About approval of the List of the organizations experts for issue of the expert opinion and authorized bodies on issue of the allowing documents for export and commodity import included in the Single inventory to which measures of non-tariff regulation in trade with the third countries, and modification of some decisions of the Government of the Kyrgyz Republic in the field of non-tariff regulation are applied

For the purpose of reduction of regulatory legal acts in compliance with structure of the Government of the Kyrgyz Republic approved by the resolution of Jogorku Kenesh of the Kyrgyz Republic of February 3, 2021 No. 4358-VI, being guided by articles 9 and 11-1   of the Law of the Kyrgyz Republic "About state regulation of foreign trade activity in the Kyrgyz Republic", articles 10 and 17   of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Approve the List of the organizations experts for issue of the expert opinion and authorized bodies on issue of the allowing documents for export and commodity import included in the Single inventory to which measures of non-tariff regulation in trade with the third countries, according to appendix are applied.

2. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 17.12.2021 No. 313

3. Bring in the order of the Government of the Kyrgyz Republic "About procedure for issue of the electronic allowing document (license/conclusion/permission) for export/import/transit of the goods included in the Single inventory to which measures of non-tariff regulation in trade with the third countries by the principle of "single window" of December 26, 2019 in No. 708 the following changes are applied:

Item 2 to state 1) in the following edition:

"2. To the state bodies determined by the relevant decision of the Government of the Kyrgyz Republic, to the organizations experts and licensors by export licensing and import of the specific goods included in the Single inventory to which measures of non-tariff regulation in trade with the third countries are applied and authorized state body in the field of customs affairs to be guided by the Protocol on measures of non-tariff regulation concerning the third countries, decisions of Board of the Eurasian economic commission "About regulatory legal acts in the field of non-tariff regulation" of August 16, 2012 No. 134, "About measures of non-tariff regulation" of April 21, 2015 No. 30 and this resolution.";

2) in Regulations on procedure for issue of the electronic allowing document (license/conclusion/permission) for export/import/transit of the goods included in the Single inventory to which measures of non-tariff regulation in trade with the third countries by the principle of "single window" are applied, approved by the above-stated resolution:

- in the paragraph the thirteenth Item 6 of the word "under the Ministry of Economics" shall be replaced with words "under the Ministry of Economics and finance";

- state Item 26 in the following edition:

"26. The electronic allowing document is considered issued from the moment of signing of the electronic allowing document by the digital signature of the corresponding head or head of the structural unit of body licensor.";

- to declare the subitem 5 of Item 29 invalid;

- state Item 30 in the following edition:

"30. The applicant has the right to appeal the decision of the organization expert on refusal in issue of the expert opinion in administrative, (pre-judicial) procedure, according to the Law of the Kyrgyz Republic "About bases of administrative activities and ministerial procedures.";

- the paragraph one of Item 41 after words of "failures in ISEO" to add with the words "and/or before start of ISEO in the industrial mode".

4. Bring in  the order of the Government of the Kyrgyz Republic "About authorized body of the Kyrgyz Republic on implementation of the Convention on prohibition of development, production and stock accumulation of bacteriological (biological) and toxin weapon and about their destruction, signed on April 10, 1972 in the cities of Moscow, London and Washington" of June 8, 2020 No. 310 the following change:

in Item 1 of the word "Ministry of Economics" shall be replaced with words "The Ministry of Economics and finance".

5. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the List of the organizations experts for issue of the expert opinion and authorized bodies on issue of the allowing documents for export and commodity import included in the Single inventory to which measures of non-tariff regulation in trade with the third countries, and modification of some decisions of the Government of the Kyrgyz Republic" of March 24, 2016 No. 142 are applied;

2)  the order of the Government of the Kyrgyz Republic "About modification of  the order of the Government of the Kyrgyz Republic "About approval of the List of the organizations experts and licensors on export licensing and import of the specific goods included in the Single inventory to which measures of non-tariff regulation in trade with the third countries, and entering of amendments and changes into some decisions of the Government of the Kyrgyz Republic" of March 24, 2016 No. 142" of May 22, 2017 No. 300 are applied;

3)  the order of the Government of the Kyrgyz Republic "About modification of  the order of the Government of the Kyrgyz Republic "About approval of the List of the organizations experts and licensors on export licensing and import of the specific goods included in the Single inventory to which measures of non-tariff regulation in trade with the third countries, and entering of amendments and changes into some decisions of the Government of the Kyrgyz Republic" of March 24, 2016 No. 142" of November 2, 2018 No. 518 are applied;

4) Item 2  of the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic concerning determination of authorized bodies in the field of non-tariff regulation" of July 22, 2020 No. 392.

6. This resolution becomes effective from the date of official publication.
