About approval of the Regulations on Government commission on problems of the victims of political repressions and its members

In pursuance of provisions of the Rehabilitation act of the victims of political repressions No. 1225-XII of December 8, 1992 (repeated publication: The official monitor of the Republic of Moldova, 1999, Art. No. 133-134, 654), with subsequent changes and amendments, DECIDES: the Government

1. Approve:

Regulations on Government commission on problems of the victims of political repressions according to appendix No. 1;

staff of Government commission on problems of the victims of political repressions according to appendix No. 2.

2. Determine that in case of release from posts of persons which are part of said commission, their functions within the commission are performed by persons who are again appointed to these positions without edition of the new order of the Government.

3. Declare invalid the Order of the Government No. 307 of May 27, 1993. "About formation of Government commission on the problems connected with compensation of the material damage caused to persons which underwent to political repressions".

Regulations on Government commission on problems of the victims of political repressions

I. General provisions

1. Government commission on problems of the victims of political repressions (further - the commission) aims at promotion of state policy in the field of recovery of victims of political repressions and permission of the questions arising in the course of application of the regulations regulating this area.

2. The commission performs the activities according to provisions of the Constitution of the Republic of Moldova, presidential decrees of the Republic of Moldova, the laws and resolutions of Parliament, ordinances, resolutions and orders of the Government, other regulations, and also this provision.

3. The commission is urged to promote acceptance of effective measures for the problem resolution which the victims of political repressions, and to accomplishment of actions plans on their social protection and recovery in the rights face.

II. Tasks of the commission

4. The main objectives of the commission are:

a) participation in process of development and implementation of regulations on the political, social and civil laws of rehabilitees;

b) permission of other problems and monitoring by competent authorities of public management of application of regulations on recovery of victims of political repressions of the Law No. 1225-XII of December 8, 1992, the procedure for return of the property seized nationalized or withdrawn by different way.

III. Rights of the commission

5. The commission is authorized:

a) request from relevant organs information and offers for the problem resolution of the victims of political repressions;

b) involve in the activities experts in the field;

c) cooperate with the international organizations in the field of social 9 protection of the victims of political repressions.

IV. Management of the commission

6. The staff of the commission affirms the order of the Government.

7. Commission sessions are convoked by its chairman as required, but at least once a quarter.

8. Commission sessions are competent only with the assistance of at least a half of her members in them.

9. Decisions of the commission are considered accepted if most of the members who are present at meeting voted for them, are entered in protocols which are signed by the chairman and the secretary of the commission.

10. Decisions of the commission can be protested according to the law.

V. Final provisions

11. Decisions of the commission are obligatory for execution by the bodies performing their accomplishment. These bodies report to the commission about results of execution of decisions.

12. Annually the commission informs the Government on the activities.
