About approval of Rules of forming and placement on domestic TV channels of social advertizing on promoting of healthy lifestyle

According to the subitem 2) Item 1 of article 14-2 of the Law of the Republic of Kazakhstan of December 19, 2003 "About advertizing" PRIKAZYVAYU:

1. Approve the enclosed Rules of forming and placement on domestic TV channels of social advertizing on promoting of healthy lifestyle.

2. To provide to department of state policy in the field of mass media of the Ministry of information and social development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of information and social development of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of information and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of information and social development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming and placement on domestic TV channels of social advertizing on promoting of healthy lifestyle

Chapter 1. General provisions

1. These rules of forming and placement on domestic TV channels of social advertizing on promoting of healthy lifestyle (further - Rules) are developed according to the subitem 2) of Item 1 of article 14-2 of the Law "About Advertising" and determine procedure for forming and placement on domestic TV channels of social advertizing by promoting of healthy lifestyle.

2. In these rules the following concepts are used:

1) the owner - the physical persons or legal entities which acquired exclusive right for use of the work and (or) object of the related rights under the agreement or other basis provided by the Law of the Republic of Kazakhstan of June 10, 1996 "About copyright and the related rights";

2) the applicant - the owner or the other person who is acting on the basis of the power of attorney on behalf of the owner who is drawn up according to the Civil code of the Republic of Kazakhstan who has the right to application for placement of social advertizing on domestic TV channels.

Chapter 2. Procedure for forming and placement on domestic TV channels of social advertizing on promoting of healthy lifestyle

Paragraph 1. Procedure for forming of social advertizing on promoting of healthy lifestyle

3. Forming of social advertizing on promoting of healthy lifestyle is performed by physical and (or) legal entities.

4. Physical and (or) legal entities create social advertizing on promoting of healthy lifestyle by independent production or by the order to mass media or other organizations on production of social advertizing for promoting of the healthy lifestyle performed on the basis of the agreement signed according to the civil legislation of the Republic of Kazakhstan.

5. Social advertizing on promoting of healthy lifestyle on domestic TV channels is created based on the following criteria:

1) compliance to the technical parameters exposed to roller of social advertizing on promoting of healthy lifestyle, established in appendix 1 to these rules;

2) compliance to the requirements established by the legislation of the Republic of Kazakhstan in the field of advertizing, TV and radio broadcasting;

3) compliance to the following directions of healthy lifestyle:

healthy and balanced diet;

physical activity (complex of physical exercises for strengthening of health);

failure from addictions (consumption of tobacco products, including products with the heated tobacco, tobacco for hookah, hookah mix, systems for heating of tobacco, electronic systems of consumption and liquids for them, psychoactive agents - substances of synthetic or natural origin (alcohol, drugs, psychotropic substances, their analogs, other stupefying substances) which in case of single acceptance make impact on mental and physical functions, behavior of the person and in case of the long use cause mental and physical dependence);

moral and emotional sphere;

prevention of diseases.

Paragraph 2. Procedure for placement on domestic TV channels of social advertizing on promoting of healthy lifestyle

6. Placement of social advertizing on promoting of healthy lifestyle is performed by TV channels according to the criteria provided by these rules.

7. For placement on domestic TV channels of social advertizing on promoting of healthy lifestyle applicants submit the following documents:

1) the request for placement of social advertizing on promoting of healthy image according to appendix 2 to these rules;

2) roller of social advertizing on promoting of healthy lifestyle in the Kazakh and Russian languages, on the external electronic medium providing invariance of quality of roller by its transfer on other carriers;

3) the document confirming exclusive right on use of the work and (or) object of the related rights.

8. For the purpose of selection of social advertizing on promoting of healthy lifestyle, domestic TV channel will organize meeting with participation of representatives of non-governmental public organizations, entrepreneurs and the interested state bodies, in number of at least five participants.

Social advertizing on promoting of healthy lifestyle is subject to placement on domestic TV channels if most of the present participants of meeting voted for it.
