Some questions of forming and use of the certificate confirming vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus negative result of testing or recovery of person from the specified disease

The Cabinet of Ministers of Ukraine decides:

1. Agree with the offer of the Ministry of Health and Ministry of digital transformation concerning introduction taking into account recommendations of the European Commission 2021/472 of March 17, 2021 of the certificate confirming vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus negative result of testing or recovery of person from the specified disease (further - COVID certificate).

2. Approve enclosed:

Procedure for forming and use of the certificate confirming vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus negative result of testing or recovery of person from the specified disease;

Rules of confirmation of action COVID certificate confirming vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus negative result of testing or recovery of person from the specified disease;

samples of COVID certificates, COVID-19, of SARS-CoV-2, caused by coronavirus confirming vaccination against sharp respiratory disease negative result of testing or recovery of person from the specified disease;

Procedure for forming of the international COVID certificate confirming vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus for issue to some categories of foreigners and to stateless persons which on legal causes live or are in the territory of Ukraine.

2-1. Determine that:

1) forming and use, including confirmation of action, foreign and international COVID certificates are performed in interaction with confidential network of the European Union or global network of certification of digital health care of WHO (further - global network WHO) and according to documentation of networks;

2) No. 88 Is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 02.02.2022

3. Bring in the resolution of the Cabinet of Ministers of Ukraine of December 9, 2020 No. 1236 "About establishment of quarantine and introduction of rationing anti-epidemic arrangements for the purpose of prevention of distribution in the territory of Ukraine of sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus" (The Official Bulletin of Ukraine, 2021, No. 1, the Art. 14, No. 17, the Art. 664, No. 19, the Art. 811, No. 27, the Art. 1442) - with the changes made by resolutions of the Cabinet of Ministers of Ukraine of June 2, 2021 No. 583 and of June 16, 2021 No. 611, changes which are applied.

4. To the Ministry of Health:

1) to approve regulations of the circulation of the data necessary for forming and use of COVID certificates in a month;

2) to give changes to rules of validation COVID certificates of Ukraine:

To the Ministry of Foreign Affairs - for the official translation of the specified changes into English and, whenever possible, on other state languages of state members of confidential network of the European Union and the states which joined global network WHO;

Administrations of the State Border Service - for accounting in office activities;

To the ministry of digital transformation - for transfer to confidential network of the European Union or global network WHO in the formats determined by documentation of networks.

5. To the ministry of digital transformation:

if technically possible receipts of data from the central database of electronic health care system to provide forming, reflection and confirmation of action of COVID certificates through the Single state web portal of electronic services, (further - the Action Portal), including with use of mobile application of the Action Portal (Action) (further - mobile application of the Action Portal);

provide electronic identification and authentication of person, including with use of the integrated system of electronic identification, the digital signature based on the qualified digital signature certificate and/or other means of identification which allow to identify unambiguously the personality during data transmission in the central database of electronic health care system, for the purpose of forming, display and confirmation of action of COVID certificates through the Action Portal, including with use of mobile application of the Action Portal;

provide access of the State Border Service to Administration and Ministry of Foreign Affairs to the software used in confidential network of the European Union and global network WHO for check COVID certificates force;

provide development of the software for check of action of COVID certificates in the territory of Ukraine by bodies, divisions, physical persons and legal entities (their representatives) to which the legislation grants the right to carry out such inspection, including with use of mobile application of the Action Portal;

perform permanent updating of the software in case of change in the data sets necessary for forming and use of COVID certificates.

till December 31, 2022 to develop and submit to the Cabinet of Ministers of Ukraine for approval the draft of regulations of the address of keys for the certificate and check of reality of COVID certificate.

6. To the Ministry of Foreign Affairs:

provide entering of data on possibility of use of COVID certificate for crossing of frontier of foreign states into interactive resource for reflection of features of entrance to foreign states;

provide together with the Ministry of Health carrying out with foreign states of work with the purpose of mutual recognition of documents on vaccination from COVID-19;

perform informing the Ministry of Health, Ministry of digital transformation, Administration of the State Border Service about conditions of the agreements on mutual recognition of documents on vaccination reached with foreign states from COVID-19;

provide official informing the European Commission and other state members of confidential network of the European Union and the states which joined global network WHO about changes of rules of validation of COVID certificates of Ukraine;

it is permanent to perform at technological level of compliance of rules of check of COVID certificates of foreign states to the international agreements and to report to foreign state about the found discrepancy.
