1. 1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of determination of rate for support of renewable energy resources

Chapter 1. General provisions

1. These rules of determination of rate for support of renewable energy resources (further - Rules) are developed according to subitem 10-1) of article 6 of the Law of the Republic of Kazakhstan "About support of use of renewable energy resources" (further - the Law) and determine procedure for determination of rate for support of renewable energy resources and determine the allowance on support of use of renewable energy resources.

2. In these rules the following basic concepts are used:

1) the auction price - the price of purchase by settlement financial center on support of renewable energy resources of the electrical energy made by object for use of renewable energy resources, object for energy waste recycling determined following the results of biddings and which is not exceeding the level of the corresponding marginal auction price;

2) skilled conditional consumers - person or group of persons which part the conditional consumers and the power making organizations using the renewable energy resources owning acting (put into operation after January 1, 2018 and not included by authorized body in the List of the power making organizations using renewable energy resources) objects for use of renewable energy resources on the property right are or on other legal cause which developed electrical energy in full is consumed by this person or group of persons or is implemented to consumers on contract prices according to the signed bilateral agreements;

3) gas - crude, commodity, liquefied oil and liquefied natural gas;

4) settlement financial center on support of renewable energy resources (further - settlement financial center) - the legal entity created by the system operator and determined by authorized body, performing according to the procedure, provided by the Law, centralized purchase and sale of the electrical energy made by objects for use of renewable energy resources, energy waste recycling, flood electrical energy and delivered in power networks of single electric utility system of the Republic of Kazakhstan;

5) rate for support of renewable energy resources - rate for sale the settlement financial center of the electrical energy made by objects for use of renewable energy resources, objects for energy waste recycling, and flood electrical energy, established by settlement financial center according to these rules;

6) the power making organization using renewable energy resources - the legal entity performing production of electrical and (or) heat energy with use of renewable energy resources;

7) the allowance on support of use of renewable energy resources - the price determined by settlement financial center according to zone of consumption of electrical energy for the power making organizations being conditional consumers or skilled conditional consumers according to the Law;

8) costs for support of use of renewable energy resources - costs of settlement financial center for purchase of the electrical energy made by objects for use of renewable energy resources, objects for energy waste recycling, purchase costs of flood electrical energy, costs for the services in the organization of balancing of production consumption of electrical energy, costs for forming of reserve fund and costs connected with implementation of its activities;

9) conditional consumers of electrical energy from renewable energy resources, energy waste recycling and flood electrical energy (further - conditional consumers) - the power making organizations using coal, gas, sulfur-containing raw materials, oil products and nuclear fuel; the subjects of the market of electrical energy acquiring electrical energy because of limits of the Republic of Kazakhstan; hydroelectric power stations with the installations located in one water-engineering system, total capacity over thirty five megawatts except for put into operation after January 1, 2016;

10) the power making organization using renewable energy resources - the legal entity performing production of electrical and (or) heat energy with use of renewable energy resources;

11) object for energy waste recycling - set of the technical devices and installations intended for energy waste recycling, and the constructions interconnected with them and the infrastructure technologically necessary for energy waste recycling;

12) operating costs - the costs connected with implementation of activities of settlement financial center;
