About procedure for functioning of national mail electronic system

Based on part nine of article 15 of the Law of the Republic of Belarus of December 15, 2003 "About mail service" the Council of Ministers of the Republic of Belarus DECIDES: No. 258-Z

1. Approve Regulations on procedure for functioning of national mail electronic system it (is applied).

2. This resolution becomes effective after its official publication and extends the action to the relations which arose since January 3, 2021.

Regulations on procedure for functioning of national mail electronic system

Chapter 1. General provisions

1. This Provision determines procedure for functioning of national mail electronic system, including procedure for acceptance, processing, storage, delivery (delivery) electronically of mailings (simple or custom), notifications on mailings, notifications on receipt of mailings, transfer of other messages connected with acceptance, processing, storage, delivery (delivery) of mailings, idea of confirmation of their acceptance and delivery (delivery), and also authorization of users of national mail electronic system in national mail electronic system.

2. The relations which are not settled by this Provision are regulated by the Law of the Republic of Belarus "About mail service", the Rules of rendering services of mail service public approved by the resolution of Council of Ministers of the Republic of Belarus of September 7, 2004 No. 1111, and other acts of the legislation.

3. In this Provision terms and their determinations in the values established by the Law of the Republic of Belarus "About mail service" and also the following terms and their determinations are used:

authorization - provision to certain user of national mail electronic system of the rights to making of certain actions in it;

authentication - check of authenticity of the user of national mail electronic system in national mail electronic system;

identification - complex of actions for establishment and fixing of data on the user of national mail electronic system;

the registered mail electronically sent by means of national mail electronic system (further - the registered mail electronically), - the mailing sent with fixation of the fact of acceptance (sending) from the sender and delivery (delivery) to the addressee;

users of national mail electronic system (further - users) - the physical persons and legal entities which are senders and (or) receivers of mailings electronically and also consumers of other services and services electronically provided by the national operator of mail service by means of national mail electronic system;

the mailing electronically sent by means of national mail electronic system (further - the mailing electronically), - information (data) accepted by the national operator of mail service for transfer and delivery (delivery) to the addressee;

the simple mailing electronically sent by means of national mail electronic system (further - the simple mailing electronically), - the mailing sent with fixation of the fact of acceptance (sending) from the sender and without fixation of the fact of delivery (delivery) to the addressee;

electronic mail service - actions or activities for acceptance, processing, storage, delivery (delivery) electronically mailings (simple or custom), notifications on mailings, notifications on receipt of mailings, transfer of other messages connected with acceptance, processing, storage, delivery (delivery) of mailings, to idea of confirmation of their acceptance (sending) and delivery (delivery);

electronic postage stamp - the electronic sign which is put down on the mailing electronically, confirming the fact of transfer of the mailing electronically in certain date and time;

electronic mailbox - the disk space assigned to the user of national mail electronic system on the server intended for acceptance and (or) sending mailings electronically, notifications on mailings, notifications on receipt of mailings, other messages connected with acceptance, processing, storage, delivery (delivery) of mailings, receipts of other services and services electronically provided by the national operator of mail service;

the electronic character of mail payment - the sign of mail payment electronically containing information on the cost of electronic mail service and confirming its payment.

4. The owner and the operator of national mail electronic system is the national operator of mail service by whom are performed creation, program and technical maintenance and development of national mail electronic system, the regulations of its functioning affirm.

5. In case of transfer of mailings by means of national mail electronic system the national operator of mail service puts down on the mailing electronically electronic postage stamp which confirms the fact of acceptance, transfer and delivery (delivery) of mailings electronically between users.

6. The payment for the electronic mail services rendered by means of national mail electronic system is levied in case of acceptance of mailings electronically on the rates of the national operator of mail service operating for date of acceptance of such departures.

The electronic character of mail payment is applied to confirmation of the fact of payment of the mail electronic service rendered by means of national mail electronic system.

7. The national mail electronic system is public.

Chapter 2. Procedure for provision of access to national mail electronic system. Rights of users

The national operator of mail service determines procedure for identification, authentication and authorization of the user in national mail electronic system, registration procedure and uses of electronic mailbox, and also services and services electronically, available to the user in national mail electronic system.

9. Acceptance, processing, storage, delivery (delivery) electronically of mailings (simple or custom), notifications on mailings, notifications on receipt of mailings, transfer of other messages connected with acceptance, processing, storage, delivery (delivery) of mailings, idea of confirmation of their acceptance and delivery (delivery) are performed on condition of passing by the user of procedures of identification, authentication and authorization in national mail electronic system and provisions of consent to receipt of mailings electronically.

10. User identification is performed in case of registration of electronic mailbox by it in national mail electronic system after the conclusion of the contract between the national operator of mail service and the user in whom conditions of use of national mail electronic system, and also the mutual rights and obligations of the Parties are determined.
