About the Constitutional court of the Republic of Uzbekistan

Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of activities of the Constitutional court of the Republic of Uzbekistan.

Article 2. Legislation on the Constitutional court of the Republic of Uzbekistan

The legislation on the Constitutional court of the Republic of Uzbekistan consists of the Constitution of the Republic of Uzbekistan, this Law and other legal acts.

Article 3. Status of the Constitutional court of the Republic of Uzbekistan

The constitutional court of the Republic of Uzbekistan (further - the Constitutional court) is permanent body of judicial authority which considers cases on constitutionality of acts of legislative and executive power.

Article 4. Powers of the Constitutional court

Constitutional court:

1) is determined by compliance of the Constitution of the Republic of Uzbekistan of the laws of the Republic of Uzbekistan and resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, the orders of the Government, decisions of local authorities of the government, interstate contractual and other commitments of the Republic of Uzbekistan;

2) is determined by compliance of the Constitution of the Republic of Uzbekistan of the constitutional laws of the Republic of Uzbekistan, the laws of the Republic of Uzbekistan on ratification of international treaties of the Republic of Uzbekistan - before their signing by the President of the Republic of Uzbekistan;

3) draws the conclusion about compliance of the Constitution of the Republic of Karakalpakstan of the Constitution of the Republic of Uzbekistan, the laws of the Republic of Karakalpakstan - to the laws of the Republic of Uzbekistan;

Interpretation of regulations of the Constitution and the laws of the Republic of Uzbekistan gives 4);

5) is considered by the appeal of the Supreme Court of the Republic of Uzbekistan initiated by courts about compliance of the Constitution of the Republic of Uzbekistan of the regulatory legal acts which are subject to application in specific case;

6) by results of generalization of practice of the constitutional legal proceedings annually represents to chambers of Oliy Majlis of the Republic of Uzbekistan and the President of the Republic of Uzbekistan information on condition of the constitutional legality in the country.

The constitutional court considers also claims of citizens and legal entities whose constitutional rights and freedoms, in their opinion, are broken by the law applied in specific case which is not corresponding to the Constitution of the Republic of Uzbekistan.

The constitutional court considers also another matters carried to its competence by the Constitution and the laws of the Republic of Uzbekistan.

The constitutional court when implementing the powers abstains from establishment and research of the actual circumstances in all cases when it enters competence of other courts or other bodies.

Article 5. Legislative initiative of the Constitutional court

The constitutional court has power to initiate legislation.

The power to initiate legislation of the Constitutional court is exercised by means of introduction by it in Legislative house of Oliy Majlis of the Republic of Uzbekistan (further - Legislative house) drafts of the laws.

The constitutional court appoints the representative for participation by consideration in Legislative house of the bill introduced by it.

Article 6. Election of the Constitutional court

The constitutional court is elected by the Senate of the Oliy Majlis of the Republic of Uzbekistan (further - the Senate) on representation of the President of the Republic of Uzbekistan from among the specialists recommended by the Supreme judicial council of the Republic of Uzbekistan including the representative from the Republic of Karakalpakstan.

Each judge of the Constitutional court is elected in individual procedure. Person who received majority of votes from total number of members of the Senate is considered the electee.

The constitutional court consists of nine judges of the Constitutional court, including the chairman and his deputy.

Article 7. Term of office of the judge of the Constitutional court

The term of office of the judge of the Constitutional court constitutes in case of initial election five years, in case of the next election - ten years.

The age limit of continuance in office of the judge of the Constitutional court makes, as a rule, seventy years.

The same person cannot be elected the judge of the Constitutional court more than two times.

Article 8. Obligation of acts and requirements of the Constitutional court

Acts of the Constitutional court are obligatory for all state bodies, non-state non-profit organizations, the companies, organizations, the organizations, officials and citizens.

Requirements of the Constitutional court about submission of regulatory legal acts, documents and their copies, giving explanations and consultations for the questions considered by it, making or abstention from any actions are obligatory for bodies and officials to whom they are addressed.

Article 9. Procedure for activities of the Constitutional court

The procedure for activities of the Constitutional court is determined by this Law, other laws governing the relations in the sphere of the constitutional legal proceedings and Regulations of the Constitutional court of the Republic of Uzbekistan.

The regulations of the Constitutional court of the Republic of Uzbekistan regulate questions of internal activities of the Constitutional court and are accepted at its meeting.

Chapter 2. Status of the judge of the Constitutional court

Article 10. Requirements to the candidate for judgeship of the Constitutional court. Qualification classes of judges of the Constitutional court

The judge of the Constitutional court the citizen of the Republic of Uzbekistan not younger thirty five years from among specialists in the field of policy and the right, having high moral qualities and necessary qualification can be elected.

To the judge of the Constitutional court it is appropriated the Highest or First qualification classes. The highest qualification class is appropriated by the President of the Republic of Uzbekistan. The first qualification class is appropriated by the Constitutional court.

Article 11. Oath of the judge of the Constitutional court

Person for the first time elected the judge of the Constitutional court takes the oath of the following content:
