About use of atomic energy
This Law determines the legal basis and the principles of regulation of the public relations in the field of use of atomic energy and is directed to protection of health and life of people, environmental protection, providing non-proliferation regime of nuclear weapon, nuclear and radiation safety when using atomic energy.
In this Law the following basic concepts are used:
state regulation - activities of authorized body for development, approval and enforcement of regulations and rules for nuclear and radiation safety, licensing of types of activity in the field of use of atomic energy and allowing control;
burial - placement of radioactive waste without intention of their withdrawal under the conditions ensuring nuclear and radiation safety; sources of ionizing radiation - the radioactive materials, installations (which are not relating to nuclear installations), the devices and objects which are letting out or capable to emit ionizing radiation;
placement Items - the special stationary objects and constructions intended for storage of radioactive materials or burial of radioactive waste;
radioactive safety - the condition of radiation situation provided with complex of the actions limiting radiative effects on personnel, the population and the environment according to the established regulations;
radioactive materials - the materials containing chemical elements which kernels are capable to spontaneous disintegration;
radioactive waste - the materials and substances in any aggregate state containing radioactive materials in the quantities and concentration exceeding the values regulated by regulatory legal acts formed as a result of economic activity and which are not subject to further use;
special non-nuclear materials - the materials determined by bylaws as such in connection with the international legal mode of regulation of nuclear export;
goods and services in the field of use of atomic energy - nuclear installations, the equipment, technologies, the radioactive materials, special non-nuclear materials used for production of nuclear materials, sources of ionizing radiation, and also the related services;
withdrawal level - complex of the sizes expressed in terms of activity in case of which or below which sources of ionizing radiation can be excluded from under control according to existing rules;
authorized body in the field of use of atomic energy (further - authorized body) - the central executive body enabling the realization of state policy in the field of atomic energy, non-proliferation of nuclear weapon and regulation of safe use of atomic energy in the Republic of Kazakhstan.
physical protection of nuclear materials and nuclear installations - single system of the organizational and technical measures directed to prevention of unauthorized access for persons to nuclear materials to installations;
storage - the temporary placement in specially prepared places (including in special containers) radioactive materials and radioactive waste assuming possibility of their extraction for use, conversion or burial;
the operating organization - the organization having the license of authorized body for implementation of activities for use of atomic energy;
nuclear safety - the property of nuclear object providing impossibility of nuclear accident with certain probability;
nuclear materials - the materials containing or capable to reproduce the sharing (split) nuclear substances;
nuclear installations - nuclear reactors, including reactors of nuclear power plants, space and aircraft, vehicles; industrial, experimental research reactors, nuclear stands; any constructions, complexes, installations, the equipment and technical means for production, use, conversion, transportation and placement of nuclear materials.
The legislation of the Republic of Kazakhstan in the field of use of atomic energy is based on the Constitution of the Republic of Kazakhstan, consists of this Law, others legislative and the regulatory legal acts of the Republic of Kazakhstan regulating questions of use of atomic energy.
1. The basic principles of state policy in the field of use of atomic energy are:
ensuring nuclear and radiation safety when using atomic energy;
availability, objectivity and timeliness of information on impact of objects of atomic energy on the population and the environment;
prohibition of burial of radioactive waste of other states in the territory of the Republic of Kazakhstan;
ensuring the state control of nuclear and radiation safety when using atomic energy;
ensuring social protection of personnel of subjects to the use of atomic energy, and also the populations living and performing labor activity in regions of their arrangement;
compensation of the damage caused by radiative effects;
participation of citizens, public associations and other legal entities in discussion of state policy, drafts of the laws and other regulatory legal acts of the Republic of Kazakhstan in the field of use of atomic energy.
2. In the territory of the Republic of Kazakhstan any activities of legal entities and physical persons for use of atomic energy for the purpose of development, creations, productions, testing, storages and distribution of nuclear weapon are strictly forbidden.
Subjects to use of atomic energy are:
nuclear installations;
placement Items;
sources of the withdrawal ionizing higher than the levels;
the organizations using sources of ionizing radiation, including medical, educational, research, commercial, agricultural and industrial, including mining, processing, and also other organizations.
Subjects in the field of use of atomic energy are:
physical persons;
authorized body of regulation, control and management;
the organizations which are engaged in activities for use of atomic energy.
1. Treat the activities connected with use of atomic energy:
placement, design, construction, commissioning, operation, preservation and conclusion from operation of subjects to use of atomic energy;
performance of works and provision of services, connected with use of atomic energy, except for activities of the test laboratories accredited in system of technical regulation using sources of ionizing radiation are lower than withdrawal level;
