1. Approve:

1) Rules and terms of representation by authorized body in the field of regulation of trading activity of data on transactions of physical persons with exchange goods according to appendix 1 to this order;

2) form of data on transactions of physical persons with exchange goods according to appendix 2 to this order.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Sultangaziyev M. E.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:

1) the direction of the copy of this order in the state and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order becomes effective from the date of its signing.

Chapter 1. General provisions

1. These rules and terms of representation by authorized body in the field of regulation of trading activity of data on transactions of physical persons with exchange goods (further - Rules) are developed according to Item 15-1 of article 26 of the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget" (Tax code) and determine procedure and terms of representation by authorized body in the field of regulation of trading activity (further - Authorized body) data on transactions of physical persons with exchange goods (further - Data).

Chapter 2. Procedure and terms of representation by authorized body in the field of regulation of trading activity of data on transactions of physical persons with exchange goods

2. Data are represented by Authorized body monthly to the 5th following the accounting period to Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further - Committee) by means of transfer on the information and communication network providing protection, authenticity confirmation, integrity checking and enciphering of the data on the form approved according to appendix 2 to this order transferred on network.

3. Within tax control the body of state revenues sends inquiry of body of state revenues for submission of data to Authorized body by form according to appendix to these rules.

Data are represented by Authorized body to the body of state revenues which sent inquiry within 10 (ten) working days from the date of receipt of request.

4. Data are represented in the state and (or) Russian languages and are signed by the head of Authorized body or person replacing it and also the worker responsible for creation of data.

5. In case of impossibility of submission of Data on information and communication network, and also in case of technical errors of the Data are represented in the electronic medium in the Microsoft Excel format by mail by the registered mail with the notification.

6. The body of state revenues provides confidentiality of information obtained within these rules.
