About implementation of notifying procedure for state registration and registration of subjects of entrepreneurship

For the purpose of creation of more favorable conditions for the organization of business activity by decrease in administrative costs, elimination of bureaucratic barriers and obstacles in case of state registration and registration of subjects of entrepreneurship:

1. Establish since September 1, 2006 procedure for state registration of subjects of entrepreneurship on notifying basis, except for registration of entrepreneurs on which the solution on withdrawal of the parcels of land, on connection to gas and power networks, and also on the licensed types of activity is required.

2. Determine that:

state registration of subjects of entrepreneurship is performed, respectively, by judicial authorities or Inspectorates for registration of subjects of entrepreneurship under khokimiyats of areas (cities) with their simultaneous statement on accounting in tax and statistical authorities;

term from the moment of submission of the statement notification before state registration of the subject of entrepreneurship with issue of the certificate on state registration constitutes no more than two working days.

3. Approve Regulations on notifying procedure for state registration and registration of subjects of entrepreneurship according to appendix.

4. 7. To the Ministry of Justice of the Republic of Uzbekistan:

establish tough control of observance of notifying order of registration of subjects of entrepreneurship;

perform the publication on regular basis in mass media of materials, organize cycle of telecasts on explanation of notifying order of registration of subjects of entrepreneurship;

provide together with Chamber of Commerce and Industry of the Republic of Uzbekistan carrying out in regions of seminars in the main directions of the Regulations on notifying procedure for state registration and registration of subjects of entrepreneurship with broad attraction of the population and employees of relevant organs of the government and management on places.

8. To the Ministry of Justice of the Republic of Uzbekistan together with the interested ministries and departments in two-month time to make in the Cabinet of Ministers offers

the changes and amendments in the legislation following from this resolution;

establishment of the administrative responsibility for violation of notifying order of registration of subjects of entrepreneurship.

9. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan Azimov R. S.

Regulations on notifying procedure for state registration and registration of subjects of entrepreneurship

I. General provisions

1. This Provision determines procedure and terms of state registration of subjects of entrepreneurship on notifying basis in the Ministry of Justice of the Republic of Uzbekistan, the Ministry of Justice of the Republic of Karakalpakstan, regional justice departments, in Inspectorates for registration of subjects of entrepreneurship under khokimiyats of areas (cities) (further - registering bodies) with their statement on accounting in the state tax and statistical bodies.

This Provision does not extend to state registration of subjects of entrepreneurship on which the solution on withdrawal of the parcels of land, on connection to gas and power networks, and also on the licensed types of activity is required.

6. The state fee is paid for state registration of the subject of entrepreneurship on notifying basis.

five minimum wages and 500 US dollars - for the companies with foreign investments;

four minimum wages - for bodies of economic board in the form of the joint stock companies (including state joint-stock companies and holdings) created by relevant decisions of the President and the Government of the Republic of Uzbekistan, and also the markets and the organizations of tax consultants.

20 percent from the state fee are transferred in Fund of development of courts and judicial authorities, and other amount - respectively in the republican budget of the Republic of Uzbekistan, budgets of areas and cities.
