Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations arising in connection with creation and use of works of science, literature and arts (copyright), execution, soundtracks, transfers of the organizations of on-air or cable broadcasting (related rights).

Article 2. Legislation on copyright and related rights

The legislation on copyright and the related rights consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are provided in the legislation of the Republic of Uzbekistan on copyright and the related rights then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

work copy - the copy of the work made in any material form;

public display of the work - demonstration of the original or copy of the work it is direct or on the screen by means of film, slide, television shot or by means of any other technical means, and also demonstration of separate personnel of the audiovisual work without respect for their sequence in the place open for public, or in the place where there is wide range of persons which are not members of the same family;

promulgation of the work - the action performed with the consent of the author which for the first time makes the work available for general data by its publication, public display, public performance, transfer to air or otherwise;

the audiovisual work - the work consisting of the fixed series of the images connected among themselves (with maintenance or without their sound), intended for visual and acoustical (in case of maintenance by sound) perceptions by means of the appropriate technical means, including the works of cinematography and all works expressed by the means similar cinema (body - and videos, filmstrips, slaydfilma and other works), irrespective of method of their initial or subsequent fixing;

the manufacturer of the audiovisual work - the legal entity or physical person which took the lead and responsibility for production of such work;

informing everyone - the message of works or objects of the related rights for general data on wires or means of wireless communication in such a way that users of telecommunication systems can provide access to them from any place and at any time at their own choice;

the message for general data - transfer of works or objects of the related rights in air, the message on cable, and also their finishing by any other methods (except for distribution of copies) before acoustical and (or) visual perception by public which representatives are not in the place of the message irrespective of whether works or objects of the related rights which became available thus are perceived actually;

record - fixing of sounds and (or) images by means of technical means in any material form allowing to perform their numerous perception, reproduction or the message;

execution - submission of the work (including performing folk art), soundtracks, execution, statements by means of game, the recitation, singing, dance in live execution or by means of technical means;

the contractor - the actor, the singer, the musician, the dancer or other physical person who plays role, sings, reads, recites, dances, interprets, plays musical instrument or otherwise performs the literary work or arts (including performing folk art), and also the production director of performance and the conductor;

the message on cable - the message of works or objects of the related rights for general data by means of cable, wire or by means of similar means;

performing arts and crafts - the two-dimensional or three-dimensional work of art, to the original or copies of which are used as objects of practical use or are postponed for such objects, including performing art trade or the work produced by industrial method;

the database - data set (Articles, calculations, etc.) expressed in objective form and systematized so that these data could be found and processed by means of electronic computers (further - EVM);

the author - physical person which creative activity creates the work;

the public performance - bringing works or objects of the related rights to acoustical and (or) visual perception by means of execution or any other form of the message, is direct or by means of technical means, in the place open for public, or in the place where there is wide range of persons which are not members of the same family;

delivery in hire - provision for the purpose of commercialization of the original or copies of works or objects of the related rights in temporary use;

reprographic reproduction - facsimile reproduction in any size and in any form of one or more copies of originals of written and other works or their copies by photocopying or by means of other technical means, except cases of production of reproductions of works of the fine arts using type-setting printing forms. Reprographic reproduction does not include storage or reproduction of the specified copies in digital form, except as specified creations of the temporary copies caused by features of the technical means used for reprographic reproduction;

relaying - simultaneous transfer to air or the message on cable of transfer of on-air or cable broadcasting to one organization by other organization of on-air or cable broadcasting;

reproduction - production of one or more copies of works or objects of the related rights or their parts in any manner and in any material form, including production in three dimensions of one or more copies of the two-dimensional work and in two measurements - one or more copies of the three-dimensional work, record in computer memory and other electronic devices;

soundtrack - any exclusively sound record of any execution, other sounds, except for the sound record included in the audiovisual work;

soundtrack copy - the copy of soundtrack on any material carrier made directly or indirectly from soundtrack all sounds or part of the sounds fixed in this soundtrack also join;

the manufacturer of soundtrack - the legal entity or physical person which took the lead and responsibility for the first sound record of execution or other sounds;

performing folk art - fairy tales, songs, dances, performing arts and crafts and other results of art and amateur folk art which do not have the specific author;

publication - release into the stream of commerce of copies of the work, record of execution or soundtrack with the consent of the author of the work, the contractor or the manufacturer of soundtrack in the quantity sufficient for satisfaction of reasonable needs of public proceeding from nature of the work, record of execution or soundtrack;

transfer to air - the message of works or objects of the related rights for general data by means of their transfer on radio or (to television, including via satellites (except for cable television). By transfer of works or objects of the related rights in air via the satellite transfer to air is understood as acceptance of signals from land station on the satellite and signaling from the companion by means of which the work or objects of the related rights can be brought to the general attention irrespective of the actual acceptance by their public;

the organization of on-air or cable broadcasting - the person who took the lead and responsibility for transfer to air or the message of cable and performing them in accordance with the established procedure;

transfer of on-air or cable broadcasting to the organization - the program created by the organization of on-air or cable broadcasting and also by its order and at the expense of its means - other organization;

the owner - the author or his heirs concerning copyright, the contractor or his heirs, the manufacturer of soundtrack, the organization of radio or cable hanging concerning the related rights, and also other legal entities or physical persons which acquired the rights to use works or objects of the related rights under the agreement or on other basis provided by this Law.

Chapter 2. Copyright

Article 4. Copyright coverage

According to this Law copyright extends:

on works of the authors or other initial owners of copyright who are citizens of the Republic of Uzbekistan or taking permanent place of stay in the territory of the Republic of Uzbekistan;
