About measures for the organization of activities of the Agency of cultural heritage under the Ministry of tourism and sport of the Republic of Uzbekistan, and also to innovative development of the sphere

For the purpose of strengthening of activities for preserving the unique and rare cultural heritage displaying rich history and culture of the people of Uzbekistan, digitalization, innovative development and strengthening of material and technical resources of the sphere, effective use of the best international experience, and also ensuring execution of the Presidential decree of the Republic of Uzbekistan of April 6, 2021 No. UP-6199 "About Measures for Further Enhancement of System of Public Administration in Spheres of Tourism, Sport and Cultural Heritage":

1. Take into consideration that under the Ministry of tourism and sport the Agency of cultural heritage is formed (further - the Agency) and its managements in the Republic of Karakalpakstan, areas and the city of Tashkent.

2. Determine the main objectives of the Agency:

a) in the sphere of protection of objects of material cultural heritage:

identification, acceptance on accounting, protection, promotion, maintaining the state register, electronic catalog, passports and state inventories, determination of security borders of objects of material cultural heritage, and also implementation of the state control in the sphere;

rational use of objects of material cultural heritage, including effective management of them on the basis of public-private partnership, digitalization of the sphere and implementation of modern information technologies;

implementation of works on preserving on real estate objects of material cultural heritage, accomplishment of function of the customer, continuous conducting scientific and technical control, conducting examination regarding influence of historical and cultural examination and the design estimates on historical and cultural value;

b) in the sphere of the museums:

maintaining the state catalog of national museum fund, inclusion of museum pieces and museum collections in structure of national museum fund, their removal from structure of the specified fund, issue according to the procedure of universal succession or different way of special permission for transition from one person to the second person, and also implementation of the state control in the sphere;

coordination and development of activities of the museums, advanced training, retraining and carrying out employee assessment of the museums, determination of categories of the museums, ensuring openness of national museum fund, studying and promoting, and also performance of works on restoration and preserving museum pieces and museum collections;

c) in the sphere of especially protected historical and cultural territories:

protection of especially protected historical and cultural territories, development of passports, management plans, the modes and determination of the protected borders, preserving historical and cultural value, uniqueness, natural landscape and peculiar features of the specified territories and historical makhally;

the recommendation of inclusion of historical places in the List of the world heritage, control of fulfillment of requirements of the Convention on protection of the world cultural and natural heritage, recommendations of UNESCO, the Center of the world heritage and Committee of the world heritage in the territory of our country;

d) in the sphere of archeology:

support, implementation of coordination and control of archaeological researches, issue of permissions to archaeological researches, conducting examination and ensuring safety of scientific reports;

maintaining the state catalog of archaeological exhibits, organization of transfer to their state, fixing of archaeological exhibits to organizations of science, culture, education, and also their alienation;

protection of objects of archaeological heritage, ensuring immediate carrying out researches on the archaeological objects which are on the verge of destruction, preservation and transformation of archaeological objects into the museums, and also creation of archaeological parks;

e) in the sphere of cultural values within the country and abroad:

protection of cultural values, including issue of certificates on export out of limits of the Republic of Uzbekistan and import of cultural values to the territory of our country, coordination of their realization, conducting art examination, determination of category and maintaining the state register of cultural values, implementation of the state control in the sphere;

identification, and also creation and regular updating of the complete database on the cultural values abroad relating to history and culture of our country, homecoming of originals or copies, photo and video images of the specified values;

the edition in different languages and extended coverage in mass media and the Internet of bibliographic collections, catalogs, books albums, newsletters and other printed materials containing the scientific data obtained on the basis of scientific research and analysis results of these data, and also cooperation with the international and foreign organizations.

3. Determine that:

The agency is special representative state body of management in the sphere of material cultural heritage, the museums, archeology, export and import of cultural values;

the decisions made by the Agency within the competence are obligatory to execution by bodies of the public and economic board, executive power at the local level, other organizations and their officials, and also citizens;

The agency introduces written preventions and instructions respectively for non-admission of violations or elimination of violations of acts of the legislation, obligatory for execution, in the sphere;

The agency brings representations, obligatory for consideration, on suppression of the facts of violation of the law, elimination of the reasons and conditions promoting them, and also acceptance of adequate measures concerning guilty officials.

4. Establish procedure according to which:

coordination with the Agency of drafts of regulatory legal acts in the sphere and master plans of settlements in which real estate objects of material cultural heritage are located is obligatory;

projects of works on construction, demolition and improvement of real estate objects of material cultural heritage, and also the objects located in especially protected historical and cultural territories, in the territories included in the List of the world heritage, and their protected borders are approved with the Agency without fail. At the same time projects on the territories (objects) included in the List of the world heritage are approved with the Center of the world heritage of UNESCO through the National commission on cases of UNESCO;

the state register of real estate objects of material cultural heritage affirms the Cabinet of Ministers;

fixing of the real estate objects of material cultural heritage which are the state-owned real estate on the basis of the right of operational management or on the basis of the right of free use is performed based on decisions of the President of the Republic of Uzbekistan and the Cabinet of Ministers;

preliminary results of the state control on the facts of harming object of material cultural heritage are subject to obligatory bringing to data of the public through the official site of the Agency within 24 hours from the moment of receipt of the notification;

for the purpose of scientific and technical research of all stages of planning and implementation of works on preserving, and also proceeding from peculiar features and condition of each object scientific and technical research groups are created, compensation of members of group is provided in the design estimates of works on preserving;

The address list of real estate objects of material cultural heritage on which works on preserving are carried out at the expense of means of the Government budget affirms the deputy prime minister - the minister of tourism and sport based on the positive conclusions of scientific and technical research groups and Scientific advisory council of the Agency;

performance of works on preserving requires availability of permission of the Agency issued based on the positive conclusions of scientific and technical research groups and Scientific and technical council, in case of non-compliance with this rule - the issued permission is nullified;

the rights and obligations determined in acts of the legislation for the state court experts extend to members of Scientific advisory council and scientific and technical research groups. The conclusion of Scientific advisory council is obligatory for the Agency.

5. Approve:

organizational structure of the Agency of cultural heritage under the Ministry of tourism and sport according to appendix No. 1;

structure of central office of the Agency of cultural heritage under the Ministry of tourism and sport with the total extreme number of managerial personnel of 65 units according to appendix No. 2.

Determine the extreme number of managerial personnel of managements in the Republic of Karakalpakstan, areas and the city of Tashkent (further - territorial administrations) the Agencies - 145 units.

Determine that additional 30 established posts for structures of central office and territorial administrations of the Agency are allocated due to optimization of number of employees of the state museums.

6. Provide to the minister of tourism and sport the right:

make changes to structures of central office, territorial administrations, other organizations of system of the Agency within the total number of their managerial personnel and the salary fund;

approve structures and charters, and also to determine the extreme number of managerial personnel of territorial administrations of the Agency.

7. Determine that:

the director of the Agency of the status, payment terms of work, medical and transport attendance is equated to the first deputy minister of tourism and sport;

the director of the Agency and its deputies based on representation of the minister of tourism and sport are appointed to position and dismissed by the Cabinet of Ministers;

length of service as the employee of the Agency is set off upon transition to work to other state bodies, including to law enforcement and monitoring bodies, for receipt of the next military and special ranks, and also calculation of allowances for military and special ranks and surcharges for long service;

planning, carrying out, coordination and scientific and technical control of works on preserving are performed on real estate objects of material cultural heritage according to the scheme according to appendix No. 3.

8. Determine sources of financing of off-budget fund of cultural heritage of the Agency (further - Fund):
