About development of power industry

For the purpose of enhancement of the relations in the field of power supply:

1. Determine that:

1.1. the block stations connected directly or indirectly to power networks of the power supplying organizations, power plants of the power supplying organizations and the Belarusian nuclear power plant are subject to single supervisory control in power industry based on agreements of rendering services in supervisory control in power industry.

The specified agreements are signed according to the procedure, determined by the Rules of access to services in supervisory control in power industry approved by Council of Ministers of the Republic of Belarus;

1.2. the power supplying organizations and GPO "Belenergo" render services on:

to distribution of the electrical energy made by block stations on power networks of the power supplying organizations within one area based on the agreement of the rendering services in distribution of electrical energy concluded between the owner of the block station and the power supplying organization to which power network the block station is directly connected;

to transfer and distribution of the electrical energy made by block stations on power networks of the power supplying organizations within several areas based on the agreement of the rendering services in transfer and distribution of electrical energy concluded between the owner of the block station with an established electric power of 25 MW and more, the power supplying organization to which power network the block station, and GPO "Belenergo" is directly connected.

The agreement of rendering services in distribution of electrical energy and the agreement of rendering services in transfer and distribution of electrical energy consist according to the procedure, determined by the Rules of access to services in transfer and (or) distribution of electrical energy approved by Council of Ministers of the Republic of Belarus.

2. Grant the right:

2.1. to owners of the block stations connected directly to power networks of the power supplying organizations to perform with use of such power networks within one area distribution and (or) within several areas transfer and distribution of the electrical energy made by the specified block stations, to the separate divisions (branches, representations), other structural divisions and (or) objects of electric utility service of owners of block stations (further - objects of the owner of the block station).

Transfer and (or) distribution of electrical energy according to part one of this subitem are performed based on the agreements called in part one of subitem 1.2 of Item 1 of this Decree in case of observance of the following conditions:

direct connection of electroinstallations of objects of the owner of the block station to power networks of the power supplying organizations;

equipment of the block station and electroinstallations of objects of the owner of the block station the automated control systems and accounting of electrical energy (capacity);

2.2. to the organizations of housing and communal services which are owners of the block stations connected directly to power networks of the power supplying organizations to perform with use of such power networks within one area sale to consumers of the electrical energy made by the specified block stations.

Sale of electrical energy according to part one of this subitem is performed based on the purchase and sale agreement of electrical energy in case of observance of the following conditions:

the prisoner's availability between the owner of the block station and the power supplying organization of the agreement called in the paragraph the second part one of subitem 1.2 of Item 1 of this Decree;

amounts of electrical energy are made by the block station over the amounts necessary for energy ensuring economic activity of its owner;

direct connection of electroinstallation of the consumer to power network of the power supplying organization;

equipment of the block station and electroinstallation of the consumer the automated control systems and accounting of electrical energy (capacity).

3. For the purposes of this Decree terms in the values determined in appendix are applied.

4. Add the Section "Ministry of Anti-monopoly Regulation and Trade" of appendix 1 to the Presidential decree of the Republic of Belarus of February 25, 2011 with No. 72 "About some questions of price regulation (rates) in the Republic of Belarus" the paragraph of the following content:

"Services in transfer and (or) distribution of electrical energy in power networks of the power supplying organizations of the national production association of power industry Belenergo, service in supervisory control in power industry".

5. Grant to the Department of Energy the right to enter for the legal entities having in property, economic maintaining or operational management the block station, the departmental reporting on production volumes, transfers, distributions and sales of electrical energy.

6. To Council of Ministers of the Republic of Belarus in three-months time:

6.1. approve:

Rules of access to services in supervisory control in power industry;

Rules of access to services in transfer and (or) distribution of electrical energy;

6.2. take other measures for implementation of this Decree.

7. This Decree becomes effective in the following procedure:

Item 6 and this Item - after official publication of this Decree;

other provisions of this Decree - in six months after its official publication.

Appendix

to the Presidential decree of the Republic of Belarus of April 16, 2021 No. 153

Terms and their determinations

The block station - power plant of the legal entity or individual entrepreneur, except for the power plants which are under economic authority of the power supplying organizations, using renewable or unrenewable energy resources.

The owner of the block station - the legal entity or the individual entrepreneur having the block station in property, economic maintaining or operational management.

The purchase and sale agreement of electrical energy - the agreement of the parties under which the owner of the block station shall give electrical energy and the consumer of electrical energy shall accept and pay it.

The agreement of rendering services in supervisory control in power industry - the agreement of the parties under which the power supplying organization shall render to the owner of the block station, and GPO "Belenergo" - the power supplying organizations and the state company "Belarusian Nuclear Power Plant" of service in supervisory control in power industry and the owner of the block station, the power supplying organizations and the state company "Belarusian Nuclear Power Plant" shall pay these services.
