About approval of Aviation rules of Ukraine of "The rule of certification of civil airfields of Ukraine"

According to parts one and the fifth Article 11, to part one of article 65 of the Air code of Ukraine, Items 4, 8 Regulations on the Public air service of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 8, 2014 No. 520, for the purpose of implementation of the state supervision of observance of the requirements for civil airfields established by the legislation and implementation of procedures of certification of airfields of PRIKAZYVAYU:

1. Approve Aviation rules of Ukraine of "The rule of certification of civil airfields of Ukraine" which are attached.

2. Approve Changes in the Rules of certification of the airports approved by the order of Public service of Ukraine on supervision of safety of aircraft of June 13, 2006 No. 407, registered in the Ministry of Justice of Ukraine on June 23, 2006 for No. 740/12614 (with changes) which are applied.

3. (Golodnyak G. G.) to provide to management of airfields and airports in the procedure established by the legislation submission of this order on state registration in the Ministry of Justice of Ukraine.

4. Determine that the certificates of airfields issued according to the Rules of certification of civil airfields of Ukraine approved by the order of Public service of Ukraine on supervision of safety of aircraft of October 25, 2005 No. 796, registered in the Ministry of Justice of Ukraine on November 10, 2005 for No. 1357/11637, are effective during the effective period established in them.

5. Declare invalid the order of Public service of Ukraine on supervision of safety of aircraft of October 25, 2005 No. 796 "About approval of Rules of certification of civil airfields of Ukraine", registered in the Ministry of Justice of Ukraine on November 10, 2005 for No. 1357/11637 (with changes).

6. This order becomes effective in 6 months from the date of its official publication.

Aviation rules of Ukraine of "Rule of certification of civil airfields of Ukraine"

I. General provisions

1. These Aviation rules extend and are obligatory for all legal entities, irrespective of patterns of ownership and departmental accessory which perform operation of civil airfields (helidromes) or airfields of joint use used for flights of aircrafts of civil aviation (further - airfields).

These Aviation rules are not applied to airfields (helidromes) certified according to the Aviation rules of Ukraine "Technical requirements and ministerial procedures for certification of airfields" approved by the order of the Public air service of Ukraine of November 06, 2017 No. 849, registered in the Ministry of Justice of Ukraine on December 28, 2017 for No. 1574/31442.

These Aviation rules are not applied to the runway platforms allowed to operation according to the Rules of the admission to operation of runway platforms for flights of light aircrafts approved by the order of Public service of Ukraine on supervision of safety of aircraft of December 1, 2004 No. 205, registered in the Ministry of Justice of Ukraine on December 24, 2004 for No. 1644/10243.

2. These Aviation rules are used by preparation of materials for certification of airfields (helidromes), and also implementation of supervision of operators of these airfields (helidromes) and applied by authorized body concerning civil aviation (further - authorized body), operators of airfields (helidromes).

3. Operation of airfield (helidrome) for the purpose of accomplishment of air transportation and/or aviation works in the absence of the certificate or in case of cancellation or cancellation of the certificate received according to these Aviation rules is forbidden.

4. The operator of airfield (helidrome) can perform activities for land servicing on condition of passing of the procedure of certification and receipt of the certificate of conformity according to requirements of Rules of certification of the airports approved by the order of Public service of Ukraine on supervision of safety of aircraft of June 13, 2006 No. 407, registered in the Ministry of Justice of Ukraine on June 23, 2006 for No. 740/12614 (with changes).

5. The operator of airfield (helidrome) shall exercise control of activities of subjects of land servicing and the subjects rendering services in management on the platform within the implemented safety management system of flights in airfield (helidrome).

6. In these Aviation rules terms are used in such values:

cancellation of the certificate - the official procedure as a result of which the certificate is nullified;

the responsible head - the official of the operator of airfield (helidrome) who has the corresponding qualification and powers on the organization of activities of the operator of airfield (helidrome) and is responsible for management of the organization (including for financial questions);

declaring - the documented intentions of the subject of aviation activities to perform services in management of activities and movement of aircrafts and vehicles on the platform of one or more airfield(s);

the declaration - the document containing data concerning the subject rendering services in management on the platform, amount and procedure for provision of these services in airfield(s);

appendix to the certificate - the document which is attached to the certificate is used for amendment of its general provisions and is its integral part;

the operator of airfield (helidrome) - the legal entity performing operation of airfield (helidrome);

the request - the official address of the operator of airfield (helidrome) in the corresponding form in authorized body for receipt of the certificate and appendix to the certificate;

the applicant - the operator of airfield (helidrome) who submitted to authorized body the application for receipt of the certificate and appendix to the certificate;

inspection check - check which is performed by authorized body in the course of supervision of activities of the certified airfields (helidromes);

management of airfield (helidrome) - integral part of the request for receipt of the certificate and appendix to the certificate which component are procedures and estimates on safety which are subject to coordination with authorized body;
