About questions of the State committee on ecology and climate of the Kyrgyz Republic

For the purpose of providing ecological safety, strengthening of environmental measures and decrease in climate risks, according to the Presidential decree of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" of May 5, 2021 114, articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides No.:

1. Form:

1) the State committee on ecology and climate of the Kyrgyz Republic based on the State agency of environmental protection under the Ministry of emergency situations of the Kyrgyz Republic, with transfer of function:

- in the field of ecology, environmental protection and environmental control, including radiation and chemical, - from the Ministry of emergency situations of the Kyrgyz Republic;

- coordination of work on accomplishment of obligations according to the Framework convention of the United Nations on climate change - from the Ministry of Foreign Affairs of the Kyrgyz Republic;

- National authorized body in Green climatic fund - from the Ministry of Economics and finance of the Kyrgyz Republic;

- collections of payment for use of natural resources and environmental pollution, and also control of expenditure of funds for the nature protection purposes; accounting, regulation of objects of animal and flora; implementation of the Convention on international trade in the types of wild fauna and flora which are under the threat of disappearance (CITES), CITES Administrative authority; coordination in the field of preserving and rational use of biological diversity, hunting and hunting economy; the state control of pollution of land and water resources - from the Ministry of agricultural, forest and water economy of the Kyrgyz Republic;

2) Department of preserving biodiversity and especially protected natural territories under the State committee on ecology and climate of the Kyrgyz Republic;

3) the Center of state regulation in the field of environmental protection and ecological safety under the State committee on ecology and climate of the Kyrgyz Republic;

4) Department of environmental monitoring under the State committee on ecology and climate of the Kyrgyz Republic.

2. Remove from maintaining the Ministry of agricultural, forest and water economy of the Kyrgyz Republic the state natural parks with the respective state, financial and material resources and transfer to the jurisdiction of the State committee on ecology and climate of the Kyrgyz Republic.

3. Rename:

- The center for climatic financing of the Kyrgyz Republic in the Center for climatic financing, with transfer to maintaining the State committee on ecology and climate of the Kyrgyz Republic of the respective state, financial and material resources;

- The agency on hydrometeorology (Kyrgyzgidromet) under the Ministry of emergency situations of the Kyrgyz Republic in the Agency on hydrometeorology (Kyrgyzgidromet), with transfer to maintaining the State committee on ecology and climate of the Kyrgyz Republic of the respective state, financial and material resources;

- The state inspectorate for ecological and technical safety under the Ministry of emergency situations of the Kyrgyz Republic in the State inspection of environmental control, with transfer to maintaining the State committee on ecology and climate of the Kyrgyz Republic of the respective state, financial and material resources, except for functions of the state control and supervision of ensuring fire safety.

4. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 24.12.2021 No. 338

5. To the state committee on ecology and climate of the Kyrgyz Republic, Ministry of emergency situations of the Kyrgyz Republic, Ministry of agricultural, forest and water economy of the Kyrgyz Republic:

To perform 1) in accordance with the established procedure reception-transmission of established posts, financial and material resources;

To take 2) into consideration that by transfer of the state to transfer the employees holding the corresponding positions on the date of entry into force of this resolution for accomplishment of the transferred functions are subject;

3) to take measures for employment of the released workers;

To submit 4) for consideration of the Cabinet of Ministers of the Kyrgyz Republic drafts of the decisions following from this resolution;

5) to take other measures following from this resolution.

6. Determine that the realization of this resolution is enabled within the approved number of staff and means provided for state bodies in the republican budget for the corresponding year and the next years.

7. Make changes to some decisions of the Government of the Kyrgyz Republic according to appendix 3 to this resolution.

8. Recognize invalid some decisions of the Government of the Kyrgyz Republic according to appendix 4 to this resolution.

9. To impose control of execution of this resolution on department of agro-industrial complex and ecology of Administration of the President of the Kyrgyz Republic.

10. This resolution becomes effective from the date of official publication.
