About some questions of military and technical cooperation of the Russian Federation with foreign states

For the purpose of increase in efficiency of military and technical cooperation of the Russian Federation with foreign states and according to the Federal Law of July 19, 1998 "About military and technical cooperation of the Russian Federation with foreign states" I decide No. 114-FZ:

1. Determine that:

a) the "National Aviation Service Company" joint-stock company (Moscow) which 100 percent of shares are in property of the State corporation on assistance to development, production and export of high-technology industrial output Rostec is the state intermediary providing complex field service of the Russian aircraft equipment carried to military products;

b) the state intermediary providing complex field service of the Russian aircraft equipment carried to military products in case of the conclusion of commission agreements with the organizations - developers and producers of military products includes in them the provision providing obligation of the specified organizations to allocate funds in the amount of difference between the price of the contract signed by the state intermediary with the foreign customer and at the price of the commission agreement (taking into account the expenses connected with delivery of military products to foreign customers) for financing of perspective developments of arms and military equipment and growth in volumes of military products;

c) the order (sale and different ways of alienation, transfer to pledge and to trust management, and also other encumbrances) by shares of the joint-stock company specified in the subitem "an" of this Item is performed only based on the Federal Law, except as specified placements of the additional shares of this joint-stock company intended for the State corporation on assistance to development, production and export of high-technology industrial output Rostec.

2. a) the tenth the subitem "b" of Item 2 of the Regulations on procedure of military and technical cooperation of the Russian Federation with foreign states to state the paragraph in the following edition:

"import of military products for needs of the federal executive bodies incorporating troops and military forming within the state defense order by the state intermediary - the specialized organization created according to the decision of the President of the Russian Federation in the form of the federal state unitary enterprise founded on the right of economic maintaining or in the form of joint-stock company which 100 percent of shares is in federal property or is given to the non-profit organization created by the Russian Federation in the form of the state corporation and (or) the state intermediary providing complex field service of the Russian aircraft equipment carried to military products - the specialized organization created in the form of joint-stock company which 100 percent of shares is in property of non-profit organization the created Russian Federation in the form of the state corporation, together with head contractors (contractors) determined in the state defense order. The decision on import of military products in this case is the order of the Government of the Russian Federation about approval of the state defense order for the corresponding year;";

b) in Regulations on procedure for provision to the Russian organizations of the right to implementation of foreign trade activity concerning military products:

add Item 2 with the subitem "a.1" the following content:

"and. 1) the state intermediary providing complex field service of the Russian aircraft equipment carried to military products - the specialized organization created in the form of joint-stock company which 100 percent of shares is in property of the non-profit organization created by the Russian Federation in the form of the state corporation - concerning the military products specified in article 1 of the Federal law "About Military and Technical Cooperation of the Russian Federation with Foreign States", in the part concerning ensuring complex field service of the Russian aircraft equipment carried to military products;";

in Item 13 of the word "the state intermediary" shall be replaced with words "the state intermediaries";

c) in Regulations on procedure for consideration of addresses of foreign customers and approvals of drafts of decisions of the President of the Russian Federation, the Government of the Russian Federation and Federal Service for Military-Technical Cooperation about deliveries of military products, re-export or transfer to the third countries of the military products delivered to foreign customers and about transfer to the third countries of the military products made according to the Russian licenses:

the fifth Item 2 to state the paragraph in the following edition:

"The address of the foreign customer containing request for delivery of military products from availability of federal executive bodies is transferred for further study: to the state intermediary - the specialized organization created according to the decision of the President of the Russian Federation in the form of the federal state unitary enterprise founded on the right of economic maintaining or in the form of joint-stock company which 100 percent of shares is in federal property or it is transferred to the non-profit organization created by the Russian Federation in the form of the state corporation; to the state intermediary providing complex field service of the Russian aircraft equipment carried to military products - the specialized organization created in the form of joint-stock company which 100 percent of shares is in property of the non-profit organization created by the Russian Federation in the form of the state corporation.";

in Item 2.1:
