1. Approve the enclosed Rules of implementation of verification (check) of justification of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin.

2. To provide to committee of technical regulation and metrology of the Ministry of Trade and integration of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Trade and integration of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Trade and integration of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of verification (check) of justification of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin

Chapter 1. General provisions

1. These rules of implementation of verification (check) of justification of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin (further – Rules) are developed according to subitem 7-4) of article 7 of the Law of the Republic of Kazakhstan "On regulation of trading activity" and determine procedure of verification (check) of justification of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin.

2. The basic concepts used in these rules:

1) authorized body in the field of regulation of trading activity (further – authorized body) – the central executive body creating trade policy and performing management, and also cross-industry coordination in the field of trading activity;

2) authorized organization – The national chamber of entrepreneurs of the Republic of Kazakhstan of Atameken performing registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin.

Chapter 2. Procedure of verification (check) of justification of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin

For the purpose of confirmation of the country of goods' origin the authorized body performs verification (check) of justification of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin (further – the REX system).

4. Verification (check) is performed based on the official requests which arrived in authorized body from the Kingdom of Norway, the Swiss Confederation of the country of commodity importation.

5. The term of carrying out verification (check) does not exceed 30 (thirty) working days from the moment of receipt of request in authorized body.

6. The authorized body for carrying out verification (check) is registered in the REX system on the website of the European commission.

Access to the website of the European commission is provided through personal login and the password of authorized body.

7. The authorized body from the date of receipt of request of justification of registration of the exporter within 3 (three) working days sends inquiry to authorized organization for provision of the copy of the application on receipt of registration number of the exporter provided by the Rules of registration of exporters in information systems of the countries of commodity importation for the purpose of confirmation of the country of goods' origin approved by the order of the Minister of Trade and integration of the Republic of Kazakhstan of March 31, 2021 No. 244-HK (it is registered in the Register of state registration of regulatory legal acts for No. 22437), and also copies of documents according to the List of the documents confirming goods origin the approved order of the Deputy prime minister of the Republic of Kazakhstan – the Minister of the industry and new technologies of the Republic of Kazakhstan of July 8, 2014 No. 257 (it is registered in the Register of state registration of regulatory legal acts behind No. 9665) (further – documents) which formed the bases for registration of exporters in the REX system.

In case of filing of application by proxy of the exporter's representative, the power of attorney on representation of interests of the exporter is attached.

8. The authorized organization within 5 (five) working days from the date of receipt of request sends required documents to authorized body.

9. The authorized body from the date of receipt of documents within 7 (seven) working days performs verification (check) of completeness and the accuracy of the data containing in documents, and also in the REX system.

10. By results of verification (check) the authorized body within 7 (seven) working days, creates the conclusion about verifications (checks) of justification of registration of exporters in the REX system with specifying of results of verification (check).

In case of discrepancy of the exporter to conditions of general preferential system, the provided Kingdom of Norway, the Swiss Confederation concerning the goods occurring from developing and the least developed countries, non-compliance by the exporter with the obligations undertaken in case of registration in the REX system and the termination by the exporter of the activities the authorized body within 3 (three) working days sends the appeal to authorized organization for withdrawal of registration of the exporter in the REX system.
