1. Approve the Instruction about carrying out currency transactions it (is applied).

2. Determine that use of foreign currency on the bonds of residents nominated in foreign currency with date of state registration of release till December 22, 2018 is allowed before complete obligation fulfillment by the issuer.

3. This resolution becomes effective since July 9, 2021.

The instruction about carrying out currency transactions

Chapter 1. General provisions

1. This Instruction determines procedure and cases of use of currency values when carrying out currency transactions by residents and nonresidents, procedure for determination by legal entities – residents of term of transfer into the accounts opened in banks of the Republic of Belarus (further – banks), Belarusian rubles and (or) foreign currency by the currency agreements providing export, import (further – repatriation), cases and procedure for submission by residents and nonresidents to banks, "Development Bank of the Republic of Belarus" open joint stock company (further – Development bank) documents and other information confirming compliance of the performed currency transactions to requirements of the foreign exchange legislation, contents of this information, and also procedure for carrying out monitoring of currency transactions.

2. Terms "banks of the Republic of Belarus", "currency exchange transactions", "currency transactions", "currency values", "the currency agreement", "import", "foreign currency", "foreign banks", "nonresidents", "residents", "goods", "export" are used in the values determined by subitems 1.1-1. 5, 1.7-1.12 and 1.15 Items 1 of article 1 of the Law of the Republic of Belarus "About currency control and currency exchange control".

The terms "web portal" and "registration number of the currency agreement" are used in the values determined by paragraphs to the second and fifth part one of Item 2 of the Instruction on the registration by residents of currency agreements approved by the resolution of Board of National Bank of the Republic of Belarus of February 12, 2021 No. 37.

Chapter 2. Use of currency values when carrying out currency transactions by residents and nonresidents

3. Physical persons - residents on the account opened in foreign currency in bank perform the following operations:

introduction (removal) of cash foreign currency into the accounts (from the accounts), transfer of foreign currency on the accounts;

payments and transfers in the cases established by articles 10-13 and 17 of the Law of the Republic of Belarus "About currency control and currency exchange control".

4. Physical persons - nonresidents on the account opened in foreign currency in bank perform the following operations:

introduction (removal) of cash foreign currency into the accounts (from the accounts), transfer of foreign currency on the accounts;

payments and transfers in the cases established by Articles 10, of 11, of 13, 14 and 18 Laws of the Republic of Belarus "About currency control and currency exchange control".

5. Legal entities - residents on the account opened in foreign currency in bank, Development bank perform the following operations:

introduction (removal) of cash foreign currency into the accounts (from the accounts), except the accounts opened in Development bank, in the cases established by subitems 1.1-1.7 of Item 1, Item 3 of Article 12, Items 2 and 3 of article 13 of the Law of the Republic of Belarus "About currency control and currency exchange control", transfer of foreign currency on the accounts;

payments and transfers in the cases established by articles 10-13 and 17 of the Law of the Republic of Belarus "About currency control and currency exchange control".

Legal entities - residents carry out payments with cash Belarusian rubles outside the Republic of Belarus with legal entities - nonresidents in total amount no more than 100 basic sizes under one currency agreement.

6. Legal entities - nonresidents on the account opened in foreign currency in bank, Development bank perform the following operations:

introduction (removal) of cash foreign currency into the accounts (from the accounts), except the accounts opened in Development bank, in the cases established by Items 2 and 4 of Article 13, Items 1 and 2 of article 14 of the Law of the Republic of Belarus "About currency control and currency exchange control", transfer of foreign currency on the accounts;
