About approval of Rules of development of target indicators of quality of the environment, including the minimum list of indicators for which target indicators of quality of the environment are established

According to Item 6 of article 37 of the Ecological code of the Republic of Kazakhstan I ORDER:

1. Approve:

1) Rules of development of target indicators of quality of the environment according to appendix 1 to this order;

2) the Minimum list of indicators for which target indicators of quality of the environment, according to appendix 2 to this order are established.

2. Recognize to invalid:

1) the order of the Minister of Energy of the Republic of Kazakhstan of February 26, 2015 No. 145 "About approval of Rules of determination of target indicators of quality of the environment" (it is registered in the Register of state registration of regulatory legal acts for No. 10869);

2) the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of May 19, 2020 No. 111 "About modification of the order of the Minister of Energy of the Republic of Kazakhstan of February 26, 2015 No. 145 "About approval of Rules of determination of target indicators of quality of the environment" (it is registered in the Register of state registration of regulatory legal acts for No. 20717).

3. To provide to department of environmental policy and sustainable development of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of development of target indicators of quality of the environment

Chapter 1. General provisions

1. These rules of development of target indicators of quality of the environment (further – Rules) are developed according to Item 6 of article 37 of the Ecological code of the Republic of Kazakhstan and regulate process of holding actions for development of target indicators of quality of the environment.

2. In these rules the following basic concepts are used:

1) regulation of quality of the environment – establishment of the maximum permissible regulations of impact guaranteeing ecological safety of the population, preserving gene pool, providing rational use and reproduction of natural resources in the conditions of sustainable development of economic activity;

2) target indicators of quality of the environment – set of quantity and quality characteristics of condition of separate components of the environment and other indicators characterizing the level of providing environmental measures and to effective management of waste which need to be reached for certain period of time;

3) package of measures for achievement of target indicators of quality of the environment – organizational and technical actions which accomplishment provides step-by-step decrease in level of anthropogenous impact on the environment and achievement of standard rates of quality of the environment;

4) monitoring of achievement of target indicators of quality of the environment – implementation of package of measures for periodic laboratory and analytical control of the course of accomplishment of package of measures for achievement of target indicators of quality of the environment;

5) the customer of works on project development of target indicators of quality of the environment (further – the Customer) – the local executive body of area, city of republican value, the capital developing target indicators of quality of the environment for program implementation of development of the territories of the corresponding administrative and territorial unit;

6) the contractor on project development of target indicators of quality of the environment (further – the Contractor) – the physical person or legal entity performing project development of target indicators of quality of the environment according to the qualification requirements established by the Customer;

7) the project of target indicators of quality of the environment – the set of materials prepared by the Contractor, including results of analytical, field and laboratory surveys on determination of target indicators of quality of the environment;

8) adjustment of the project of target indicators of quality of the environment – complex of the works which are carried out at the initiative of the Customer in case of achievement of target indicators of quality of the environment, need of introduction of new target indicators of quality of the environment or change of standard rates of quality of the environment;

9) the summary of nontechnical nature – summary of project materials of target indicators of quality of the environment;

10) priority pollutants of the environment – the list of the pollutants, most dangerous to certain regions, of which high toxicity, capability to accumulating and stability are characteristic.
