1. Approve the enclosed Rules of issue of import permits on the territory of the Republic of Kazakhstan from state members of the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these states of ozone-depleting substances and products containing them.

2. To provide to department of climatic policy and green technologies of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan;

3) within ten working days after state registration in the Ministry of Justice of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of issue of import permits on the territory of the Republic of Kazakhstan from state members of the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these states of ozone-depleting substances and products containing them

Chapter 1. General provisions

1. These rules of issue of import permits on the territory of the Republic of Kazakhstan from state members of the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these states of ozone-depleting substances and products containing them (further - Rules) are developed according to Item 2 of article 308 of the Ecological code of the Republic of Kazakhstan (further - the Ecological code), the subitem 4) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law) for the purpose of implementation of the Law of the Republic of Kazakhstan "About ratification of the Agreement on movement of ozone-depleting substances and containing from products and accounting of ozone-depleting substances when implementing mutual trade of state members of the Eurasian Economic Union and the Protocol on accession of the Kyrgyz Republic to the Agreement on movement of ozone-depleting substances and containing from products and accounting of ozone-depleting substances when implementing mutual trade of state members of the Eurasian Economic Union of May 29, 2015" also determine procedure for issue of import permits on the territory of the Republic of Kazakhstan from state members of the Eurasian Economic Union (further - the Union) and export from the territory of the Republic of Kazakhstan to these states of ozone-depleting substances and containing them products.

2. These rules extend to the individual entrepreneurs and legal entities performing import to the territory of the Republic of Kazakhstan from state members of the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these states of ozone-depleting substances and containing them products specified in Sections 1.1 and 2.1 of the Inventory to which measures of non-tariff regulation are applied approved by the Decision of Board of the Eurasian economic commission of April 21, 2015 No. 30 "About measures of non-tariff regulation".

3. Import to the territory of the Republic of Kazakhstan from state members of the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these states of ozone-depleting substances (except products containing them) physical persons for private use (in non-commercial purposes) is prohibited.

4. The export permit of ozone-depleting substances and products containing them from the territory of the Republic of Kazakhstan on the territory of state member of the Eurasian Economic Union is issued in the presence of the conclusion (the allowing document) for import of such substances and products issued by competent authority of the corresponding state member of the Eurasian Economic Union on which territory import of ozone-depleting substances and products containing them is supposed.

5. Receipt of permission is not required:

1) when moving by physical persons of products containing ozone-depleting substances for private use (in non-commercial purposes);

2) when moving ozone-depleting substances together with air, sea (river), railway, the automotive vehicle with the purpose and in quantity which are necessary for ensuring normal operation of the equipment and technical devices of this vehicle, including for gas station, refill of refrigeration equipment, air conditioning systems, fire extinguishing means and other equipment, and technical devices for which operation according to technical characteristics ozone-depleting substances are necessary.
