About questions of provision of the statement from the register of contracts containing the data which are the state secret when implementing purchases of goods, works, services for ensuring the state and municipal needs

1. Determine that concerning contracts, data on which execution are included in the register of contracts containing the data which are the state secret (further - the register of contracts), till January 1, 2022:

the supplier (the contractor, the contractor) has the right to send to the customer inquiry for provision of the statement about the contracts included in the register data concerning the performed such supplier (the contractor, the contractor) of the contract (further - the statement);

the customer, in case of authorization by him according to requirements of the legislation of the Russian Federation about the state mystery of provision to the supplier (the contractor, the contractor) of the statement, no later than 3 working days following behind day of receipt of request of the supplier (the contractor, the contractor) constitutes the statement in the form approved by the Ministry of Finance of the Russian Federation;

the supplier (the contractor, the contractor) sends with observance of requirements of the legislation of the Russian Federation on the state secret the statement to the Federal Treasury;

The Federal Treasury no later than 3 working days following behind day of receipt of the statement directed by the supplier (the contractor, the contractor) puts down on it mark about compliance to information containing in it to the data included in the register of contracts and sends to the supplier (the contractor, the contractor) with observance of requirements of the legislation of the Russian Federation on the state secret the statement with the specified mark or in case of lack of information containing in the statement in the register of contracts or in case of its discrepancy to the data included in the register of contracts returns the statement to the supplier (the contractor, the contractor) with indication of return reason;

the supplier (the contractor, the contractor) has the right to use with observance of requirements of the legislation of the Russian Federation on the state secret the statement with mark of the Federal Treasury as the document confirming the procurement participant's compliance to the additional requirements provided by the order of the Government of the Russian Federation of February 4, 2015 No. 99 "About establishment of additional requirements to procurement participants of separate types of goods, works, services, cases of reference of goods, works, services to goods, works, services which because of their technical and (or) technological complexity, innovative, high-technology or specialized nature only suppliers (contractors, contractors) having necessary skill level and also the documents confirming compliance of procurement participants to the specified additional requirements" are capable to deliver, execute, render instead of documents (the copy of the performed contract (agreement), the copy of the act (acts) of the performed works, the copy (copies) of earlier performed (performed) contract (contracts), the agreement (agreements) provided by appendices No. 1 and 2 to the specified resolution.

2. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning provision of the statement from the register of contracts containing the data which are the state secret when implementing purchases of goods, works, services for ensuring the state and municipal needs.

3. Item 2 of this resolution becomes effective since January 1, 2022.

Changes which are made to acts of the Government of the Russian Federation concerning provision of the statement from the register of contracts containing the data which are the state secret when implementing purchases of goods, works, services for ensuring the state and municipal needs

a) in Item 3:

add the subitem "e" with the offer of the following content: "When implementing purchases on delivery of the goods provided by line item 6(1) appendices No. 1 to the order of the Government of the Russian Federation of February 4, 2015 No. 99 "About establishment of additional requirements to procurement participants of separate types of goods, works, services, cases of reference of goods, works, services to goods, works, services which because of their technical and (or) technological complexity, innovative, high-technology or specialized nature only suppliers (contractors, contractors) having necessary skill level are capable to deliver, execute, render and also the documents confirming compliance of procurement participants to the specified additional requirements" in the register of contracts also the group and class of goods on the Single codifier of objects of supply for federal state needs joins (EC 001-2020).";

c) in paragraph three of Item 12 of the word "in subitems "z" - "to" Item 3" shall be replaced with words "in subitems "z" - "to" and Item 3 "m"";

d) add with Items 23 and 24 of the following content:

"23. The supplier (the contractor, the contractor) for the purpose of participation in procurement of separate types of goods, works, services concerning which participants the Government of the Russian Federation establishes additional requirements according to parts 2 and 2.1 of article 31 of the Federal Law has the right to send with observance of requirements of the legislation of the Russian Federation on the state secret to authorized body request about provision of the statement from the register of contracts about the contracts included in the register data concerning the performed such supplier (the contractor, the contractor) of the contract.
