximum weight over 12 tons;

movements of heavy and large-size vehicles (weight and dimensional control);

driving of vehicles through paid highways public of federal importance, paid sections of highways public of federal importance regarding observance of procedure for introduction of fare of the vehicle;

operation of the objects of road service placed in strips of branch and (or) roadside strips of highways public of federal importance;

works on capital repairs, repair and content of highways public of federal importance and artificial road constructions on them (including requirements to road-building materials and products) regarding ensuring safety of highways;

e) mandatory requirements in the field of the organization of regular transportations:

to availability of routemaps of regular transportations at carriers and transport drivers;

to compliance of characteristics of the vehicle to the data specified in the route map of regular transportations;

to procedure for landing of passengers in vehicles and disembarkation of passengers from vehicles;

to the equipment of the objects of transport infrastructure intended for servicing of passengers of interregional routes of regular transportations (bus stations, bus stations, stopping points);

to accomplishment of the flights provided by the schedule along interregional route of regular transportations;

to accomplishment of the set restrictions to the organization of transportations of passengers and baggage by request for the purpose of free implementation of regular transportations;

e) mandatory requirements in the field of the international motor transportations:

to the vehicles used for implementation of the international motor transportations;

to availability and compliance of registration (filling) of documents which are required for implementation of the international motor transportations (permissions, accounting coupons, notifications, commodity-transport delivery notes and other documents);

to distinctive marks of the state in the territory of which the vehicle is registered;

to transportation of passengers by buses;

to work of crews of vehicles, including regarding observance of work-rest schedule of drivers, and also compliance of control devices of registration of work-rest schedule of drivers (tachographs);

to transit transportations, including transportations of separate types of agricultural products, raw materials, food and separate types of goods;

g) mandatory requirements to use of navigation aids when implementing transportations of passengers and freights;

h) the mandatory requirements imposed to the legal entities and individual entrepreneurs performing operation of vehicles:

to the organization of work of transport drivers according to requirements to safety of traffic by holding training of drivers, carrying out the corresponding instructing of drivers for the purpose of providing them with operational information on ensuring safe transportation and advanced training and professional skill of drivers;

to organization of events on observance of the work-rest schedule of drivers set by the legislation of the Russian Federation checked in stationary and portable checkpoints, in places of landing and (or) disembarkation of the passengers established by the legislation of the Russian Federation in the sphere of road transport and urban land electric transportation, highways, road activities regarding safety of highways, the international motor transportations and also in the location of the controlled organizations;

to the organization of holding actions for elimination of the reasons promoting making of the road accidents, and road traffic offenses with participation of the vehicles belonging to them;

to organization of events on performing obligatory medical examinations of transport drivers, stipulated by the legislation the Russian Federation, and also actions for enhancement by drivers of skills of first-aid treatment by the victim in the road accidents;

to implementation of maintenance of vehicles in the terms provided by documentation of manufacturing plants of vehicles;
