I. General provisions

1. On content of the adopted children and children over whom it is established guardianship/guardianship food allowances, acquisition of clothes/footwear, personal care products, etc. are paid to adoptive parents, and also guardians/custodians.

2. The monthly allowance is established and paid in the amount of 800 lei for each adopted child.

2-1. The children who are under guardianship/guardianship who study in educational institution since the fifth class before achievement of 18 years, receive daily benefit according to the provisions established by the Government.

2-2. Lump-sum allowances in case of the placement and monthly allowances in the amount of established by the Government are paid to the children who are under guardianship/guardianship.

3. Benefits are not established and not paid in the following cases:

a) the adoptive parent is spouse/spouse of the biological parent of the child;

b) ceased to be valid;

4. II. Procedure for establishment and payment of monthly allowances

6. Establishment and payment of monthly allowances on the adopted children and children over whom are established guardianship/guardianship are performed by territorial agencies of the social help / responsible structures of social security and protection of the rights of the child of municipium of Chisinau / autonomous territorial education Gagauzia. For the adopted child monthly allowances are granted based on the application submitted by his parent to territorial authority of guardianship of administrative and territorial unit in the place of residence of the child after adoption confirmation.

7. Ceased to be valid according to the Order of the Government of the Republic of Moldova of 03.04.2024 No. 241

8. The adoptive parent encloses the following documents to the application:

a) copy of the identity certificate of the adoptive parent;

b) copy of the decision of degree of jurisdiction on adoption confirmation;

c) copy of the certificate of birth of the child.

11. Territorial agency of the social help / responsible structures of social security and protection of the rights of the child of municipium of Chisinau / autonomous territorial education Gagauzia in two weeks from the moment of filing of application by the adoptive parent accepts the order about establishment and payment of monthly allowance or about refusal in establishment and payment of monthly allowance.

12. Territorial agency of the social help / responsible structures of social security and protection of the rights of the child of municipium of Chisinau / autonomous territorial education Gagauzia informs the applicant in 3-day time from the date of adoption of the order on results of consideration of its statement.

13. Territorial agency of the social help / responsible structures of social security and protection of the rights of the child of municipium of Chisinau / autonomous territorial education Gagauzia rejects the statement for establishment of benefit in cases, stipulated in Item 3 this provision.

14. The refusal in establishment and allowance payment can be appealed in degree of jurisdiction.

15. The right to allowance payment arises from coming into force of the order of degree of jurisdiction about adoption confirmation (in case of adoption of the child) and from the moment of adoption of the order by territorial authority of guardianship about the planned accommodation of the child in service of guardianship/guardianship, except as specified, stipulated in Item 3 this provision.

16. Monthly allowances are established and paid from the moment of filing of application (in case of adoptive parents) or from the date of the edition of the order territorial authority of guardianship about the planned accommodation of the child in service of guardianship/guardianship.
