About approval of the Procedure for conducting complete verification of the declaration of person authorized on accomplishment of functions of the state or local self-government

According to Item 5 parts one of Article 12, parts three of article 51-1 of the Law of Ukraine "About prevention of corruption"

I ORDER:

1. Approve the Procedure for conducting complete verification of the declaration of person authorized on accomplishment of functions of the state or local self-government which is applied.

2. Submit to legal management this order on state registration to the Ministry of Justice of Ukraine.

3. To impose control of execution of this order on the vice-chairman of the National agency concerning prevention of corruption Roman Sukhostavts.

4. This order becomes effective from the date of its official publication.

Procedure for conducting complete verification of the declaration of person authorized on accomplishment of functions of the state or local self-government

I. General provisions

1. This Procedure determines the procedure of carrying out by the National agency concerning prevention of corruption (further - the National agency) complete verification of the declaration of person authorized on accomplishment of functions of the state or local self-government.

2. In this Procedure terms are used in the following values:

the direct head - the closest head to whom the authorized person is directly subordinated;

the declaration declaration of person authorized on accomplishment of functions of the state or local self-government (including the last corrected declaration), except the declaration submitted according to part three of article 45 of the Law of Ukraine "About prevention of corruption" (further - the Law);

the declaration which can be checked it is automated, - the declaration which is subject to complete check according to requirements of the law and containing the data allowing to identify the member of the family of the subject of declaring or subject to declaring, in which software of the Unified state register of declarations of persons authorized on accomplishment of functions of the state or local self-government (further - the Register) false information, signs of conflict of interest, groundlessness of assets, illegal enrichment or inaccuracy of assessment of the declared assets is not revealed;

the vice-chairman of the National agency - the vice-chairman of the National agency to which functional obligations questions of implementation of measures of financial control belong;

false information in the declaration - the data specified in the declaration according to article 46 of the Law differs from the data containing in the documents of title, judgments which took legal effect, the registers, databanks, other information and communication and help systems including containing information with limited access, holder (administrator) of which are state bodies, local government bodies, open databases, registers of foreign states, other sources of information, on the amount exceeding 100 subsistence minimums for able-bodied persons, and/or the data which do not allow to identify the member of the family of the subject of declaring or subject to declaring;

inexact data in the declaration - the data specified in the declaration according to article 46 of the Law differ from the data containing in the registers, databanks, other information and communication and help systems including containing information with limited access, holder (administrator) of which are state bodies, local government bodies, open databases, other sources of information, on the amount which is not exceeding 100 subsistence minimums for the able-bodied persons identified for date of submission of the declaration, and/or the data untrue, but on set of other data allow to identify the member of the family of the subject of declaring or subject to declaring;

subject to declaring object, data on which are specified or shall be specified in the declaration according to article 46 of the Law;
