About mental health services

The purpose of this Law is regulation of the relations in the field of rendering mental health services.
The legislation on mental health services consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about mental health services then are applied rules of the international treaty.
In this Law the following basic concepts are applied:
the informed voluntary consent to medical intervention - the voluntary consent expressed in writing by person capable to understand information provided by available method on state of his health, nature of mental disturbance and about the forecast of possible development of disease, the purpose, procedure and duration of rendering mental health services, methods of diagnostics, treatment and medicines which can be applied in the course of rendering this help, their side effects or written consent of his legal representative;
mental health services - complex of the special events directed to inspection of condition of mental health of persons, prevention, diagnostics of mental disturbances, treatment, leaving and medico-social resettlement of persons suffering from mental disturbances;
mental health facility - medical institution which main function is rendering mental health services;
mental disturbance - the change of mental condition of person recognized according to the International classification of diseases operating in the Republic of Uzbekistan;
the commission of psychiatrists - the commission created by governing body of health care, consisting of three or more psychiatrists who are jointly making decisions on the questions connected with rendering mental health services;
legal representatives are parents (adoptive parents), guardians or other persons, representatives to represent the interests of persons suffering from mental disturbances, to perform protection of their rights, freedoms and legitimate interests when rendering mental health services to them.
Operation of this Law extends to citizens of the Republic of Uzbekistan when rendering mental health services to them, and also on the legal entities and physical person participating in rendering mental health services in the territory of the Republic of Uzbekistan.
The foreign citizens and stateless persons which are in the territory of the Republic of Uzbekistan when rendering mental health services to them have all rights established by this Law on an equal basis with citizens of the Republic of Uzbekistan.
The basic principles of rendering mental health services are legality, social security, humanity, observance of human rights and freedoms, confidentiality of information.
Are guaranteed by the state:
free mental health services when rendering primary health care, specialized medical care, fast, including fast specialized medical care in the public medical institutions;
carrying out all types of psychiatric examination according to the legislation;
the social help and assistance in employment of persons suffering from mental disturbances in the presence of the corresponding conclusion of medico-social commission of experts;
the solution of questions of guardianship of persons suffering from mental disturbances;
consultations according to legal issues and other types of legal aid in the medical institutions giving mental health services, the medico-social organizations intended for persons suffering from mental disturbances;
mental health services in case of emergency situations.
For providing persons suffering from mental disturbances, mental health services and their social protection the state:
creates all types of the organizations giving mental health services, whenever possible at the place of residence of persons suffering from mental disturbances;
will organize obtaining by the minors suffering from mental disturbances, educations in the public specialized educational institutions, general averages and the average special educational organizations;
creates in the territory of mental health facilities on the terms of public-private partnership medical production enterprises for labor therapy, training in new professions and employment at these companies of persons suffering from mental disturbances including persons with disability, with the organization of the production process adapted for persons suffering from mental disturbances for the purpose of their rehabilitation and social reintegration;
