About basic technological organizational model of system of marking of goods means of identification in the Eurasian Economic Union

According to the order of Eurasian intergovernmental council of July 17, 2020 the No. 11 Council of the Eurasian Economic Commission solved:

1. Approve the enclosed basic technological organizational model of system of marking of goods by means of identification in the Eurasian Economic Union.

2. Ask the governments of state members of the Eurasian Economic Union in order to avoid excessive loading on business entities to provide possibility of exchange of data between the national component of system of marking created according to the Agreement on marking of goods means of identification in the Eurasian Economic Union of February 2, 2018 and national system of the traceability created according to the Agreement on the mechanism of traceability of the goods imported on customs area of the Eurasian Economic Union of May 29, 2019 on conditions and according to the procedure which are determined by the legislation of state members of the Eurasian Economic Union.

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Basic technological organizational model of system of marking of goods means of identification in the Eurasian Economic Union

I. General provisions

1. This basic technological organizational model of system of marking of goods means of identification in the Eurasian Economic Union (further - basic model) is developed for the purpose of implementation of the Agreement on marking of goods by means of identification in the Eurasian Economic Union of February 2, 2018 (further - the Agreement) and determines the unified approaches in case of introduction of marking of goods means of identification (further - marking of goods) in state members of the Eurasian Economic Union (further respectively - state members, the Union).

2. This basic model is applied in case of introduction of marking of goods according to articles 5 and 7 of the Agreement and does not extend to marking of gemstones, precious metals and products from them.

3. Council of the Eurasian economic commission (further - the Commission) having the right in case of decision making about introduction of marking of goods to establish the productions connected with features and turnover of separate types of goods of provision, other than provisions of this basic model. Including such provisions can be established concerning tobacco products, alcoholic products, medicines.

4. For the purposes of this basic model concepts which mean the following are used:

"aggregation" - ensuring interrelation of codes of identification or codes of marking of the marked goods with the code of identification or code of marking which is part of the means of identification applied on group packaging when picking of the marked goods in group packagings, and also ensuring interrelation of codes of identification or codes of marking of the marked goods and (or) group packagings with code of identification of shipping package when picking in shipping package including in case of consolidation of shipping packages in shipping packages of higher level for the purpose of ensuring receipt of data on the marked goods without the need for opening of the created packaging. The choice of option of aggregation (ensuring interrelation of codes of identification or interrelation of codes of marking) is determined by the legislation of state members;

"the internal operator" - the national operator (administrator) of state member which did not enter marking of goods in the territory and from which territory commodity exportation is performed, subject to marking, on the territory of state member which entered marking concerning such goods;

"group packaging" - packaging which combines the marked goods as a result of aggregation is subject to marking by means of identification and can be realized to the consumer entirely or is defunct for the purpose of realization of the goods enclosed in it separately with provision of data on it in national component of information system of marking of goods;

"importer" - the participant of turnover of goods registered in state member on which territory import of the marked goods from the territory of other state member is performed;

"identification code" - the sequence of symbols representing the unique number of copy of goods or group packaging including GTIN, and also serial number of the marked goods or group packaging;

"code of identification of shipping package" - the sequence of symbols representing the unique number of shipping package created taking into account aggregation of the enclosed marked goods and (or) group packagings;

"marking code" - the unique sequence of symbols used for forming of means of identification, generated by the national operator (administrator), consisting of code of identification and code of check;

"check code" - the sequence of symbols created as a result of cryptographic transformation of code of identification and allowing to reveal its falsification;

"the marked goods" - goods, it is direct on which or on consumer packaging of which means of identification or the material carrier containing means of identification, and authentic data on which (including data on the means of identification applied on it and (or) the material carrier containing means of identification) contain in national component of information system of marking of goods, is applied;

"the national operator (administrator)" - the authorized state body or authorized organization of state member enabling generation and (or) the realization (sale) of codes of marking and (or) means of identification and providing functioning of national component of information system of marking of goods;

"consumer packaging" - the packaging which is integral part of commodity unit, realized together with goods to the consumer;

"the cross-border issuer" - the national operator (administrator) of state member which entered marking of goods in the territory and on which territory import of the marked goods from the territory of other state member which did not enter marking of goods in the territory is performed;

"shipping package" - the packaging combining the marked goods and (or) group packagings, used for storage and transportation of goods for the purpose of protection them from damages when moving and forming independent transport unit.
