In pursuance of part (1) article 5 of the Law on forming of real estate units No. 354-XV of October 28, 2004. (The official monitor of the Republic of Moldova, 2004, Art. No. 233-236, 999) DECIDES: the Government

1. Approve Regulations on certification of cadastral engineers it (is applied).

2. To the agency of land relations and inventory to take necessary measures for ensuring proper realization of this Provision.

Regulations on certification of cadastral engineers

I. General provisions

1. The regulations on certification of cadastral engineers (daleepolozheniye) regulate procedure and conditions of certification of cadastral engineers on the right to perform cadastral works on forming of real estate units.

2. The purpose of certification is check of professional knowledge of cadastral engineers and ability to put them into practice for the purpose of:

installations and markings of borders of the real estate unit on the place;

identifications of the real estate unit based on documents of title;

implementation of measurements on the area for creation and change of the cadastral or geometrical plan;

accomplishment of other works on forming of real estate units.

3. Certification of cadastral engineers is performed by the Agency of land relations and inventory (further - the Agency) by issue of the qualification certificate of the cadastral engineer (the daleekvalifikatsionny certificate).

4. Certifications the specialists applying for accomplishment of cadastral works on forming of real estate units, specialists whose qualification certificate loses are subject or voided, the specialists who made gross blunders in case of accomplishment of cadastral works on forming of real estate units.

Note. The mistake which entailed change of cadastral documentation is considered rough.

5. For ensuring the corresponding qualification of specialists the Agency systematizes and represents to interested persons the list of regulations, instructions, technical requirements, methodical instructions and other documents which it is necessary to study, and also the list of subjects for preparation for examinations.

II. Conditions for certification of cadastral engineers

6. The qualification certificate is issued based on the decision of the qualification commission of cadastral engineers (the daleekvalifikatsionny commission) to person meeting the following requirements:

a) has one of the following specialties: cadastral engineer, engineer on the organization of the territory, design engineer, surveyor;

b) has working experience in accomplishment of cadastral works at least 3 years;

c) passed qualification examination.

III. Functions of the qualification commission of cadastral engineers

7. Skill test of cadastral engineers is performed by the qualification commission as a part of 7 members created by the order of the Agency.

Specialists of the Agency and structures subordinated to it, representatives of the interested public (professional) organizations are part of the qualification commission. The chairman, the vice-chairman and the responsible secretary of the qualification commission are appointed from specialists of the Agency.

8. The qualification commission is effective constantly and performs the following functions:

approves the list of questions for written examination;

considers results of written examination and conducts interview;

if necessary approves structure of examination committee;

considers the technical cases provided by applicants;

makes the decision on passing qualification examination;

makes the decision on cancellation of results of qualification examination;

considers appeals of applicants concerning results of qualification examination and makes on them decisions;

represents results of qualification examination of administration of the Agency for issue of the qualification certificate to the applicants who passed examination;

performs also other functions according to this Provision.

9. Chairman of the qualification commission:

performs the common directorship of work of the qualification commission;

determines date of meetings of the qualification commission;

conducts meetings of the qualification commission;

signs protocols of meetings of the qualification commission;

performs also other functions according to this Provision.

Powers of the chairman of the qualification commission in case of its absence are carried out by the vice-chairman of the qualification commission.

10. Responsible secretary of the qualification commission:

will organize reception of applications, necessary documents for passing qualification examination;

informs interested persons on date of qualification examination;

keeps protocols of meetings of the qualification commission;

signs the minutes of the qualification commission;

will organize issue of qualification certificates;

keeps the register of qualification certificates of cadastral engineers.

IV. Procedure for certification of cadastral engineers

11. Certification of cadastral engineers is carried out according to their statement or at the initiative of the Agency in case of identification of the gross blunders made by cadastral engineers in case of accomplishment of cadastral works.

12. For receipt of the qualification certificate the applicant submits the Qualification commission the following documents:

a) the statement for issue of the qualification certificate (according to the sample given in appendix No. 1);

b) copy of the identity document;

c) the copy of the diploma about education;

d) the copy of the service record or the statement from it;

e) if necessary technical cases on accomplishment of the cadastral works performed by the applicant or with its participation.

The applicant who for the first time addresses concerning provision of the qualification certificate or effective period of the qualification certificate of which expired more than a year ago, submits all documents specified in the previous paragraph. The applicant whose effective period of the qualification certificate expires or expired less than a year ago, and also the specialist who is subject to certification on initiative of the Agency submit the documents specified in Items and) and e) this Item.
